Scott and I met with Paul Harstad and his contractor sometime in
early May or June. At that time, we told him about the 1991
Wetland Conservation Act and that we would need to evaluate the
amount of fill or drainage which would occur prior to issuing a
building or land alteration permit. We directed him to contact the
Rice Creek Watershed District, and I sent him a copy of the Act.
Shortly thereafter, he applied to the Rice Creek Watershed District
for a permit. They indicated that they would need to review a
detailed site survey with the boundary of the wetland clearly
delineated on it. To my knowledge, such a survey was never
submitted. �
I informed the Building Inspection Department that no work was to
occur on the lot until the requirements of the Act were met.
All of these activities occured prior to the Legislature completing
the 1993 Amendments to the Act. It may be that they will fill less
than 400 square feet and would be exempt from the replacement
requirements, but they still will need to submit a detailed site
survey and have the wetland fully delineated.

This letter is to inquire as to the status of your development on
the two single family lots located on East Danube Road in Fridley.
We received notification from the Rice Creek Watershed District
that the application for permits has been inactive over the summer.
Please recall that prior to any development occurring, the 1991
Wetland Conservation Act requires the City to certify that the
activity occurring in any wetland is exempt or that a replacement
plan has been approved.
In 1993, the Legislature amended the Act to exempt areas of fill
400 square feet or smaller. While the exemption would not require
you to develop a replacement plan for any area filled, you will
still need to have the property surveyed and the wetland edge
delineated so that the area of fill can be calculated. This
information will be required prior to issuance of a land alteration
permit or a building permit by the City.

I sent a letter to Paul Harstad, owner of two residential lots
located on East Danube Road N.E. The lots contain wetland areas,
and therefore fall under the jurisdiction of the 1991 Wetland
Conservation Act. Mr. Harstad has indicated that he intends to
make the lots buildable and has contacted the Rice Creek Watershed
District regarding their requirements pertaining to the 1991
Wetland Conservation Act. If the areas to be filled or drained are
less than 400 square feet in area, the draining or filling may be
permitted under the 1993 amendments to the Act.
We will continue to monitor the activity on these lots to insure
compliance with the 1991 Wetland Conservation Act.

This is to summarize the City's position reqardinq issuance of a
building permit on the above-referenced lots. The City will
issue a building permit upon submission, review, and approval of
the following documents:
1. Submission of a hvdroloaic analvsis identifvincx the impacts
to adiacent prooerties of the construction of a sinale
familv detached dwellina on Lot 5. The purpose of the study
is�to determine if there will be adverse impacts to
surrounding properties from the construction of a dwelling
on the property. Two reports of a high water table and
increased flooding have been received from-awners of the
rt' t 5535 and 5505 West Danube Road N.E. Another

rep�ort of increased runoff was also reported by �he ��n�r �f y d
the property at 5477 East Danube Road N.E. The analysis P��,�`
must be completed by a certified hydrologist If adverse ��

2. Completion of soil borinas and submission of soil borin�
reports. The report must analyze the suitability of the
soil and fill below the 100 foot elevation and above the 100
foot elevation as indicated on the grading plan submitted
April 1994. If determined appropriate by the City, existing
fill above the 100 foot elevation may have to be removed and
may be a stipulation of permit approval.

3. Lots 5 and 6 shall be combined for tax purposes into one tax
varcel. Further, the areas on Lot 6 identified on the
attached plan shall be excavated.
4. The developer shall meet with surroundinq owners and review
the results of the studies in #1 and #2.
State�Building Code Chapter 1305.0106 Section 106, Permits,
refers to Section 106.3.2 of the Uniform Buildinq Code which
reads: "Plans, specifications, enqineering calculations,
diagrams, soil investigation reports, special inspection and
structural observation programs, and other data shall constitute
the submittal documents and shall be submitted in one or more
sets with each application for a permit." Further, Chapters 18
and 33 of the IIBC provide the City with the authority to require
any necessary tests to insure that the soil and site geology are
;:appropriate for construction. The City has the authority to
require the analysis described in Items �1 and �2.
