10. STIPULATIO�TS - RFAD BEE`ORE SIGNING APPLICATIOl�1:
a. A surety bond or ceritifiec] check in the amount of $�./►yl
(5$ of value of work to be completed) must be submittecl after
approval of applie;ation anal prior to any work commencing. This
bond or check is to ensure satisfactory performance and
compliance with the belaw stated stipulations. The surety bond
or check shall be kept active until the completion of work
and/or expiration of permit and'can only � released by written
notification of the City after a satisfactory final inspection
has �� performed by City forces.
b. All access anc7 street frontage of the land alteration site must
be controlled by a fence, a min�ma of four (4) feet in height.
All entrances must have gates that are capable of �ing locked.
c. Only rock, sand, gravel, dirt, or similar natural earth f ill is
permitted. No coa�re�e, asphalt, or demolition wastes will be
penni�ted as fill iPG4 a clenolition landfill permit-is first
obtair�d from Anoka County.
d. Operations shall be limitecl to daylight hours and shall not
interfere with the health and safety of surrounding residents
and the premises shall be maintained at all times so as not to
create a nuisance.

e. Any explosives usec7 must be done so in accordance with Chapter
212.3, paragraphs d, e, f, g, of the Fridley City Cocle and any
other applicable standard e.g. Federal, State, Industrial, etc.
f. At the encl of each season's operations and no later than the
last day of December each year, the site is to be left in a neat
and orderly condition, with maximum slopes of 2:1 with no
overhang or vertical banks and with a level bottom.
g. On the Friday of each work week, or when required by the City,
material from this operation that is found to exist on City
streets shall be cleaned to the City's satisfaction by the
applicant.
h. Upon completion of lar� alteration operations, the land must be
left acoording to the plans and contours submitted with this
application and planted with suitable vegetation to prevent
erosion.
i. Upon completion of land alteration operations or expiration of
this permit, an inspection by the City will be made of the
pre9nises and adjoining streets. Any da�nage found to have been
caused by these operations will be corrected by the applicant

ADDENDUM TO BURLINGTON NORTIILTtNv6�

The Permittee shall procure and furnish to the Railroad a policy of Public
Liability and Property Dama�e Liability Insurance as herein provided, or certificate
with respect thercto, together with a Contractual Liability Lndorsement attached thereto,
under the torms of which the insuring agreements of the policy are extended to cover the
liability asswned by the Permittee hereunder. The form of said Endorsement is hereto
attached, marked Exhibit "B'�.
The Permittee shall carry regular Contractor's Public Liability Insurance
providing for a limit of not less than Five Hundred Thousand Dollars ($500,000.00)�
for all damages arising out of the bodily injuries to or death of one person, and,
subject to tliat limit for each person, a total limit of not less than One Ftillion
Dollars (�1,000,000.00) for all dama�es arising out of bodily injuries to or death of
two or more parsons, in any one accident, and regular Pro�erty Damage Liability Insurance
providing for a litnit of not less than Five Ilundred Thousand Dollars ($SOO,A00.00) for
all damages to or dastruction of property in any one accident, and suhject to that lir�it
a total (or aggregate) limit of not less than One Alillion Dollars ($1,OQ0,000.00) for
all damages to or destruction of property durinfi the policy period.
Such policy or certificate with resnect thereto, to�;etlier with said Contractual
Liability Enderse�ent attaclied thereto, shall be submitted to the Railroad for approval
as to the insurance company writing same, the amount and the�fon►i, and, upon approval
and prior to commencement of any work to be performed under this agreement, the Permittee
shall deposit t}►e same with tlie Railroad.
It is undorstood that said insurance policies shall be so written that no
insurance company shall have any recourse against the Railroad, by way of subro�;ation
or othen+rise, for any loss covered by or paid or payable under said policies.
