REQUEST
The petitioners, Brian and Virginia George are seeking two variances to reduce the side yard
setback on the south and north sides of the house for living space.
• The first variance is to reduce the north side yard setback for living space from 10 ft. to
7 ft. to recognize the existing non-conforming setback of the existing house and to
expand that non-conforming setback by constructing a 16 ft. by 21.5 ft. addition to their
house.
• The second variance is to reduce the south side yard setback for living space from 13 ft.
to 6 ft. to recognize the existing non-conforming setback of the existing house and to
allow the construction of a covered porch in the front of their house which is located at

The recognition of the non-conforming setback is required prior to issuance of any building

The property is zoned R-1 Single Family as are all
surrounding properties, with the exception of the Z ,5, 14t

south of Mississippi Street. The lot is a narrow �, ,,a
rectangular lot, with the house facing East River

Road. The property is a unique single family lot in
that it is 50 ft. wide and 300 ft. long and the house 841e

line. There are no building permit records for the

located on the property directly south at 6414 East River Road. This easement also services
the property at 6410 East River Road.
This lot is in the O-6 Overlay District, which was created to allow the expansion of existing
homes and construction on new homes on lots created and recorded prior to December 29,
1955, that are between 5,000 and 7,499 square feet in size and have narrower lot widths. This
overlay not only recognizes smaller lot sizes as conforming, it also allows for more compatible
setback and lot coverage requirements than a typical single family lot.
The O-6 Overlay district requires a side yard setback of ten (10) feet. The petitioner is seeking
to reduce the north side yard setback requirement from 10 ft. to 7 ft. to simply recognize the
existing non-conforming setback of the existing house. They would also like to construct a 16
ft. by 21.5 ft. addition at the same setback. The O-6 Overlay district also requires a minimum
side yard setback of thirteen (13) feet where a house is built without an attached garage, so
that there is access to the rear yard for a detached garage and off-street parking. The
petitioner is also seeking a variance to reduce this requirement from 13 ft. to 6 ft. to recognize
the existing setback of the house and construct a covered porch to the front of the house. As
was stated earlier, the petitioners have a 10 ft. easement south of their property line to allow
access to their site. As a result, the 6 ft. setback between the house and property line won't be
as severe because of the easement area. The property lines on this property are already
impacted due to the location of the existing house, expanding the non-conformities shouldn't
have any additional negative impacts to neighboring properties.
Recognition of these non-conformities is required before the petitioner can construct an addition
to the existing house.

Staff would like to point out that a building permit was issued for the petitioner's to start
construction of their addition. It was at the time of footing inspection that our Building Inspector
determined that the proposed addition and the existing house didn't meet setback
requirements. The petitioner's construction company who filed the permit had accidentally
depicted the lot at 60 ft. wide, when it actually is 50 ft. wide. As a result, the existing house and
the proposed addition didn't meet setback requirements.
City staff hasn't heard from any neighboring property owners.
RECOMMENDATIONS
City Staff has no recommendation as these variances are within previously granted dimensions.

Mr. Hickok said that Staff recommends that if the variance is granted, the following
stipulation be attached.
1. Petitioner shall clzeck with the building department prior to starting construction
to ensu��e all requirements ha>>e been met.
Commissioner Jones asked for an explanation of the Overlay District.
Mr. Hickok said that in 2003 the City analyzed the existence of 50' wide lots in the city.
Families had built homes on the lots and they were non-conforming. Because the lots
were non-conforming, if a home was destroyed by a fire, city ordinance would not let the
same home be built on that lot. It was decided to recognize all 50' wide lots as
conforming so residents could reinvest in their homes such as put on a porch or family
room. It was a way to promote reinvestment.
Chai�rperson Sielaff asked if staff had received any comments from neighbors.
Mr. Hickok answered no.
Virginia George, 6420 East River Road NE, said that when they purchased the property
they were told the lot was 60' x 288'. These lot dimensions were used when they started
draw up plans for their remodel project. They started construction but when the inspector
came out they were told there may be a problem. They would like to build a family room,
two additional bedrooms and a front porch. This addition would enable them to stay in
Fridley for a while.

Commissioner Anderson also did not have an issue with this item. He commented that
it is great people want to upgrade their homes in Fridley.
MOTOIN by Commissioner Jones to approve the Consideration of a Variance, VAR 08-
08, by Brian & Virginia George, to reduce both the North and south side yard setbacks
for living space to recognize the non-conforming placement of the existing home.
Reducing the south side yard setback from 10 feet to 6 feet and the north side yard
setback from 10 feet to 6 feet and the north side yard setback from 10 feet to 7 feet to
recognize the setback of the existing house and to allow an addition to the house at that
setback, generally located at 6420 East River Road NE. Seconded by Commissioner
Anderson.

UPDATE ON P�.ANNING COMMISSION & CITY COUN
Scott Hickok, Co unity Development Director, said that the sign on Main Street with
Industrial Equities as approved. The sign in the safety vision triangle will be moved
and the other two v iances were granted. The Northstar Corridor is moving towards the
CTIB grant applicati n for the '/4% sales tax pool funds. These funds will be used for
transportation project There are three projects applying for funding tliis round and
Fridley is one of three ojects applying. Staff should hopefully know by the end of
October about the fundi . If all goes as planned, Fridley will be on line for November
2009 to have a station. T\Commissioners, Council and Staff have worked very hard to
get this through.
