Existing Zoning: R-1 (Single Family Residential) Location: 6420 East River Road Size: 15,000 sq. ft. .34 acres Existing Land Use: Single Family Home Surrounding Land Use & Zoning: N: Single Family & R-1 E: Single Family & R-1 S: Single Family & R-1 W: Neiahborhood Park & P Comprehensive Plan Conformance: Consistent with Plan Zoning Ordinance Conformance: O-6 Overlay District: Section 205.31.5.D.(2) requires a side yard setback of ten (10) feet. Section 205.31.5.D.(2) ((a)) requires a side yard setback of 13 ft. for housing without a detached garage. Zoning History: 1950 — Lot is platted. House built prior to 1949. Legal Description of Property: Lot 27, Revised Auditor's Subdivision No. 23, except road, subject to easement of record. Public Utilities: Home is connected. Transportation: East River Road provides access to the property. Physical Characteristics: Narrow suburban lot where property receives access from an easement that also serves two other properties. SUMMARY OF PROJECT Mr. and Mrs. George are seeking finro variances to reduce the side yard setback on the south and north sides of the house for living space. • The first variance is to reduce the north side yard setback for living space from 10 ft. to 7 ft. to recognize the existing non-conforming setback of the existing house and to expand that non-conforming setback by constructing an addition to their house. • The second variance is to reduce the south side yard setback for living space from 13 ft. to 6 ft. to recognize the existing non- conforming setback of the existing house and to allow the construction of a covered porch in the front of their house which is located at 6420 East River Road. SUMMARY OF HARDSHIP "We would like to apply for a residential building variance for our home located at 6420 East River Road because our home was built in the late 1930's and does not meet curreni minimum side /ot setbacks on either side of the structure." - Brian & Virginia George SUMMARY OF ANALYSIS City Staff has no recommendation as these variances are within previously granted dimensions. Similar variances granted: ■ VAR #00-23 369 Hugo Street Variance approved to reduce the side yard setback from 10 ft. to 5 ft. to allow a home expansion ■ VAR #00-19 1352 Hillcrest Drive Variance approved to reduce the side yard setback from 10 ft. to 5 ft. to recognize an existing non-conformity. CITY COUNCIL ACTION/ 60 DAY DATE City Council — October 13, 2008 60 Dav — December 4, 2008 Existina House Staff Report Prepared by: Stacy Stromberg VAR #08-08 REQUEST The petitioners, Brian and Virginia George are seeking two variances to reduce the side yard setback on the south and north sides of the house for living space. • The first variance is to reduce the north side yard setback for living space from 10 ft. to 7 ft. to recognize the existing non-conforming setback of the existing house and to expand that non-conforming setback by constructing a 16 ft. by 21.5 ft. addition to their house. • The second variance is to reduce the south side yard setback for living space from 13 ft. to 6 ft. to recognize the existing non-conforming setback of the existing house and to allow the construction of a covered porch in the front of their house which is located at 6420 East River Road. The recognition of the non-conforming setback is required prior to issuance of any building permits for the proposed addition to the house. SUMMARY OF HARDSHIP "We would like to apply for a residential building variance for our home located at 6420 East River Road because our home was built in the late 1930's and does not meet current minimum side lot setbacks on either side of the structure."— a/so see attached hardship statement - Brian & Virginia George ANALYSIS The property is zoned R-1 Single Family as are all surrounding properties, with the exception of the Z ,5, 14t neighborhood park west of the subject property. ;6 6 The subject property is located on East River Road south of Mississippi Street. The lot is a narrow , ,,a rectangular lot, with the house facing East River 643 Road. The property is a unique single family lot in that it is 50 ft. wide and 300 ft. long and the house 841e is situated 206 ft. back from the front yard property ,,, line. There are no building permit records for the construction of the existing house or garage, so it ,N` 18' " appears that they were both constructed prior to 635, 1949. The petitioners have stated in their hardship ,, 8 letter that they believe the house was constructed 6331 in the late 1930's. The lot is also unique in the fact 632 ' 'E that it receives access from a 10 ft. easement 12 f "' 6437 6431 120 110 ,QQ , z x eazo j O, 5409 ' fi4,4 ti408 6410 98 123 111 135 us ia 7 17Q `t-'8' 146'1,122 `110 1 ,,1,59 S,4 1 135 l,23 4,,, 'K located on the property directly south at 6414 East River Road. This easement also services the property at 6410 East River Road. This lot is in the O-6 Overlay District, which was created to allow the expansion of existing homes and construction on new homes on lots created and recorded prior to December 29, 1955, that are between 5,000 and 7,499 square feet in size and have narrower lot widths. This overlay not only recognizes smaller lot sizes as conforming, it also allows for more compatible setback and lot coverage requirements than a typical single family lot. The O-6 Overlay district requires a side yard setback of ten (10) feet. The petitioner is seeking to reduce the north side yard setback requirement from 10 ft. to 7 ft. to simply recognize the existing non-conforming setback of the existing house. They would also like to construct a 16 ft. by 21.5 ft. addition at the same setback. The O-6 Overlay district also requires a minimum side yard setback of thirteen (13) feet where a house is built without an attached garage, so that there is access to the rear yard for a detached garage and off-street parking. The petitioner is also seeking a variance to reduce this requirement from 13 ft. to 6 ft. to recognize the existing setback of the house and construct a covered porch to the front of the house. As was stated earlier, the petitioners have a 10 ft. easement south of their property line to allow access to their site. As a result, the 6 ft. setback between the house and property line won't be as severe because of the easement area. The property lines on this property are already impacted due to the location of the existing house, expanding the non-conformities shouldn't have any additional negative impacts to neighboring properties. Recognition of these non-conformities is required before the petitioner can construct an addition to the existing house. Left Picture — Side yard setback reduction to 6 ft. (Location of front porch addition) Right Picture — Location of the addition off the back of the home Staff would like to point out that a building permit was issued for the petitioner's to start construction of their addition. It was at the time of footing inspection that our Building Inspector determined that the proposed addition and the existing house didn't meet setback requirements. The petitioner's construction company who filed the permit had accidentally depicted the lot at 60 ft. wide, when it actually is 50 ft. wide. As a result, the existing house and the proposed addition didn't meet setback requirements. City staff hasn't heard from any neighboring property owners. RECOMMENDATIONS City Staff has no recommendation as these variances are within previously granted dimensions. Consideration of a Variance, VAR 08-08, by Brian & Virginia George, to reduce both the North and south side yard setbacks for living space to recognize the non-conforming placement of the existing home. Reducing the south side yard setback from 10 feet to 6 feet and the north side yard setback from 10 feet to 6 feet and the north side yard setback from 10 feet to 7 feet to recognize the setback of the existing house and to allow an addition to the house at that setback, generally located at 6420 East River Road NE. MOTION by Commissioner Jones to open the public hearing. Seconded by Commissioner Anderson. UPON UNANIMOUS VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SIELAFF DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:08 P.M. Scott Hiclok, Community Development Director, said that the petitioners are seeking two variances to reduce the side yard setback on the south and north sides of the house + , _r. _ for living space. The first variance is to reduce the north side yard setback from 10 feet to 7 feet to recognize the existing non-conforming setback of the existing house and to expand that non-conforming setback by constructing a 16 feet by 21.5 feet addition to their house. The second variance is to reduce the south side yard setback from 13 feet to 6 feet to recognize the existing non-conforming setback of the existing house and to allow the construction of a covered porch in the front of their house which is located at 6420 East River Road. The recognition of the non-conforming setback is required prior to issuance of any building permits for the proposed addition to the house. Mr. Hickok reviewed the petitioners hardship; "We would like to apply for a residential building variance for our home located at 620 East River Road because our home as built in the late 1930's and does not meet current minimum side lot setbacks on either side of the structure. " - Brian & Virginia George Mr. Hickok said that the property is zoned R-1 Single Family as are all surrounding properties, with the exception of the neighborhood park west of the subject property. The lot is a narrow rectangular lot, with the house facing East River Road. The property is a unique single family lot in that it is 50 feet wide and 300 feet long and the house is situated 206 feet back from the front yard property line. Mr. Hickok said that there are no building permit records for the construction of the existing house or garage, so it appears that they were both constructed prior to 1949. The lot is also unique in the fact that it receives access from a 10 feet easement located on the property directly south at 6414 East River Road. This easement also services the property at 6410 East River Road. Mr. Hickok said that this lot is in the O-6 Overlay District, which was created to allow the expansion of existing homes and construction on new homes on lots created and recorded prior to December 29, 1955, that are between 5,000 and 7,499 square feet in size and have narrower lot widths. This overlay not only recognizes smaller lot sizes as conforming, it also allows for more compatible setback and lot coverage requirements than a typical single family lot. The O-6 Overlay district requires a side yard setback of 10 feet. The petitioner is seeking to reduce the north side yard setback from 10 feet to 7 feet to recognize the existing non-conforming setback of the existing house. Mr. Hickok said that the petitioner would also like to construct a 16 feet by 21.5 feet addition at the sa.me setback. The O-6 district also requires a min. side yard setback of 13 feet where a house is built without an attached garage. The petitioner is seeking a variance to reduce the south side setback from 13 feet to 6 feet to recognize the existing setback of the house and construct a covered porch to the front of the house. The 6 feet side yard setback on the south side of the house will be less of an impact as a result of the 10 feet easement area that exists south of the petitioner's property line. Mr. Hickok said that the recognition of these non-conformities is required before the petitioner can construct an addition to the existing house. Staff would like to point out that a building permit was issued for the petitioner's to start construction of their - . . . . . . addition. It was at the time of footing inspection that our Building Inspector determined that the proposed addition and the existing house didn't meet setback requirements. The petitioner's construction company who filed the permit had accidentally depicted the lot at 60 feet wide, when it actually is 50 feet wide. As a result, the existing house and the proposed addition didn't meet setback requirements. Mr. Hickok said that City Staff has no recommendation as these variances are within previously granted dimensions. Similar variances granted were VAR #00-23 369 Hugo Street — Variance approved to reduce the side yard setback from 10 ft. to 5 ft. to allow a home expansion; and VAR #00-19 1352 Hillcrest Drive — Variance approved to reduce the side yard setback from 10 ft. to 5 ft. to recognize an existing non-conformity. Mr. Hickok said that Staff recommends that if the variance is granted, the following stipulation be attached. 1. Petitioner shall clzeck with the building department prior to starting construction to ensue all requirements ha>>e been met. Commissioner Jones asked for an explanation of the Overlay District. Mr. Hickok said that in 2003 the City analyzed the existence of 50' wide lots in the city. Families had built homes on the lots and they were non-conforming. Because the lots were non-conforming, if a home was destroyed by a fire, city ordinance would not let the same home be built on that lot. It was decided to recognize all 50' wide lots as conforming so residents could reinvest in their homes such as put on a porch or family room. It was a way to promote reinvestment. Chairperson Sielaff asked if staff had received any comments from neighbors. Mr. Hickok answered no. Virginia George, 6420 East River Road NE, said that when they purchased the property they were told the lot was 60' x 288'. These lot dimensions were used when they started draw up plans for their remodel project. They started construction but when the inspector came out they were told there may be a problem. They would like to build a family room, two additional bedrooms and a front porch. This addition would enable them to stay in Fridley for a while. MOTOIN by Commissioner Brown to close the public hearing. Seconded by Commissioner Jones. UPON UNANIMOUS VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SIELAFF DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:25 P.M. Commissioner Brown said he did not have an issue with this item and he would be in favor for it. . .- - . .. . ' M Commissioner Jones agreed and understood the hardship of the homeowner. Commissioner Anderson also did not have an issue with this item. He commented that it is great people want to upgrade their homes in Fridley. MOTOIN by Commissioner Jones to approve the Consideration of a Variance, VAR 08- 08, by Brian & Virginia George, to reduce both the North and south side yard setbacks for living space to recognize the non-conforming placement of the existing home.
