READ BEFORE SIG1vING APPLICATION
1. A surety bond or certified check in the amount of $ / 0 0— (5% of value of work to be
completed) must be submitted after approval of application and prior to any work commencing. This
; bond or check is to ensure satisfactory performance and compliance with the below stated
stipulations. The surety bond or check shall be kept active until the completion of work and/or
expiration of permit and can only be released by writter��otification of the City after a satisfactory
final inspection has been performed by the City.
2. All access and street frontage of the land alteration site must be controlled by a fence, a minunum
of four (4) feet in height. All entrances must have gates that are capable of being locked.
3. Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or
demolition wastes will be permitted as fill unless a demolition landfill permit is first obtained from
Anoka County.
4. Operations shall be limited to daylight hours and shall not intef�'ere with the health and safety of
surrounding residents and the premises shall be maintained �all ti.mes so as not to create a
nuisance.

S. Any explosives used must be done so in accordance with Chapter 212, subsections 212.07.SA, .SB,
.SC, .SD, and .SF. of the Fridley City Code and any other applicable standards, e.g. Federal, State,
Industrial, etc.
6. At the end of each season's operations and no later than the last day of December each year, the
site is to be left in a neat and orderly condition, with maximum slopes of 2:1 with no overhang or
vertica.l banks and with a level bottom.

On the Friday of each work week, or when required by the City, material from this operation that
is found to exist on City streets shall be clea.ned to the City's satisfaction by the applicant
Upon completion of land alteration operations, the land must be left according to the plans and
contours submitted with this application and planted with suitable vegetation to prevent erosion.
9. Upon completion of land alteration operations or expiration of this permit, an inspection will be
made by the City of the premises and adjoining streets. Any damage found to have been caused by
these oper�s will be corrected by the applicant upon notification by the City.

Sedion 404 Onlv Conditions In addition to the General Conditions, the following conditions apply only to activities
that involve the discharge of dredged or fill material and must be followed in order for authorization by the nationwide
permits to be valid:
1. Water suaplv intakes. No discharge of dredged or fill material may occur in the proximity of a public water
supply intake excep[ where the discharge is for repair of the public water supply intake structures or adjacent bank
stabiliza[ion.
2. Shellfish oroduction. No discharge of dredged or fiU material may occur in areas of coacentrated shellfish
production, unless the discharge is directly related to a shellfish harvesting activity authorized by nationwide pemu[ 4.
3. Suitable material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash,
debris, pr bodies, etc.) and material discharged must be free from torac pollutants in toxic amounts (see section 307 of
the Clean Water Act).
4. Miti�ation. Discharges of dredged or fill material into waters of the United States must be minimized or
avoided to the maximum extent practicable at the project site (i.e. on-site), uNess the DE has apprwed a
compensadon mitigadon plan for the specific regulated activity.
5. Snawnine areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum
extent practirable.
6. Obstruction pf hish flows. To the maximum extent practicable, discharges must not permanentty restrict or
impede the passage of normal or expected high flows or cause Ehe relocation. of the water (unless the primary purpose
of the fill is to impound waters).
7. Adverse imnacts from impoundments. If the discharge crcates an impoundment of water, adverse impacts on
the aquatic system caused by the aecelerated passage of water and/or the restricdon of its flow shalt be minimized to
the ma�mum extent practicable.
8. Waterfowl breedin� areas. Discharges into breeding areas for migratory waterfowl must be avoided to the
ma�mum ex[ent practipble. � '
9, Removai of temaorarv fills. Any temporary filis mus! be remwed in their entirety and the affected areas
retumed to their pree�sting elevation.
C. PTatianwide Permit Conditioas
General Conditians: The following general conditions must be followed in order for any authorization by a nationwide
permit to be valid:
1. Navieation. No activity may quse more than a minimal adverse effect on navigatioa

3. Erosion and silta6an oontrols. Appropriate erosion and siltatioa wntrols must be used and maintained in

the earHest practipble date.
4. Aquatic Iife mwements. No activity may substantiaily disrupt the movement of those species of aquatic Gfe
indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's
primary purpcue is to impound water.

to minimize soil disturbance.
6. Re�ional and case-bv�ase cqnditions. The activity must compty with any regional conditions which may have
been added by the division engineer (see 33 CFR 330.4(e)) and airy case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a compoaent of the Na[ional Wild and Scenic River System;
or in a river ofl9cially designated by Congress aS a"study river" for possible iaclusion in the system, while the river is in
an official study status. Informadon on Wild and Scenic Rivers may be obtained fcom the Nadonal Park Service and
the U.S. Forest Service.
8. Tribal riehts. No activity or its operadon may impair reserved tribal rights, including, but not Gmited to,
reserved water rights and ueaty 5shing and hunting rights.
9, Water qualitvi certifiradon. In certain states, an individual state water quality certification must be obtained or
waived (see 33 CFR 330.4(c)).
10. Coastal wne mana�ement. In certain states, an individual state coastal zone management consistency
concunence must be obtained or waived. (see 33 CFR 330.4(d)).
11. Endangered Species. No activity is au[horized under any NWP wtsich is likely to jeopardize the continued
existence of a threatened or endangered species or a species propcued for such designation, as identified under the
Federal Endangered Species Act, or wiuch is likely to desstrroy or adversely modify the cridpl habitat of such speci�s.
Non-federal permittees shall notify the district engineer if auy listed species or critical habitat might be affected or is in
the vicinity of the project and shall not begin work on the activity until notified by the district engineer that the
requirements of the Endangered Species Act have been satisfied and that the activity is suthorizetl. Information on the
location of threatened and endangered species and their cridcat habitat can be obtained from the U.S. F�sh and
Wildlife Service and National Marine Fisheries Service. (see 33 CFR 330.4{�)

B. Nationwide Permit
13. Bank Stabilization. Bank stabilization activities necessary for erosion
prevention provided:
a. No material is placed in excess of the minimum needed for erosion
protection;
b. The bank stabilization activity is less than SOO feet in length;
c. The activi�y will not exceed an average of one Eubic yard per running foot
placed along the banTc below the plane of the ordinary high water mark or the
high tide line;
d, No material is placed in any special aquatic site� including wetlands;
e. No material is of the type or is placed in any location or in any manner so
as to impair surface water flow into or out of any wetland area;
f. No material is placed in a manner that will be eroded by normal or expected
high flows (properly anchored trees and treetops may be used in low energy
areas); and,
g. The activity is �art of a single and complete project.
Bank stabilization activities in excess of 500 feet in length or greater than
an aver�ge of one cubic yard per running foot may be authorized if the
permittee notifies the District Engineer in aceordance with the "Notification"
general condition and the District Engineer determines the activity complies
with the other terms and conditions of the nationwide permit and the adverse
environmental impacts are minimal both indiyidually and cumulatively.

Regional conditions:
1. This nationwide permit is not valid where material is discharged for
the purposes of controlling aquatic vegetation, creating upland area,
stabilizing or impounding active springs� gaining roadway/pathway access,
filling within posted fish spawning areas� or stabilizing banks through use of
loose fill when physical site limitations make such stabilization impractical
or undesirable (e.g, deep muck� steep bank or bed slope).

stabilization work along the Mississippi River near river mile 861, left bank
in Fridley. The project site is in the N 1/2 Sec. 15, T. 30N., R. 23W., Anoka
County, Minnesota.
It appears from the information provided that this work has been and is
being conducted at a location either above Corps of Engineers permit
jurisdiction, or in a manner which is already authorized by an existing
Department of the Army nationwide permit. Bank stabilization work authorized
by this nationwide permit is described in the enclosures, provided the
enclosed conditions are followed.
This determination covers only your project as shown in the material
€axed to our office. If the design, location, or purpose of the project is
changed, you should contact us to make sure the work would not result in a

Floodplain Distric�Requirements

A Special Use Permit is required for all structures.
Structures constructed for human habitation must have the lowest habitable floor elevation
one foot above the 100 year flood elevation. Basements are not pernutted. Elevations
may be obtained from the Planning Department.
Accessory structures may be below the 100 year flood elevation if they are properly
floodproofed. .
If placed on fill, the fill shall extend 15 feet beyond the structure on all sides.
The City requires a hold harmless agreement indemnifying the City from liability as a result
of flood damages as a result from issuing a Special Use Permit.
O-2, CRTTICAL AREA DISTRICT REGULATIONS
♦ All structures are to be placed 40 feet from the top of the bluffline overlooking the
N�ississippi River, and 100 feet from the normal high water line.
♦ Any work along the bluffline requires approval from the Department of Natural
Resources, the Army Corps of Engineers, and a land alteration permit from the City of
Fridley, or a letfer from the above stating the project is exempt from their requirements.
♦ Clear cutting of trees within the setback area is not permitted. Selective cutting of trees
over 4" in diameter requires City approval
Variances to the floodplain requirements and special use pernvt applications require notification
to the Department of Natural Resources and the Environmental Quality Board.
