7. Ql the Friday of each work week, or when required by the City, material from
this operatio�n that is fotuid to exist an City streets shall be cleaned to the
City's satisf action by the appl icant.
8. Upon wmpletio�n of land alteration operations, the land must be left acvording
to the plans and oontours sulmitted with this application and planted with
suitahle vegetation to prevent erosion
9. Up�n oomgletion of land alteration operations or expiratio� of this permit, an
inspection will be made by the City of the prenises and adjoining streets.
Any damage fo�d to have been caused by these operations will be oorrectec] by

RE: UNAUTHORIZED FILLING OF RICE CREER - ANOKA COUNTY
On July 8, 1988 Tom Hovey of this office made a field inspection of
the filling acti�*ity occurring at your property on Rice Creek in the
City of Fridley, Anoka County.
Based on that inspection, we have determined that the filling is
c�ccurring below the ordinary high water level of Rice Creek. Further,
no DNR permit has been obtained for this f illing; therefore, the work
is in violation of Minnesota Statutes Chapter 105.42.
You are hereby advised to cease the filling activity in all respects.
At the earliest possible date, we ;aill be fcrwarding to you a formal
Commissioner's Order. That Order will detail the aspects of the
violation and any necessary restoration work required by DNR permit
rules. Further filling would constitute a separate violation of the
state law which would result in further citations to both you and the
contractor. Any questions you may have pertaining to this matter
should be directed to Area Hqdrologist John L. Stiae or myself at
296-7523.

At 8:45 a.m., July 8, 1988, I received a call from Virgil Herrick stating
that Mr. Silverstein had requested him to come out to witness a fill
operation an his property at 6675 F�st River Road N.E.
At 9:10 a.m. Virgil Herrick, Ralph Vollarr�n, Rusty Silseth and myself inet Mr.
& Nirs. Silverstein at the site.
Th,e fill operatian being cor�d�ucted by Ar�ka County contractor, Astlefoxd, was
being done an the south slvore of Rice Creek, between ttie Locke Lake dam and
East River RQad. The contractor was renoving material fram the excavation
for the r�w East River R,aad bridge arrl placirbg it with a backh,oe on the south
side.
According to Mr. Silverstein, he had made an agreenent with the contractor to
place the material on his lot r�ext to the creek. He stated he has applied
far� a peYmit from the Rice Creek Watershed District and that they would
review his peYmit at their July 13, 1988 meeting.
Upon my return to City Hall, I called the E.A. Hickok & Associates office;
the Rice Creek Watershed office; and Paul Ruud, County Engineer, off ice to
apprise them of the project: they all stated they were aware of the
situation. N�. Ruud sta.ted tha.t the Rice Creek Watershed District inspector
has been on the site.
