Recently I have been contacted by Dr. Sajady regarding his
property adjacent to the Locke Lake Dam. I have been advised
that the Dam was rebuilt and the level of the lake was raised
as a result.
The problem concerns the fact that Dr. Sajady's property is
adjacent to the Dam and that the City is using his retaining
wall as a portion of the Dam wall. Apparently Dr. Sajady
has been in contact with the appropriate City offices regarding
the problem; however, nothing has been done to correct the
problem. I�uch of Dr. Sajady's property is currently under water
and his retaining wall is showing serious signs of deterioration.
Even the walls of Dr. Sajady's house are starting to crack on
the sides toward the lake which is the result of the high level
of water.
Please review this matter and favor the undersigned with a
response as soon as possible.

In 1981 the city completed repairs to the Locke Lake dam. This work consisted
of filling cracks in the concrete walls to prevent water penetration and eubgrade
erosion. At that time we established an elevation, below the top of the Sajady
retaining wall, to maintain as the s�er level of the Locke Lake pool.
In 1982 we installed a dam board loweriag and raising support. This work allows
us to raise and lower boards into the dam face for pool level control. We attempt
to work with the Locke Lake Association in mainta�ining a summer pool level and
fall and spring maintenance periods for property owner vork on their lake walls.
In April, 1982, ve aotified Mr. Sajady:of a potential problem with his concrete
platform belov tt►e spillway. I have not received any response to this letter.
The Northerly wing wall of the dam ie a portion of that structure. It has started
to lean into the Lake and has been identified by the city as a project for repair
this fall. Accordingly, during the September thru Novembez ti� frame, the city
will inform the resideats on Locke Lake that the water will be lowered so repair
work can be completed. At that time it is euggested'that the property owners
complete any work they desire and that Mr. Sajady coordinate with the city if he

Dear Mr. Brennan,
I have been asked to respond to your letter to Mayor Nee dated
August 16, 1983. Our attornery has received my report but apparently
has not been able to respond to you.
The City of Fridley has not rebuilt the Locke Lake damn or
raised the water in the lake. In 1981, we did establish a water
elevation which was below the top of the damn wing wall. We also
repaired the damn structure by filling cracks. Mr. Akbar was
notified in April, 1982 that there was considerable undermining
under his concrete platform and action should be initiated to cor-
rect this problem.
A portion of the northerly wing wall of the damn has started
to lean into the lake. The City plans on repairing this wall plus
the south westerly wall during this month. All property owners on
the lake are being notified that the water in the lake will be drawn
down between September 15, and October 15, 1983, and it is suggested
that any repair work necessary be scheduled during this period.

Dear Dr. Sajady:
On Monday, September 19th, the City of Fridley will start making
some repairs to the Locke Lake Dam. The area to be repaired is on
the north wing of the dam, which is adjacent to your property. We
will attempt to pour a second retaining wall behind the first one.
This wi11 stretch from the dam north, approximately thirty feet.
Also, on the southeast corner of the dam downstream, we will attempt
to put in a sma11 retaining wall. This wi11 prevent the water from
washing back behind the dam and also prevent erosion of the bank.
Any damage that is ca.used. to your property by this repair will be
restored as closely as possible to its original condition. This
work wi11 talce approximately one month, depending on weather con-
ditions. If you have any problems, please contact me at 571-3450,
ext. 155. �

I have expressed some concern about the stability of the dam and I would
like to know if we have taken adequate measures to assure there is no
serious problem in this area.
Please review the situation and take appropriate action.

In 1981 we established a high and low water level to be maintained on Locke
Lake. The high elevation was gainted on the dam retaining wall and establsihed
at 6" belaw the retaining wall on the property at 6765 East River Road which is
north of the Aklaar Sajady property. At that time this wall was lower than the
retaining wall of Dr. Sajady. That same year we also repaired the dam
structure.
In 1982 we notified Dr. Sajady of the DNR dam inspection results and indicated
he had sane serious problens with his retaining wall and ooncrete platform.
In 1983 we notified all the lake property awners that the City w�ould be lowering
Locke Lake in Sept�nber and October in order to allow the City to repair the
retaining wall at the dam. This wall, which abutts Dr. Sajady's property was
realigned and resupported. .
�is past month we have again notified the residents along Locke Lake that the
City would be lowering the lake during September and October in order to
acc�mplish additional repairs to the dam wing walls.
This has been an extrenely w�et year and Rice Creek has re�nained at a high level
throughout the s�umner period. We have attenpted, through the rernoval of boards,
to maintain the water level within the established limits.
While we cannot control the amount of water within Rice Creek, we attempt,
within our limited resources and abilities, to renove or install boards within
the Locke Lake Dam structure to oontrol the level of the water during the s�uner
period within the established limits. There are occassions of rainfall, within
the Rice Creek Watershed District, that the water elevation will rise, that we
are tmaware of and therefore heights above the desired level can sometimes
occur. Since 1981 we have atte�ted to maintain the water level at the 1981
established high and law level limits. �e City, at least since 1980, has never
sent a letter to the Locke Lake residents informing them to raise their
retaining walls.

I trust you have already had a cha,nce to review my client's
September 9, 1985 correspondence concerning the problems he is
experiencing on his home. Based upan my previous involvement,
I know that this matter was subject to inquiry in 1983.�
On September 17th I went to my client's house to view the
problem. Upon my arrival I was advised by Dr. Sajady that the
water level had been lowered in the lake by removing boards in
the damm which resulted in the water bein� approximately two
feet lower. Based upon the water marks on my client's retaining
wall as well as the damm wall it was readily apparent that the
water level had been lowered very recently.
My client indicates that the present water level is.
acceptable; therefore, I am writin� to determine whether or
not the city plans on raising the water level irom the present
level. The second purpose of this inquiry is to determine
wbether or not the city would participate in repairin� my client's
retaining wall which has been damaged by the hi�h water level of
the lake.

RE: Water Level - Locke Lake
I have received Mr. Akbar Sajady's letter of September 9, 1985 concerning the
water level on Locke Lake. As we have indicated in the past, both to Mr.
Sajady and yourself, the City had established a maxim,an and minim� elevatiori to
be retained during the surruner period on Locke Lake. These elevations were
established in 198C and were based on retaining the water level below the top of
Mr. Sajady's retaining wall. As you are well aware, I am sure, it is impossible
to naintain a set level based upon the amount of water which is present in the
Rice Crcek Watershed District. This year, in particular, we have experienced a
consideratle a�nount of rain. ZY�e creek, as the main storm water trunk for the
Rice Creek District has oontinued to flaw extresnely high. EVen with the boards
renoved, we have not been able to effectively lawer the water level because of
the vol� that is entering Locke Lake.
Just recently letters were sent to the Locke Lake residents and contact was made
with Mr. Sajady that the City would lower the water level in Locke Lake so that
work oould be acoomplished on the City's portion of the dams wing wall, adjacent
to Mr. Sajady's property. While the boards have been renoved, the water level
has actually risen because of the rains we have e�cperienced. No work has been
accomplishe�d to date on the dam.
When the water lawers, both the City and all the residents along the lake will
have the opportunity to initiate any repairs or shore line work before the
winter season.
In s�am�ary, it is the desire of the City to keep tl�e water level of Locke Lake
within those elevations established in 198�. However, as is the case this year,
the final elevation is influenced more by the amount of rainfall than by
anything the City does. We will continue to make reasonable efforts to keep the
water level within the previously established elevations, but obviously tr►e
sucoess of our efforts is dependent upon the course of nature.

The City of Fridley has experienced a major failure of the dam at Locke Lake. In the process
of replacing the dam, it was found necessary for the County to condemn the abutting property
at 6745 East River Road. This was finalized on April 25, 1994. With the recent rains, Rice Creek
has increased its flows tremendously, causing the dam structure to collapse and the abutting
dike to erode, jeopardizing the NSP transmission lines and the three abutting properties to the
dam site. Since it is necessary to remove the residential home at 6745 East River Road in order
to gain access to the dam site, it is imperative that the structure be removed as soon passible
to prevent further loss of properties and collapse of the NSP electrical transmission system.
Request that an emergency demolition approval be provided to Veit Demolition, subcontractor
for Lunda Construction, the prime contractor for the dam reconstruction project.

Minnesota Cities Insurance Trust (LMCIT), we are hereby`writing
to provide you with a disclaimer of coverage, and to advise you we
will not indemnify you for this loss.
This disclaimer is being written pursuant to Covenant No. CMC 14240
effective January 1, 1994/95. The Comprehensive Municipal
Liability Coverage Form, which is a part of the above r�ferenced
covenant under Coverage A. Municipal Liability Coverage (Claims

Sajady, Plaintiff Akbar Sajady vs. City of Fridley - Defendant.
In general terms, this lawsuit arises out of plaintiffs alleging the city failed to properly mainta.in
Locke Lake Dam. As a result the plaintiff alleges his property was abused, destroyed and
discruninated when the city chose to use heavy equipment. He feels he was not fairly
compensated when his home was condemned and alleges he has suffered � severe financial,
psychological and physical hardship as well as years of discrimination against him and his
property.
Please be advised that pursuant to the covera.ge agreea�ent canta.ined under Covenant I�To. CMC
14240 effective January 1, 1994/95 as issued to the City of Fridley by the League of Minnesota
Cities Insurance Trust (LMCIT), we will be accepting defense of this case on your behalf,
subject to a reservation of LMCIT's rights with respect to indemnification.
