It is our understanding that you have been contacted by the developer of the
plat, Mr. Charles Cook, and have decided to partieipate in the sanitary seW er
portion of the projeet oaly. It was stated by Nr. Cook that it is not your
desire to participate in street aecess onto the proposed RiverMrood Drive at
this time.
The City's concern is that aufficient street access opportunity be maintained
so that possible future subdivisions of your property Will not be land locked.
The developer is t�illiag to dedicate an aceess easement to himselP which xill
be held to provide a future driveWay access from your property onto Riverxood
Drive. This easement would provide a 25 foot aceess onto the street which is
the minimum requirement bq eode. The actual fee oWnership of the propertq
trould belong to the future oxner of proposed Lot 1, Block 3, Riverrrood Park
(see map). .
Please be advised that at this time Mr. Cook will be the oWtter of this
easement. Any transactions betWeen him (or any subsequent ox ner of the
easement) and you (or a subsequent oarner of your lot) will take place beyond
City involvement. The value of this easement Will be determined by it�s owner
and may very vell reflect a sigaificaat expense eommensurate with a
proportionate amount of the original a.ssessments or more.
The City Council will be acting on the final plat oa Moaday, December 16, 1985

On December 16� 1985 tbe Fridley City Council Pormallq approned the fiaal
plat called Riverwood Eatatea.
As you l�ow the Council �+as eoncerned with a street acaeae for your lot
should it ever be subdivided. In order to provide for the potential aceeae
and utilitiea for the iiiture� the Counoil has determined that the plat elnou].d
provide a 25 foot of right-of-waq adja�ent to your property (see map). Along
with this pronision it was determined that your property would oarry a
deferred assessment oharge Por 1/33 of all the street aad w ater line
assessmente and 1/34 i'or sanitary sewer aesessmeats. Aa additional
assessment of 1/3� of the saaitary sewer asseeament will be aharged to you at
this time Por the service exteaded to your existing house and property.
With the exeeptlon of a 1/34 �.tary sewer assessment, the r�ainder of the
assessments are deferred aad you will not inaur aosts for them uatil suah
time as the property ia aQtually subdiv3ded. At the time oP subdivisioa

Mr. Flora, Public Works Director, stated there was an outlot when the
Riverwood Elenentary School property was platted, and the a�ner of this
outlot has requested a lot split. Mr. Flora stated the petitiw�er wishes to
split off the west 90 feet of his lot to provide a buildable lot off
Riverwood Drive. He stated the property a�rner has worked with ti�e developer
in order to prwide a triangular piece of property for more frontage for
this lot. He stated the portion to be added to Mr. Malecek's lot split is
670 square feet which will prwide for a more harmonious aligrunel�t with the

ric�t-of-way. Mr. Flora stated with this 670 square feet added to Mr.
Malevek's lot, it reduoes the size o� Mr. Anderson's lot fr�an about 9,470
square feet to 8,800 square feet.
Mr. Flora stated there were six stipulations attached to this lo� spl it and
staff had added that the petitioner was to work with the developer to obtain
the additional property along the westerly boundary line and for the
petitioner to pravide a hard surface driveaay to the existing house.
Mr. Malecc�k stated he was made asaare of the stipulation for the hard surface
driveway last Friday and requested the lot split be approved, without this
stipulation. He stated he didn't inderstaru3 why it should be tied to the
1 ot spl it.
Mr. Qureshi, City Manager, stated the hard surface driveway is a City Code
requirene.nt and felt it wauld be appropriate at this time for Mr. Malecek to
provide �e drivsaay.

follaaing stipulations: (1) City be pravided with a 25 foot bi.keway/walkway
easement along East River Ra3d; (2) New h�use frorit yard setback to follaw
the curve of the street; (3) Lot sglit to be reo�rded prior to issuance o� a
building permit; (4) Park fee of $750.00 is to be paid prior to issuance of
a building peLmit; (5) Private utility easement to be provided across the
northerly 10 feet of the new lot; (6) Petitioner agrees to fair share of
street and utility assessments for the riew lot; and (7) Fetitioner work with
the developer to obtain the additional property along the westerly boundary

Cotmcilman Schneider asked Mr. Malecek if he could provide a hard surface
drivaaay in the riear future. Mr. Malecek stated he has a long drive, about
155 feet long, and statec] there are other homes along East River Road that
do rbt have hard surface drivaaays.
Mr. Herrick, City Attorney, stated, in theory, this requirement is in the
CY ty Code and staf f should be enf or ci ng i t, but has been som ew hat 1 eni ent .
He felt it may be the appropriate time for the property awner to meet this
c�ode requirenent.
C��cilman FitzFatrick stated he agre�ed the wde should be enforced, but was
not sure it had anything to cb with this action for the lot split.
Mr. Qureshi stated he believed there were actions taken b� the CA�cil. which
gave Mr. Malecek the opportuni.ty to split his lot and make his property more
valuable and this would be the time to bring his driveway into compliance
with the aode.

could be worked out to i�,lude the driveaay in future Faving projects which
