Mr. John Capretz of 7335 East River Road has called the City and the County a number of times
regarding the improvement along East River Road, the bike path and its impact to some large
evergreen trees on his property.
The County acquired additional right-of-way for the East River Road improvement project which
included space for the City's bike path. The construction clearing for the improvement is
approximately 2�a to 3 feet from the large evergreen trees located on Mr. Capretz's property.
He was originally concerned with the line of sight and clearance issue with the branches of the
trees. The County had offered to trim the trees to either the property line, to the main tree trunk or
completely around the tree to balance the branches. He was not agreeable to trimming all the trees
and at this point in time, the County will only be trimming back the branches to the property line.
In the process of relocating the curb stop for the residential water line; the excavation extended a
few feet onto his property. In this process, a tree root from one of the evergreen trees was cut. Mr.
Capretz is now claiming damages to the tree, requesting restitution of over $1,000 because af the
potential death or blowing over of the tree as a result of the water valve installation. The County has
offered to remove the tree at na charge but will not pay restitution for the tree as a result of this work.
They have indicated if in the very near future the tree should die as a result of this work, there could
be some liability and claims paid, but this claim would have to be made after the tree has suffered
severe damage. Mr. Capretz feels he is being infringed upon and believes that since the City can
pay $11,000 to apartment renters, we should be able to compensate him $1,000 for the tree. I have
indicated that he should take a photograph of the tree root and its location and maintain that record
for the next year or two and initiate a claim should any damage or death occur to the tree as a result
of this construction.
