RE: 7525 East River Road
It was recently brought to staff's attention that the single family home at 7525 East River Road is for
sale and that a 1973 speed letter on file indicates that the detached accessory structure located in the
rear yard of this property that has water and sewer hookup was legal non-conforming. Current staff
would like to correct this record and state that this previous opinion from a staff person was incorrect.
This property is zoned R-1 Single Family. There can only be one principle structure on an R-1 lot
(205.04.4.B). Even members of a family could not use both structures as living structures. Code
certainly would not allow rental of the accessory structure as living space.
In addition, considering the location of the accessory structure on the lot, it will not be feasible to
complete a replat or split off one lot to create two R-1 lots out of the parcel that meet zoning code
requirements.
