THE PUBLIC HEARING OPEN AT 8:06 P.M.
Mr. Bolin stated that Mr. and Mrs. Klismith are seeking a variance to reduce their front
yard setback from 35' to 25' and to allow the existing accessory structure to be placed in
the front yard of their home located at 7905 East River Road. The Code does require a
minimum front yard setback for accessory structures as well as main structures of 35'
and also requires that all accessory structures be located in the side or rear yard of a
property.
Mr. Bolin stated the Klismith property is surrounded to the north and east by R-1 Zoning,
single family homes. To the south across 79�' Way is a convenience store zoned C-1.
To the west is a mix of R-3 and R-1 zoning. Their lot was platted in 1922. The home
was built sometime prior to 1949. The garage was built in 1976, and a variance was
granted to the Klismiths in 1992 to increase the height of the fence in their front and side
yard. �Their hardship-statement states that it would cause them undue hardship to tear it
down and move it so it would be behind their house or at least more than 35' from the
lot line.
Mr. Bolin stated City staff recommends approval due to the extraordinary
circumstances. These are actually two requests in one. Similar variances have been
granted for the setback request. A recent one was Variance #97-02 in which the �
setback was reduced to 18' for a garage. Staff supports this variance request to allow
the accessory building in the front yard and noted, for the record, that this should not set
a precedent for the City to grant all future requests for people who are Iooking to place
accessory buildings in their front yard. The two main reasons this request has staff
support are (1) the fact that there was a building permit for the garage granted in 1976
that had a stipulation on the permit stating that it only needed to be setback 25' from th�
south lot line and (2) the shape of the lot doesn't leave the property owners many oth��
options for placing the garage on the site. The petitioners were working with the
building department trying to obtain a building permit to put a screen porch addition ����

the west side of their home to meet all the setbacks, and they need the variance for the
garage in order to -have a fully conforming lot.
Mr. Klismith stated that staff presented the request very clearly. They do have the odd
shaped lot tb contend with a�d �hey needed to have to variance to add the porch and
give a little more space in�h� home. They were looking at it more as a three-season
porch to get a little more-use for their family.

Ms. Beaulieu stated that the hardship pertains to the year it was built, the shape of the
lot, �nd being a comer lot. She stated she definitely sees the hardship.
M�. FCuechle stated that this is a hardship of no making of the current property owners,
and it would� give undue hardship to tear the garage down and not allow them to put on
a screer�po"rch. He would recommend approval.
Ms. Mau asked that if they would decide to build a new garage some day, would they
have to conform to the 35'?
Mr. Bofin s�ated that if the vanance was granted they wouldn't need to.
Ms. Mau stated that it would be an undue hardship, and she would like to stipulate that
if the time ever comes that if they want to rebuild the garage that they would need the
setback.
Mr. Kuechle stated that they could possibly do that.
Mr. Bolin stated that if the garage bumed or was destroyed, a stipulation like the one
mentioned would require the property owners to go through the variance process again.

ANALYSIS
The Klismith's are seeking the variances in order to have the existing garage
recognized as a conformity. The building permit granted for the garage stipulated that
the garage only be 25' from the South lot line.
Section 205.09.03.D.(1) requires a minimum front yard setback of 35'. Section
205.04.05.B requires accessory buildings to be in the side or rear yard. 79"' Way,
according to City code, is the Klismith's front yard. The Klismith's were seeking a
building permit to put a porch on the west side of their home, when the non-conformity
with the garage was discovered.
While the City Staff is in support of granting this particular variance for allowing an
accessory building in the front yard, it should be noted that this should not set a
precedence to grant all future requests. The shape of this lot, and the stipulation on the
garage building permit are extraordinary circumstances that were considered by Staff.
RECOMMENDATIONS
City Staff recommends approval of this variance request, due to extraordinary
circumstances. Similar variances for the setback request have been granted.

We would like to ask for a variance for the site of our preexisting garage. It is onty ZS f�et from
the frorn of our lot. It was built at this location approximately forty years ago. It would cause us undue
hardship to tear it down and move it so that it would be behind our house or at least more than thirty five
feet from the lot liae.
The reason the ne� for tivs variance has come to our attention is we want to add a gorch to the
west side of our house. This addirion will be in compliance vvith the crty code. We live on a corner lot.
According to code, "If a lot is a comer lot, the frout shall be the shorter lot line that ahuts the street ri�ht of
way." For us that would be'79'� way wlrich make our prcexistin� ga.ra�e noaconformin�.
In order to build the porch on our home facin� East River Road we ner�tl to have ttris elcception to
the code granted by the city. Our proposed addition is witivn code but the garage on ow property is not.
