the vacation is approved, the variance would not be necessary.

Chairwoman Gabel reported that the Planning Commission recouanended to vacate it
and the City Council agreed witil that. Mr. Clark explained that the process takes
about four weeks and the puHlic hearing will be in a month and it will be November
before the vacation will be law. He said Mr. ScIierven has excavated but does not
have`the foot3ngs in. , He furtfier stated that tize utility easen►ent that is being
kept will make no difference as Mr. Scherven wi11 still be 9 feet from the south
lot line.
Mr. Scherven said he has had the lot for 11-12 years and he is planning to build a
honse with an attacbed garage. Chaizwoman Gabel asked if the sewer and water are
hooked np and Mr. Scherven said no, but he has two estiinates on that. Mr. Clark
said that can be done without any probl�ns. Mr. Plen►el if the house will be factory
built. Mr. Scherven said it will not be pre-fab or pre-cut and he is doing the con-
tracting himself and showed the coffiaission a photograph and blueprints. He said it
will be a 28' by 32' house.
Mr. Barna askecl when 66th is vacated how much land it would give on the south side.
Mr. Clazk said probably another 25 feet but it will be utility easement. Chairwoman
Gabel noted that there is gardening in tIiere now and Mr. Scherven said he did not
want to cut down any trees. Chairwoman Gabel asked about the costs to build.
Mr. Schesroen said about $42,000 to build, another $5,00 for the plumbing and there wi11
be electrician costs and block and brick work costs. Chaixwoman Gabel asked about
the nwnber of bedroatns and if Mr. Scherven would be living there. Mr. Scherven said
he lives in an apartment right naw and he plans to move into tIie house.
Chairwoman Gabel saic� Mr. Boardman didn't think there would be any problem with
66th Avenue. Mr. Clark said about 5-7 years ago there was a petition to vacate but
the city was not vacating at that t3me and does,not see '�_hat the stxeet will gQ through
in the future; people do not want. to pay for isnprovements and there is no reason not
to vacate. Chairwaman Gabel asked how much footage tiiere would be between the curb
and garage if the street were not vacated. Mr. Clark said about 1B feet and the
garage would not really obstruct vision and it wonld not be a high density traffic
area. Mr. Barna said he did not have a proble�n with th3s variance. Mr. Plemel
said it looks like a nice home and a nice addition to the neighborhood.
MOTION by Mr. Barna, seconded by Mr. Hippen, to close the public hearing. UPON A
VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECLARED THE PUBLIC HEARING CLOSED AT

C. A]]MINISTRATNE STAFF REVIEW:
This lot is on the southwest corner of Liberty Street and East River Road.
A variance was needed in 1974 to build the dwelling as the lot area is
only 6511.9 square feet. �here is a 20 foot easement for highway purposes
along East River R�ad and a 20 foot drainage and utility easement alonq
the west side of the lot which leaves little area to build a garage on.
A variance would be necessary to place a garaqe anywhere on this property.
Mr. & l�lrs. � Richar8 G. Gay, 7998 East River Road; 2+7r. and Mrs. Dalberg, 8605 Balti�nore
Street NE., were present.
Mr. Gay said there is a 20 foot utility easement on the west side and a 20 foot
easement along the east for the widening of East River Road, and that by having a
garage and driveway there, it would block the traffic lights coming into his neigh-
bor's window. Chairwoman Gabel asked how many feet off East River the proposed
driveway was and Mr. Clark said about 40 feet from the curb to the driveway. Mr.
Plemel noted there was very little traff ic because it was a dead end street. Chair-
woman Gabel noted the driveway was partially on the easement.. Mr. Clark said there
was no problem as everyone crosses easements with driveways. Chairwoman Gabel
said there may be a problem down the line if they decide to widen East River Road.
Mr. Gay eaid he does not live there but may eventually, and he would need a garage
to keep everything inside and clean it up a little. Chairwoman Gabel noted there
was no other place to put the garage and Mr. Barna said it was a weird shaped lot
tied up with easements. .

Mr. Gay said the work will be snbcontracted and it will match the house. Mr. Plemel
asked if they will be caming to the west � of the fire hy��t. Mr. Gay said yes,�
a 12 foot driveway and it will widen and will be putting up steel and concrete posts
to prevent slipping into the fire hydrant in the winter.
Mr: and Mrs. Dalberg said they were not opposed to ihe variance but wanted this chance
to air their grievances at being tvrned down for variances so many times. They own lots
across tiie street and briginally owned the lot that Mr. Gay now has. �[rs. Dalberg
said it has been 2-3 years since they have applied for a variance and they had
wanted to build a hosne on the dead end street. Chairwoman Gabel said the commission
is not able to tell them what changes . -. have to take place to make that
pro�rty more bnildable and asked if they hane a different house plan. She said
there was strong neighborhood reaction the last time and they may have s3sailar
reaction'again. Plrs. Dalberg felt if there was going to be any reaction to a variance
in the area, the neighbors would be here for Mr. Gay's variance. Both Mr. Plemel
and Chairwoman Gabel remembered the neighborhood reaction and suggested that Mrs.
D�lberg talk to her neighbors and explain what they would like to do before they come
for a variance. Mr. Barna explained that if the neighbors object for any reason at
all, the final decision is up to the City Cauncil and Chairwaman Gabel said it went
to the City Council the last time. The Commission suggested again that she review
the house pla�s, talk to her neighbors anS explain and re-apply for a variarice.
Mr. Barna, referring back to Mr. Gay's variance, asked what happens when the East
River Road expressway cc�nes tY�rough. I�lr. Clark figured if they raant to widen, they
migfit do it in the otIier direction. Mr. Gay felt it would make more sense to try
and straighte� aut the road as much as possible. Mr. Hippexl felt everyone should
have a garage, especially with the winters and there is a]most no other place for
a garage to be built. Chai�taoman Gabel agreed, stating there is an obvious hardship
as there is no other place for the garage and that it is not a good situation with
what may happen in the future but that thepetitioner is aware of the risk.
Mr. Barna stated it really would not be creating any structure any closer than there
is right now. CYiairwaman Gabel said the other side has drainage and utility easements.
MOTION by Mr. Hippen, seconded by Mr. Pl�nel, to close the public hearing. UPON A
VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN GABEL DECIARED THE PUBLIC HEARING CLOSED AT
8:52 P.M.
