Recently I received a complaint regarding the size of two antennas located on a residential
property in the City of Fridley. The property in question is addressed a� 8164 East River Rd and
is owned by Ernest and Edna Draheim.
On August 26, 1996 I contacted the FCC 1-800 number and spoke with Joanne. Joanne informed
me that tlus location was not registered as an amateur radio operators location and that amateur
radio operators do not have specific antenna height requirements. Joanne did, how�ver, in%rm
me that this may be a CB operator in which case the home owner may i�e in violation of F�C rule
95.408. Joanne informed me that a written complaint should be sent to your attention if a
violation is occurring.
Upon conducting an inspection, I believe that one of the two antenna's at this location exc�eds 60
feet in height from the ground up. It is my understanding that this is a violation of FCC rul�es.
Please inspect this situation and let me know what corrective action, if any, will be required of the
property owner.
In addition to the antenna size, there has been reports of a tremendous amount of telephone, TV,
etc. interFerence when the radio tower is in use. Please let me know what can be done to alieviate
this concern for the neighborhood. Any help or information you provide will be extremely
helpful. Thanks for your cooperation.

Subject: FCC Letter / Antenna Height Requirements
Dear Mr. Draheim:
_ Thank you for your September 11, 1996, phone call. The FCC also sent me a copy of the
letter you referred to during our eonversation. It appears that the FCC is concerned about
- the size of the antenna and possible violation of CB Rule 8( c). As you indicated on the
phone, because you are an amateur radio operator and not a CB operator, this antenna
size requirement does not apply. Apparently, a 70 foot tall amateur radio antenna does
not exceed the 200 foot maximum allowed by the FCC.
As I indicated on the phone, I am also concerned about the antenna size. In review�ng the
residential section of the City Code, it is clear that private radio or television antennas
exceeding a height of 20 feet above the dwelling roof require a special use permit. It
would appear that your antenna exceeds this requirement. To bring the antenna into
compliance, you could shorten the antenna or apply for a special use pernut. Enclosed is
information regarding the special use permit process. Scott Hickok, Planning
Coordinator, is available at 572-3599 if you have questions regarding this process.
Regarding being grandfathered or permitted because the antenna is a pre-existing
nonconforming use, there are two considerations staff must make. First, was the antenna
constructed before the antenna size requirement was enacted? Second, if the antenna was
constructed before the ordinance, has it been significantly modified, reconstructed, or
changed? To assist staff in determining if the antenna is grandfathered, please inforrn us
when the original antenna was constructed and what, if any, structural modifications have
occurred since its construction. If it can be determiried that the antenna is grandfathered,
a special use permit would not be required.

Dear Mr. White:
On June 8, 2000, you requested a letter regarding some zoning issues at 8164 East
River Road. Since your request, I have reviewed the address file for their property.
As a result of the County's improvement project, the subject property will fall below the
7,500 square foot minimum for a lot platted prior to December 29, 1955. As a result, the
lot becomes nonconforming. It is also my understanding, that the structure will be 14
feet from the public right-of-way line, within the 35 foot front yard setback. Even though
considered nonconforming, the zoning code permits typical routine maintenance work
as long as the nonconformity is not intensified. Should the structure be destroy�ed in its
entirety; variances would have to be granted in order to rebuild a home of the property.
