Notice is hereby given that the Appeals Commission of the City of Fridley will conduct a Public Hearing at the Fridley Municipal Center at 6431 University Avenue N.E. on Wednesday, June 26, 1996, at 7:30 p.m. for the purpose of: Consideration of variance request, VAR #96-13, by Arthur 8� Judith Montour: Per Section 205.07.03.D.(1) of the Fridley Zoning Code, to reduce the front yard setback from 35 feet to 29 feet to allow the construction of a 7 foot by 7 foot 6 inch entry addition on Lots 11 & 12, Block 14, Springbrook Park Addition, the same being 261 Ely Street N.E., Fridley, Minnesota, 55432. Page 3 RE UEST DEVELOPMENT SITE �� The petitioners request that a variance be granted to reduce the front yazd setback from 35 feet to 29 feet. If approved, a 7 foot by 7 foot 6 inch, 2-story entrance addition will be constructed on the front of the dwelling unit at 261 Ely Street. SITE DESCRIPTION/HISTORY The properiy is located in the Springbrook Addition which is located in the northwest corner of the City. The subject parcel is 60 feet by 200 feet. A 24 foot by 35 foot split level house occupies the site. The house was constiucted in 1968. In 1969, a 26 foot by 28 foot detached garage was constructed. ANALYSIS Section 205.07.03.D.(1), requires a front yard setback of not less than 35 feet. Public purpose setved by this requiremern is to allow for off-street pazking without encroaching on the public right-of- way and also to protect the "line of sight" of adjacent properties. The petitioners are proposing to construct a 7 foot by 7 foot 6 inch entry addition onto the front of the dwelling unit. The loca.tion of the addition will be two stories in height. The purpose of the addition is to provide a larger entry space with a closet on the first level and additional windows above. As proposed, the ernry addition is not a vestibule or airlock. A vestibule would have two sets of doors (nrterior and e�rterior), thereby sepazating the elements from the interior of the house. Section 205.04.06.A(4) would permit a vesh�ule to encroach irrto the front yard by 5 feet, providing it does not exceed 50 square feet in area and is not one story in height and will be centered on the front of the house. The petitioners' proposal is 52.5 square feet and also extends an additional 2 feet into the front yard. The petitioners could reduce the size of the addition or redesign the addition to match setbacks and maximum square foot requirements. This request is within previously granted variances. Mr. Hickok stated Mr. & Mrs. Montour are requesting a variance to redu setback from 35 feet to 29 feet to ailow the construction of a 7 foot by 7 entry addition at their home. The hardship as stated is the petitioners' � their entry. Mr. Hickok stated the code requires a front yard setback of 35 feet to allc sight for the properties on the street and to give more consistent front ya� landscape opportunity. Mr. Arthur Montour, 261 Ely Street N.E., stated he has lived in this home for 30 years. The entrance has always been small; and when they have company in the wintertime, there is no room for taking off winter coats, boots, etc., and it is very inconvenient. They would like to open the entrance up to make it more convenient for guests and to improve the looks of the house. The entry will not be a two-story addi#ion; the roofline will just be 12 feet high. They will aiso have a closet in the entryway. Dr. Vos asked if there were any objec�ions from the neighbors. Mr. Montour stated his neighbors have no objections. The neighbors on either side of their home have submitted letters stafing they have no objection to the addition. Dr. Vos stated this variance request seems to be within the spirit of the code. The encroachmen# is very minimal and should not impac� the line of sight.
