It was brought to the City's attention and confirmed by an on site
inspection on July 14, 1978 that the uni.mproved alley right of way
in the 200 bloc3c between Ely Street and Liberty Street N.E. , Fridley
was being used as a depository for adjacent property owner's grass
' clippings and yard wastes.
Section 113.12, Refuse Disposal, of the Fridley City Code, prohibits
the disposal of any grass clippings, yard wastes, or any refuse on
the public right of way.
In addition, it is the adjoining property owner's responsibility to
maintain any unimproved alley right of way. Therefore, the City
must require you to clean and maintain your property and the adjoining
right of way free of all grass clippings and yard wastes found there.

Dear Nr. �talters:
It xas confirmed by an on-site inspection on September 19, 1g84 that you Were
maintaining your property in violation of Section 113, Refuse Disposal, and
Seetion 110, Publie Nuisance, of the Fridley City Code.
The inspection found tires, wheels� scrap metal and Wood, motor vehicle and
motorcycle parts, long Weeds and grass, construetion debris, discarded Dikes,
laWn moWers and a refrigerator and other miscellaneous refuse and debris
littering your yard. This is presenting a cluttered appearance, is a
nuisanee, and is a detractant to the neighborhood.
At this time, the City must require you to dispose in a sanitary manner, all
of the refuse and debris found on your property. In addition, you must
provide and maintain a sufficient number of approved covered containers to
store all refuse inside� betxeen collections, and have all refuse removed
from your premises at least once a week.
Finally, any aec�ulations of discarded material and refuse is declared to be
a public nuisance and is subject to abatement under Chapter 110 of the
Fridley City Code.

lieu of this code requirement, I hereby agree that I will transport
my solid waste materials directly to an appropriate area landfill
at least once every three months. In addition, I agree to keep
receipts documenting that disposal has occurred in this manner, and
I fully understand that the City may, at any time, request the
opportunity to review this documentation. Also, I agree to store
all solid waste within a secured building between trips to the
landfill.

Mr. Walters appeared at the open forum portion of the December 1,
1993, City Council meeting to express his frustration regarding
recent actions taken against him by City staff. Specifically, Mr.
Walters stated that.the two main issues involved were a citation
issued for not having refuse service and fire/police officers
appearing at his residence responding to burning complaints.
Mr. Walters stated that he burns paper in his garage and
periodically takes other refuse directly to the landfill to avoid
the high cost of regular refuse pickup. He indicated that he has
saved receipts for his trips to the landfill to clearly prove that
he is appropriately disposing of these materials.
Mr. Walters appeared in Anoka County Court on December 3, 1993, and
pled not guilty to the charge of not having weekly refuse service.
At that time, the Court set his arraignment on this citation for
December 16, 1993.
Solid Waste Collection Service
On November 9, 1993, staff issued a citation to Mr. Walters for
failure to provide for weekly solid waste collection by a licensed
refuse hauler as required undex` Fridley City Code Chapter 113.
This citation resulted from checking with the City's licensed
haulers to determine that Mr. Walters did not have service after
two letters had been sent to Mr. Walters on this subject. (Copies
of these letters are attached for your review.) Staff had
initially become aware of this situation through_a complaint
received this summer.

Upon receiving complaints that a resident does not have regular
solid waste collection service, staff has sent out letters
indicating that such service is required and has performed follow-
up work similar to that done in Mr. Walters' case. For 1993 to
date, staff has sent letters on nine such complaints, and this is
the first citation issued for violation of this code requirement.
State law requires that each city or town with a population of
1,000 or more shall ensure that every residential household and
business in the city or town has solid waste collection services.
City staff spoke with Minnesota Office of Waste Management staff
regarding what types of collection strategies would be allowable
under the law. According to the Office of Waste Management staff,
self-hauling, sharing collect�ion services, and less than weekly
collection do not violate the intent of the law.
Based on this information, the City has three main alternatives in
addressing the solid waste collection issue:
l. Enforce the current ordinance.
Under this alternative, the City would continue to pursue
legal action against Mr. Walters and any other residents
found not to have regular weekly solid waste collection
service by a licensed refuse hauler as stated in Fridley
City Code Chapter 113. .
2. Address on a case-by-case basis.
Under this alternative, the City would keep the present
ordinance requirement mandating weekly refuse collection
service but would administratively consider other options
(self-hauling, shared service, etc.) that may meet the
intent of the code as specific cases arise.
3. Amend ordinance.
As indicated earlier, state law does provide flexibility
to cities concerning.acceptable solid waste collection
alternatives. Therefore, the City could choose to amend
its present ordinance to permit such options as self-
hauling, shared collection, and/or less frequent
collection. Under this alternative, the City would need
to establish requirements concerning monitoring of seif-
hauling, appropriate frequency of collection/disposal,
and other related i.ssues to adequately health and safety
concerns.

Illegal Burninq
Staff spoke with the Fridley Fire Department to determine what
actions have been taken against Mr. Walters with respect to
unlawful burning of materials at his residence. While the Fire
Department has responded to several such complaints at this
location, no action has been taken against Mr. Walters. (Copies
of Fire Department reports are attached for your review.)
Recommendation
Based on analysis of the alternatives regarding solid waste
collection, staff recommends that the City Council keep the
existing ordinance and authorize staff to address special
circumstances on a case-by-case basis. If the Council selects this
approach, staff could meet with Mr. Walters prior to his scheduled
court appearance on December 16, 1993, to work out a plan which
would meet his needs and satisfy the intent of the existing
ordinance. .
