Dear Mr. Miskowiec:
I have been requested to respond to your letter of March 5, 19$2,
regarding liability in relation to the viaduct in your backyard.
As previously reported to you, the City placed warning signs in
the easement surrounding the storm sewer pipe which carries Spring-
brook Creek under East River Road. The signing assists in physi-
cally notifying persons in tlie area of a possible dangerous situa-
tion. Accordingly, it is the City's opinion that neither the City
nar the property owner can be lield liable, unless it is shown that
they have been negligent.

Dear Mr. Miskowiec:
The City o€ Fridley has established a City Code for the purpose of
promoting a pleasant and attractive suburban environment. A recent
: inspection of the property at 440 Ely Street N.E. revealed that not
all Code requirements are presently being met. Listed beTow is an
item which does not comply with the City Code:
1. Observed garbage/debris at curbside on two consecutive days.
Fridley City Code 113 requires that all solid waste must be
kept in approved containers in the rear yard or garage except
on the day of refuse pick-up. Please remove this debris and
dispose of properly.
Your prompt attention in correcting this situation would greatly
assist us in helping make Fridley,a better plaee to live. An
inspection will be eonducted on or about April 10, 1989, to
determine compliance.
