Dear Mr. Zirngible:
On June 29, 1992, the Fridley City Council officially approved your
request for a Variance, VAR #92-11, to reduce the side yard setback
for an accessory structure from 5 feet to 2.5 feet; to reduce the
rear yard setback from 25 feet to 17 feet; all to allow the
construction of a detached accessory structure and expansion of a
single family dwelling on Lot 4, Block 1, Bourdeaux's Springbrook
Addition, the same being 8106 Fairmont Circle N.E., with the
following stipulations:
1. The accessory structure shall be architecturally compatible
with the existing dwelling unit.
2. The east wall of the accessory structure shall have a minimum
one hour fire rating if it is less than 6 feet from the
dwelling unit.
3e The petitioner shall provide a hard surface driveway by June
l, 1993.
You have one year from the date of City Council action to initiate
construction. If you cannot begin construction in time, you must
submit a letter requesting an extension at least three weeks prior

MOTION by Councilman Fitzpatrick to concur with the unanimous
recommendation of the Appeals Commission and grant Variance
Request, VAR #92-11, to reduce the side yard setback from 5 to
2.5 feet and to reduce the rear yard setback from 25 to 17 feet,
with the following stipulations: (1) the accessory structure shall
be architecturally compatible with the existing dwelling unit; (2)
the east wall of the accessory structure shall have a minimum one
hour fire rating if it is less than six feet from the dwelling
unit; and (3) the petitioner shall provide a hard surface driveway

Mr. Bu ns, City Manager, stated that the Army is proposing to

Request
The petitioner is requesting that two variances be granted:
1. To reduce the side yard setback for an accessory
structure from 5 feet to 2.5 feet;
2. To reduce the rear yard setback for the dwelling unit
from 25 feet to 17 feet;
To correct an existing encroachment and allow the expansion
of the second floor of the dwelling unit.
Site
Located on the property is a single family dwelling unit with
no garage. The property is zoned PUD, Planned Unit Develop-
ment with the adjacent properties zoned similarly.
Analysis

Seation 205.04.05.B.(2) requires that all accessory buildings
and structures shall not be any closer than five feet to any
lot line.
Public purpose served by this requirement is to provide space
between individual structures ta reduce the possibility of
fire, to provide access to the rear yard for emergencies, and
to limit the condition of crowding in the residential
neighborhood.
The petitioner is proposing to construct a 24 ft. by 24 ft.
detached accessory structure. The accessory structure meets
the setback from the street as it is 25 feet from the property
line; however, a varianae to the side yard setback requirement
is required as the structure is proposed to be located 2 1/2 �
feet from the side lot line. The petitioner could reduce the
width of the proposed accessory structure by 2 1/2 feet,
thereby constructing a 21.5 foot wide garage which would meet
the zoning requirements.

The property to the west meets or exceeds the minimum setback
requirements. If the proposed garage is closer to the
existing dwelling unit than 6 feet, the wall of the accessory
structure adjacent to the dwelling unit will be required to
have a minimum 1 hour fire rating. As the petitioner has
other options which meet the code requirements, staff
recommends denial of this variance request.
Rear Yard Betback
Bection 205.07.03.D.(3).(a) requires that the rear yard shall
have a depth of not less than 25� of the lot depth with not
less than 25 feet permitted or more than 40 feet required for
the main building.
Public purpose served by this requirement is to provide rear
yard space to be used for green areas which enhance the
neighborhood.
Egistinq Condition
The petitioner is proposing to expand the upper level of the
dwelling unit to add an additional bathroom and bedroom to the
second floor.
The existing dwelling unit is located 17 feet from the rear
lot line. The dwelling unit is two stories tall; however, the
second story does not extend the full length of the dwelling
unit. As it is impractical to require the petitioner to
remove 8 feet of the existing first floor of the dwelling
unit, staff recommends approval of the request to reduce the
rear yard setback to correct the existing condition for the
first floor of the dwelling unit.
Pro�ose8 Egpansion
The petitioner intends to extend the second story of the
dwelling unit to match the first floor, creating a setback for
the second story of 17 feet. The petitioner has reasonable use
of the property without the proposed addition.
Recommendation
Staff recommends that the Appeals Commission take the
following action:
1. Recommend to the City Council denial of the side yard
setback for an accessory structure from 5 feet to 2.5
feet;

2. Recommend to the City Council approval of the request to
reduce the rear yard setback from 25 feet to 17 feet for
the existing condition of the first floor of the dwelling
unit;
3. For the request to reduce the rear yard setback for the
second floor expansion, staff typically recommends denial
of these types of applications. Staff is responsible for
interpreting the "letter of the law", and the Appeals
Commission and City Council are responsible for
determining whether the variance is warranted. In this
instance, the Appeals Commission and City Council may
want to aonsider granting the variance in order to
encourage housing maintenance and improvement. In cases
where improvements match existing encroachments, the City
may want to encourage additions on certain properties.
The City should be cautious to ensure that adjacent
properties are not affected and that all other zoning
requirements are met (lot coverage, height, etc.).
Testimony from the adjacent property owner would be
helpful to determine if there would be adverse impacts.
The City Council, HRA, and staff are working on a long
term housing plan to promote housing maintenance and
improvements. This application, if approved, is
consistent with the current planning effort.
If the Commission chooses to recommend approval of the
variance requests, staff recommends the following
stipulations:
1. The accessory structure shall be architecturally
compatible with the existing dwelling unit.
2. The east wall of the accessory structure shall have
a minimum one hour fire rating if it is less than
6 feet from the dwelling unit.
3. The petitioner shall provide a hard surface driveway
by June 1, 1993.
Appeals Commission Action
The Appeals Commission voted unanimously to recommend approval
of the request to the City Council.
City Council Recommendation

Ms. McPherson stated the property is located at 8106 Fairmont
Circle. The property is zoned PUD, Planned Unit Development,
however, the use of the property is a single family dwelling, as
are all the adjacent properties.
Ms. McPherson stated the petitioner has a two-part variance
request. The first is to reduce the side yard setback for an
accessory structure from 5 feet to 2.5 feet. The petitioner is
proposing to construct a 24 foot x 24 foot detached accessory
structure. The proposed location of the structure meet the setback
from the front property line; however, it does not meet the 5 foot
setback requirement for the side lot line.
Ms. McPherson stated the petitioner has the option to reduce the
width of the proposed accessory structure by 2.5 feet which would
allow the petitioner to construct a 21.5 foot wide garage versus
the proposed 24 foot. Staff acknowledges that this may be too
narrow of an accessory structure; however, it would be possible to
store two vehicles in the structure with the reduced width. The
property to the west meets or exceeds the minimum setback
requirement as far as the structures on the adj acent property. Mr.
Zirngible has submitted a statement from the adjacent property
owners stating they are comfortable with the location of the
proposed accessory structure.
Ms. McPherson stated that if the Appeals Commission recommends
approval of this request, a requirement to have a one hour fire
rating will be applied to the wall of the structure that is
adjacent to the dwelling unit if it is less than 6 feet from the
dwelling unit. Staff is recommending that the Appeals Commission
recommend denial of this request because the petitioner does have
an alternative which meets the code requirement.
Ms. McPherson stated that the second portion of the variance
request is to reduce the rear yard setback for the dwelling unit
from 25 feet to 17 feet; to correct an existing encroachment and
allow the expansion of the second floor of the dwelling unit. The
existing dwelling unit is located 17 feet from the rear lot line.
The dwelling unit is two stories tall; however, the second story
does not extend the full length of the dwelling unit.

Ms. Beaulieu asked the standard size for a double garage.
Ms. McPherson stated a size of 20 feet x 20 feet has been approved;
however, the City receives many requests for 24 feet x 24 feet.
Dr. Vos stated he looked at the property and stated there seems to
be some question about what is the side yard and what is the front.
Ms. McPherson stated the Code defines the front as the shortest of
the two frontages. Again, similar requests have been reviewed
where the front functions as the side yard and vice versa.
Dr. Vos stated there seemed to be much lot between the east
property line and the house. �
Ms. McPherson stated the house could be 17.5 feet from the east
property line.
Dr. Vos stated it looks like 30 to 40 feet. This could affect all
areas if interpreted differently.
Ms. Smith asked if there was anything that states how close an
accessory building can be to an existing home.
Mr. McPherson stated that if it is within a certain number of feet,
it is considered attached. The petitioner can define the distance
the accessory structure will be from the dwelling unit.
Dr. Vos asked, if attached, is there a different request and would
the structure still need a fire wall.
Ms. McPherson stated the structure would need to meet all building
code requirements. -
Ms. McPherson stated that underlying the long recommendation, it
would be staff's recommendation to deny tlie request. There are
some instances where the City may consider that the spirit of the
Code would be met be granting the variance, and it may be
appropriate in some instances to consider approval of the request. •
Mr. Zirngible presented a letter from his�neighbor to the west
supporting the request to reduce the side yard setback.

from Mrs. William Gorman, dated May 19, 1992, stating they do not
object to the side yard setback from 5 feet to 2.5 feet.

Mr. Zirngible stated on the west side of the property their Inouse
is 22 feet to the property line. The hardship is that this is the
only location on the property for tYae structure. He needs to keep
garbage cans, boat trailer, etc. in a garage. There is currently
no garage.
Ms. Smith asked how close the garage would be to the house.
Mr. Zirngible stated there would be 2.5 feet between the dwelling
unit and the garage.
Ms. Beaulieu asked what the hardship would be if the garage were
limited to 21.5 feet in width.
Mr. Zirngible stated the boat trailer takes the space of a.car, and
in terms of cost, the costs for building would be the same.
Dr. Vos asked if the building could be located in another place.
Mr. Zirngible stated, no. There is an existing driveway at the
north end of the property. If �a garage were placed in that are,
he would still need a variance because of the placement of the
house on the property.
Ms. Smith asked what the petitioner has planned for the second
story of the house.
Mr. Zirngible stated they plan to add a bath and master bedroom.
The roof line would be extended over what is now a flat roof.

Dr. Vos stated his opinion of a 21.5 foot double garage gives no
space to open the car door in the garage. One can hardly get out
of the car.
Ms. Beaulieu stated she would xnove to approve both requests. The
first shows a hardship with where the house is located. A garage
is necessary. It seems as if the petitioner has looked over the
situation and has found the best placement. The second request is
an existing condition so adding the second floor at 17 feet is not
a detriment, and she felt that the spirit of the Code will be met.

Ms. Smith stated she does not like the side yard setback because
it constricts the neighbor in the future if they want to do
anything, but the lot is large. Allowing the upstairs, if done
pzoperly, will add to the property.
Dr. Vos stated there is 22 feet from the adjacent dwelling to the
lot line. If the petitioner goes 2.5 feet from the property line,
it will hinder the neighbor.
Ms. McPherson stated that if the property owner to the west wanted
to build, the distance between structures would be reduced from 15
feet to 12.5 feet.

The reason for the firat variaace aad hardship ia to build a garage. We
do not preaently have a garage on the property. The aize of the garage
that we want to build ia 24 feet by 24 feet. It is not going to be
attached. It is going to be built on the west aide of the house.
The second variance and hardship ie to add on to the aecond floor of the
house on the north end. It would cover the portion of the houae that
present].y has a flat roof. We would like to build a bedroom and a bath.
