Public purpose served by this requirement is to avoid the congestion of
ovprcrowdinq a residential neigh6orhood, to avoid an excess burden on
tF�e existinq �•!ater and sewer services, and to avoid reduction of
surrounding property values.
Section 205.07.3, U, 1, requires a front yard set6aci: of not .less than
35 feet.
Public purpose served by this requirenent is to allorr for off-street
parking without encroaching on the pu6lic rig!it-of-ti•�ay, and also for
aesttie*.ic consideration to reduce the buildinq "line of siqtit" encroach-
ment into tfie neiqfibor's front yar�.
B. STATED HARDSHIP:
From HUD Residential Appraisal Report dated 7/22/R6: "Suf�,iect is a
very narqinal property whicfi arill continue to be a problem if its
deficiencies are not corrected. Very snall house, general condition is
poor, roon sizes and layout are poor."
C. ADltI�IISTRATIVE STAFF RE1�IE41:
This is a 50 6y 110 ft. 6uildinq site �vith hoMes on both sides. This
lot fias a sr�all house and a detached garaqe in the rear yard. It
presently is classified as a legal nonconforr�inq use because the lot is
less than 7,500 sq. ft, and tfie fiouse is only 26 feet back from the
front lot line. TFie petitioner is proposinq to make a 27 by 17 ft. �
addition, as well as upgrade tf�e existing structure. If the Roard
approves this request, the Staff suggests that a stipulation be �ade to
hard surface ti�e driveway:
Mr. Clark stated the driveway r�as already hard-surfaced. Hoviever, one sti�ulation
the Staff vrould like to add was that if the variance was granted, not only the
addition, but also the existing house must be brought up to �oday's buildin4 c�de
standards. He stated that a�as the law and v�ould need to be cfone anyvr�3so
P1r. Clark stated the plot plan r�as in the aqenda. He stated the Commissioners
had a picture of the house and sor�e preliminary house plans.
Ms. Dana Elsen, tf�e petitioner, stated she had more finalized house plans sho�•�in�
t� elevations on all sides. She showed the plans to the Carmissioners.
Mr. Betzold stated one of the stipulations mentioned by Staff was that the whole

Pir. Barna� stated he has lived in this neighhorf�ood since 197(1. HP otvned and
recent�y sold a house similar to-tF�is one just two blocl:s north. I{e had also
built an arfdition onto this fiwse, lie stated the proposPd acidition �►as � very
nice addition. The plans ��ere well laid out, and he thought the addition would
increase the value of the house.
P�1s. Savage stated she agreed with �tr. Barna. The existing house was certainly
inadr_quate for anyone to live,in now, an� it looked inadequate for the neigh-
borhood. The addition would certainly uPqrade the house and she r�ould be in
favor of qranting the variance.
Nr. Betzold stated it was also an incentive to otf�ers in the neiqhborhood to
keep inproving the neigh6orhood. By building onto the back of the house, it
� was not r�oving the house any closer to the street.
P1r. Barna stated one of the reasons the City wants larqer lots was so there
was room for recreation tvith the house. This area was quite profuse in parl:s--
1-2 blocks from the Ptississippi River, about 3/10 mile from Rivervietv Park,
and about 3/4 mile from Springbrool: �Jature Center. There was plenty of
recreational area so the suhstandard lot would not affect the intent of the
ci ty code.

G ADMINISRRATIVE STAFF REVIII�T:
This is a 50 by 110 ft building site with haanes on both sides. This
lot has a small house and a detachecl garage in the rear yard. It
presently is classifieol as a legal nonconfornning use because the lot is
less than 7500 sq. f� and the house is only 26 feet back f rom the
front lot line. 71ne petitiorier is proposing to make a 27 by 17 foot
addition, as well as upgrade the existing structure. Sf the Board
approves this request the staff suggests that a stipulation be ma�e to

Section 205.07.3, A, 2, requires that a lot in a plat recorded before
Decer�ber 29, 1955, shall have a minimum lot area of 7,500 sq. ft.

Public purpose served by this requirement is to avoid the congestion of
overcrowdinq a residentia7 neigh6orhood, to avoid an excess burden on
the exis�ing ��!ater and sewer services, and to avoid reduction of
surrounding property values.
Section 20�.07.3, U, 1, requires a front yard setbacl: of not less than
35 feet.
Public purpose served by this requirement is to allovr for off-street
parl:ing without encroaching on the pi�6lic rig!it_of•t�ay, and also for
aestlietic consideration to reduce the building "line of siqht" encroach-
ment into tfie neighbor's front yard.

From HUD Residential Appraisal Report dated 7/22/�6: "Suf�,iect is a
very narginal property whicfivrill continue to be a problem if its
deficiencies are not corrected. Very small house, qeneral condition is
poor, room sizes and layout are poor."
C, ADPIIPlISTRATIVE STAFF REVIEI�J:
This is a 50 6y 110 ft. 6uilding site ��rith homes on both sides. This
lot f�as a sr�all house and a detached garage in the rear yard. It
presently is classified as a legal nonconfore�ing use because the lot is
less than 7,500 sq, ft, and tfie Fimuse is only 26 feet back from the
front lot line. TFie petitioner is proposing to make a 27 by 17 ft.
addition, as well as upgrade tfie existing structure. If the Roard
approves this request, the Staff suggests that a stipulation be r�ade to
hard surface the driveway.
Mr. Clark stated the driveway was already hard-surfaced, However, one stipulation
the Staff would like to add was that if the var-iance was granted, not only the
addit.ion, but also the existing house must be br�ught up to �oday's buildinq code
standards. He stated that v�as the law and would need to be done anyvray.
P1r. Clark stated the plot plan v�as in the agenda. He stated the Commissi�nPrs
had a picture of the house and some preli�ninary house plans.
Ms. Dana Elsen, tf�e petitioner, stated she had more finalized house plans sho�•►inct
the el�vations on all sides. She showed the plans to the Cormissioners.
Mr. Betzold stated one of the stipulations mentioned hy Staff v�as that the whole
house be brought up to code. 41as that the petitioner's intention?

P1r. Clark pointed out that nost of the lots in the area were the same size as the
petitioner's lot.

P1r. Barna" stated he fias lived in this neigf�borhood since 1970. HP owned and
recentiy sold a house similar to this one just two blocks north, F�e had also
built an addition onto this house. He stated the proposed addition was a very
nice addition. The plans were well laid out, and he tf�ou�ht the addition would
increase the value of the house.
D1s. Savage stated she agreed with P1r. Barna. The existing house was certainly
inadequate for anyone to live in now, and it looked inadequate for the neigh-
borhood. The addition would certainly upgrade the house and she would be in
favor of granting the variance.
P1r. Betzold stated it was also an incentive to others in the neighborhood to
keep inproving the neigh6orhood. By 6uilding onto the back of the house, it
was not r�oving the house any closer to the street.
P1r. Barna stated one of the reasons the City wants larger lots was so there
was room for recreation with the house. This area was quite profuse in par{:s--
1-2 blocks from the Plississippi River, about 3/10 mile from RivervietN Park,
and about 3/4 mile from Springbrool: P�ature Center. There was plenty of
recreational area so the substandard lot would not affect the intent of the
city code.
