Mr. Keacper atated that he didn�t think he wanted the Appeels Commission put ia the position oP agreeiag that the lot was buildable, and then finding out $hat it wasn't. Nlr. Mr. Ke�uper stated that the Appeals Commission Was a Board of the City of Frfdley� and it would be giving tacit approval�to certain elements of the problem_ancl s�as aot sure he knew enough at this.point in time to be able to do that. Mr. Barna asQed if the Coaffiission wa8 expected to react to the Missi�sippi River Corridor Critical Areas part of it as a variance thing-or if this part of it ��ras under the Special Use Permit. 1Kr. Holden stated th�t it Was a variance. l�r. �arns stated that he had no ob�ectians to the 60 foot lot size becauae ma�r lots are only 50 feet. As far as the 768, square foot requirement, mar�y of the ha�es•in that area are less thaii 720 square feet� so he would have no objection to that. Mr. Barna atated that as far as the river corr3dor variance� except � for the floal plain part, as far as preserving anything, the preserved ar�a m_ separated by a road and a bicycle walkway. Mr. Barna stated that he felt that�the house would fit in nicely. Mr. Barna stated that he would have 13ked to hear fraan the geople to the east oP this lot, becsuse.this house would be higher. Mr. Barna s�arized tbat he would have no objectians to the three variances; to building within 100 feet of the river� to buildiag the house 48 feet smaller �han required, and to bui.ldi�g on a lot smaller th�n the required 7500 square feet. He stated a special use permit is required since the property lies within the flood plain. Mr. Sobiech stated the City has received no negative comments from the Department of Natural Resources. He stated a drainage plan has been sub- mitted which would direct water to the street to be received by the storm sewer system in Fairmont Avenue. Mr. Sobiech stated one of the variances has been deleted regarding the size of the dwelling, therefore, the two variances to be considered would be reduction in the minimum size of the lot from 7,500 to 6,420 square feet and a variance to the Interim Development Regulations for the Mississippi River Corridor Critical Areas to reduce the minimum setback from 100 to 80 feet. No persons in the audience spoke for or against these requests for a special use permit and variances. MOTION by Councilman Fitzpatrick to approve SP #78-12 with the stipulation that the plan submitted is follov�ed and acceptable to the City Engineer. Seconded by Councilfian Schneider. Councilman Schneider questioned, if there was some future damage to this house from floodirg, if the petitioner would have recourse back to the City. Mr. Herrick, City Attorney, felt the City has adopted reasonable standards and is taking the necessary steps to see that these standards are met. He stated the petitioner has been made aware that this lot is in the flood plain and knows what the highest previous flood experience has been and has re- quested permission to build knowing the situation. Mr. Sobiech stated it is intended to have the variance request for all three structures, however, if the variance was not utilized within one year, it would be necessary for them to renew or reapply. Mr. Dick Johnson, representing D. W. Harstad, requested they have the option to extend. the variance beyond the time limit. Mr. Kim Wall, 8065 Riverview Terrace� came forward and stated that Fairmont caanes down at such an incline� that if there was a heavy rain, and the water builds up� that drain cannot handle it, and the street fills with water and then drains into an empty lot. The person who owns the lot just p�ys taxes and won't bu31d on that lot be�ause it is too small. Mr. Wall was concerned that if Ms. Spohn's property was built up� would tbe water run into his driveway. Rir. Hall also stated tha�t if Ms. Spohn's lot is raised 4 feet and if it was graded with a 15 feet inclin� awqy from the house� the water would run�east� which is a decline going the other wa�, and a11 that water will �o back again, and there was water sitting on Ms. Spohn's lot this spring, because the dra3ns cannot handle the water. Mr. Harrie asked where the catch basins were located. Mr. Eall stated there are located near her east lot line,�and another a little south across the street on Fairmont.
