claim other than negligence on the part of the City or its agents.
I affirm that this work is requested due to the immediate need, schedule, and my financial
condition, and that this request is only being allowed at the sole discretion of the City of
Fridley.
I understand that I am responsible to the City for all costs related to the work listed above as
established by the contract cost(s) to the City of Fridley for all work completed, plus 12%
for Engineering and Administration. I am also requesting that these costs are added to my
special assessment for City of Fridley Project �jZp I�^(� 1 and assessed to my
property consistent with the special assessment for this project, including certification to my
property taxes, and any and a11 interest required.

structure, or for any addition to any existing building or structure, or for any altera.tion or repair
to any existing building or structure, upon applic�tion therefore, require the payment by the

We are wri6ng regarding the 2010 Street Rehabilitation Project No. ST2010-01. Our home is on
Femdale Avenue, included in the project. We are having our outdated asphalt driveway removed
and replaced with cement
We feel it is also important to replace the curb-cut prior to the mill work and overlay of the street.
It is our request that you consider authorizing the $480.00 cost of the curb-cut to be included with
the special assessment our property will incur upon completion of the street rehabilitation.
If you will include the $480.00 cost of the curb-cut with our street special assessment, wre waive
any and all rights to appeal any or all portions of the ST2010-1 special assessmeni

Notice is hereby given that the City Council will meet at 7:34 P.M. on October 26, 2009 in the Council
Chambers, Municipal Center, 6431 University Ave. NE, Fridley, MN, to consider the proposed
assessment for the 2009 Street Improvement Project ST2009-01. Adoption by the City Council of the
assessment may occur at the hearing.
The area to be assessed for the improvement is legally described as follows:
Pin(s) all located in the City of Fridley, County of Anoka, State of Minnesota.
The amount PROPOSED to be assessed to your properly is as follows: $ 1023.00.
It will be payable over 10 years at 6.5% interest (See page 2 for payment options).
T'he proposed assessment roll is on file for public inspection at the City of Fridley Finance Office. Written
or oral objections will be considered at the meeting. People who desire to be heard regarding the proposed
improvement and assessment shall be heard at this meeting.
If you wish to preserve your opportunity for appeal of the assessment, you must present your objections in
writing.
Minnesota Staxutes, Section 429.061, Subdivision 1, provides in part: "T�10 appeal may be taken as to the
amount of any assessment adopted pursuant to Subdivision 2, unless a written objection signed by the
affected property owners is filed with the Clerk prior to the assessment hearing or presented to the
presiding officer at the hearing." No appeal of your assessment will be accepted by t6e district court
unless this written objection is properly filed.
An owner who has properly filed a written objection as provided in the preceding paragraph may appeal
an assessment to the District Court, pursuant to Section 429.081, by serving notice of the appeal upon the
Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with
the District Court within 10 days after service upon the Mayor or Clerk.

Minnesota Statutes Sections 435.193 through 435.195 and Council Resolution 14-1995 authorize
the City to defer the payment of special assessments against homestead properties owned by
persons older than 65 yeazs of age and disabled persons for whom it would be a hardship to make
the payments. Under this arrangement interest WILL accrue from the date of adoption. For
fiu�ther information about this deferral prograzn, contact the Finance Department at
763-572-3526.
1. Various options aze available for �aying the principal amount of the assessment after the
City Council has accepted the roll:
A. Payment of the pri.ncipal either IN FULL or AT LEAST HALF will be accepted
until November 25, 2009.
B. Allow the entire assessment to be certified to the Anoka County Property Records
and Taxation Division for collection with real estate taxes in 2010.
2. Interest is charged in the following matter:
A. No interest is charged if full paymerat is received within 30 days of adoption of the
special assessment roll or by Noverrnber 25, 2009 (if the assessment is adopted on
October 26).
B. After.30 days: from adoption, interest will be chazged on the remaining balance on
a daily basis from the adoption date.
3. If you do not prepay in total prior to November 25, 2009, the rema.ining principal along
with interest from the d.ate of the adoption of the resolution through December 31, 2010,
will be collected with your 2010 taxes.
