Public purpose served by this requirement is to allow for o� street parking without encroaching on a right-of-way, and also for aesthetic consideration to reduce the building "line-of-sight" encroachment into the neighbor's front yard. The petitioner requests that the frorrt yard s�back be reduced from 35 feet to 30.5 feet to allow construction of a 26 x 32 foot addition to an existing dwelling. 2 °. Property H'istory � � The ea�ting dwelling was consaucted in 1956. The existing dwelling is a two story structure with a tuck-under two car garage. In 1976, a building pemut was issued to construct a 1Qx16 foot deck. In 1995, a building permit was issued for alteration of the kitchen. The subjed prope�ty has a dramatic change in topography from north to south. The proposed addition would occur on the south side of the existing dwelling. It includes a new garage with a geat room and deck above it. The petitioner has two alternatives which would meet the code requirement: 1. Petitioner could reduce the size of the addition to meet code requirement (21.5 x 32) 2. Petitioner could move the addition to the east to meet the setback requirements. Ms. McPherson stated the subject property is located at 5221 Fillmore Street N.E. The property is zoned R-1, Single Family Dwelling, as are the surrounding parcels. The variance request by the petitioner on behalf of Mr. & Mrs. Raines is to reduce the front yard setback from 35 feet to 30.5 feet to allow the construction of a 26 foot x 32 foot addition. Ms. McPherson stated the existing dwelling was constructed in 1956. The dwelling is a two-story structure with a tuck-under garage. There is a driving and parking area toward the street side of the dwelling. The petitioner is proposing to construct a garage, a great room and a deck addition. There are alternatives for the petitioner as follows: 14 , R J � � 1. Reduce the size of the addition (21.5 x 32). 2. Move the addition back to meet the setback. Ms. McPherson stated the City has granted similar requests in the past. Staff has no recommendation. Mr. Wallen stated the property in question has a severe north and south slope. From the south end of the proposed garage area, there is an extensive retaining wall and the steep slope drops approximately 35 feet. Mr. Raines has done extensive retaining of that wall and another beside the house. To move the proposed garage back would encroach on an existing bedroom and the window. To reduce the size of the garage to 21.5 feet would reduce the interior to 20 feet after allowing for construction. Mr. Raines is a painting contractor with a one ton pickup truck that he uses for this business. The truck is 20 feet long itself. If the size is reduced, the truck would not fit in the proposed garage. Mr. Raines currently does not use the tuck under garage. It is very small and inadequate. The proposal is to provide storage. Currently the house has no basement and they use the existing garage for storage. They would like to achieve some type of storage space for the family. A three-car garage is something they would like to have. Their daughter is nearing driving age and they may acquire another vehicle. Rather than park in the drive, they would like to have the third car storage. In addition, the depth would give Mr. Raines an opportunity to store painting materials. He currently stores extension ladders on the drive area. He would like to place them in an enclosure to also keep secure. Mr. Wallen provided photographs of the property as it currently exists. The property has an existing deck which would be removed and the garage constructed. Storage for extension ladders is currently on the ground. There is also an extensive retaining wall. There is another retaining against the house with steps coming down to the yard. Mr. Raines currently has a small back yard and play area. The property is located on a cul de sac. The proposed garage would be setback 36 feet at the north corner of the driveway but as the cul de sac curves it impacts the setback. other homes on the cul de sac have shorter setbacks. Because of the severe slope, it has caused conformance problems for everyone in that area. Dr. Vos asked if the request is for 35 feet to 30.5 feet on the right hand side of the driveway only. Ms. McPherson stated yes. Mr. Kuechle asked how close the tie in of the addition would be to the existing windows. It appears to be four to five feet. 15 � 4 � � Mr. Wallen stated they would have to remove a section of the retaining wall. It is possible to move the addition back but, with the construction of the house and the retaining wall, he is concerned, when taking a retaining wall that meets frost and in coming closer to the steps, that could affect the integrity of that wall. Mr. Kuechle stated it is not a great expense to remove a wall and bring it into compliance. Mr. Wailen stated the stairs are narrower at the top and widen as they come down. The retaining wall is rounded. Mr. Raines stated he did not know if they could get a full five feet. There is also a fireplace there. Mr. Wallen stated another concern is that this is a beautiful site. The more you go back the more you encroach on the upper window also because the addition will be tall. Mr. Bliss stated he lived in the house directly across the street. He has no objection to the addition. He thought it would help. Mr. Raines has to park his cars outside now. He has a difficult turn to get into the existing garage. Mr. Bliss stated he has a 17 foot setback granted in 1979. There is also a difficult slope. The petitioner also has a very steep slope on the south side so the usable space is very limited. Dr. Vos asked if the neighbor to the south had any comments about the proposed expansion. Mr. Raines stated they took the plans and showed them to all the neighbors. Almost everyone was shown the plan and seemed to be in favor. Ms. McPherson stated staff had received no calls. MO ION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. IIPON A VOICE VOTE, ALL VOTING A7[$, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRILD AND THS PIIBLIC HEARING CLOSED AT 9:05 P.M. Dr. Vos stated he looked at the property. He thought it amazing that the owner had done what they are going to do already. He has never seen a cul de sac as big as that one in Fridley. There is a 36 foot setback on the north side and 30.5 on the south side. The radius of the cul de sac causes a part of the hardship. He would vote for approval. Ms. Savage agreed. Also, the shape of the lot causes a hardship with the slope which eliminates much of the usable yard space. 16 m 4 � . She thought that the public purpose would be served by the addition and did not think there would be any adverse effect by the variance. She would vote in favor. Mr. Kuechle stated he thought the contractor could have gotten the addition onto the site without a variance. It could have been moved back toward the window more. He did not feel that a convenience necessarily constitutes a hardship. However, in this case, the site lines are not affected and the setback is really only 4.5 feet so overall he would be willing to vote in favor. Ms. Smith stated she would vote for approval. The property is zoned R-1, Single Family Dwelling, as are the surrounding parcels. The variance request by the petitioner on be.half of Mr. & Mrs. Raines is to reduce the front yard setback from 35 feet to 30.5 feet to allow the construction of a 26 foot x 32 foot addition. Ms. McPherson stated the existing dwelling was constructed in 1956. The dwelling is a two-story structure with a tuck-under garage. There is a driving and parking area toward the street side of the dwelling. The petitioner is proposing to construct a garage, a great room and a deck addition. There are alternatives for the petitioner as follows: 1. Reduce the size of the addition (21.5 x 32). 2. Move the addition back to meet the setback. Ms. McPherson stated the City has granted similar requests in the past. Staff has no recommendation. Mr. Wallen stated the property in question has a severe north and south siope. From the south end of the proposed garage area, there is an extensive retaining wall and the steep slope drops approximately 35 feet. Mr. Raines has done extensive retaining of that wall and another beside the house. To move the proposed garage back would encroach on an existing bedroom and the window. To reduce the size of the garage to 21.5 feet would reduce the interior to 20 feet after allowing for construction. Mr. Raines is a painting contractor with a one ton pickup truck that he uses for this business. The truck is 20 feet long itself. If the size is reduced, the truck would not fit in the proposed garage. Mr. Raines currently does not use the tuck under garage. It is very small and inadequate. The proposal is to provide storage. Currently the house has no basement and they use the existing garage for storage. They would like to achieve some type of storage space for the family. A three-car garage is something they would like to have. Their daughter is nearing driving age and they may acquire another vehicle. Rather than park in the drive, they would like to have the third car storage. In addition, the depth would qive Mr. Raines an opportunity to store painting materials. He currently stores extension ladders on the drive area. He would like to place them in an enclosure to also keep secure. Mr. Wallen provided photographs of the property as it currently exists. The property has an existing deck which would be removed and the garage constructed. Storage for extension ladders is currently on the ground. There is also an extensive retaining wall. There is another retaining against the house with steps coming down to the yard. Mr. Raines currentiy has a small back , .. '��A `.d _ _ .. � • � � . The proposed garage would be setback 36 feet at the north corner of the driveway but as the cul de sac curves it impacts the setback. Other homes on the cul de sac have shorter setbacks. Because of the severe slope, it has caused conformance problems for everyone in that area. Dr. Vos asked if the request is for 35 feet to 30.5 feet on the right hand side of the driveway only. Ms. McPherson stated yes. Mr. Kuechle asked how close the tie in of the addition would be to the existing windows. It appears to be four to five feet. Mr. Wallen stated they would have to remove a section of the retaininq wall. It is possible to move the addition back but, with the construction of the house and the retaining wall, he is concerned, when taking a retaining wall that meets frost and in coming closer to the steps, that could affect the integrity of that wall. Mr. Kuechle stated it is not a great expense to remove a wall and bring it into compliance. Mr. Wallen stated the stairs are nar,rower at the top and widen as they come down. The retaining wall°is rounded. Mr. Raines stated he did not know if they could get a fuil five feet. There is also a fireplace there. Mr. Wallen stated another concern is that this is a beautiful site. The more you go back the more you encroach on the upper window also because the addition will be tall. Mr. Bliss stated he lived in the house directly across the street. He has no objection to the addition. He thought it would help. Mr. Raines has to park his cars outside now. He has a difficult turn to get into the existing garage. Mr. Bliss stated he has a 17 foot setback granted in 1979. There is also a difficult slope. The petitioner also has a very steep slope on the south side so the usable space is very limited. Dr. Vos asked if the neighbor to the south had any comments about the proposed expansion. Mr. Raines stated they took the plans and showed them to all the neighbors. Almost everyone was shown the plan and seemed to be in favor. IIPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PIIBLIC HEARING CIASED AT 9:05 P.M. Dr. Vos stated he looked at the property. He thought it ama2ing that the owner had done what they are going to do already. He has never seen a cul de sac as big as that one in Fridley. There is a 36 foot setback on the north side and 30.5 on the south side. The radius of the cul de sac causes a part of the hardship. He would vote for approval. Ms. Savage agreed. Aiso, the shape of the lot causes a hardship with the slope which eliminates much of the usable yard space. She thought that the publie purpose would be served by the addition and did not think there would be any adverse effect by the variance. She would vote in favor. Mr. Kuechle stated he thought the contractor could have gotten the addition onto the site without a variance. It could have been moved back toward the window more. He did not feel that a convenience necessarily constitutes a hardship. However, in this case, the site lines are not affected and the setback is really only 4.5 feet so overall he would be willing to vote in favor. Ms. Smith stated she wouid vote for•�'approval. The request meets the setback on one side and is only 4.5 feet on the other corner. MOTION by Dr. Vos, seconded by Ms. Smith, to recommend approval of Variance Request, VAR #95-11, by A. E.
