N�ERS PRESENT: Ylinen, Mittelstadt, Miniah 1�IDERS ABSENT: 0'Bannon, Ahonen OTHgtS PRESENT: Breher-Building Official MOTION by Miniah to accept the amended minutes of the August 7, 1968 Board of Appeals Meeting. Seconded by Mittelstadt. Upon a voice vote, there being no naye, the motiox� carried u.na.nimously. A REQIIEST FOR A VARIANCE OF SECTION 45.23(a) SIDE YARD SET BACK FROM 5 FEE�T TO 2 FEEI' 6 INCHES. AND SECTION 45.26 FRONT YARD SET BACK FROM FEET TO 2 FF�,fi TO PERMIT CONSTRIICTION OF A 17 FOOT 6 INCH BY 25 FOOT ATTACHID GARAGE ON LOT Mr. Mickley was present to speak on his own behalf. Mr. Mickley called to the attention of the Board that the contractor for exiating dwelling ma.de an error in side yard aet backa when pourin� the footinge wherein the aide yard set backs axe 20 feet instead of 25 feet, and 15 feet � inatead of 10 feet, neither being in violation of any Code but ms.kirig it neceseary for the request for a side ,yard variance of Section 45•23 (a). MOTION by iVlittelstadt to grant the two variances becauae the owner wae a victim of circumstancea ina.smuch as the house was not placed on the property as originally planned, a.nd due to the contour of the lot it prohibits the construction or use of a detached �ara,ge and it does not cause a hazard by reducing the iront yard aet back and also due to the fact that none of the adjoining property owners were present to present an objection to the requeated variance. Seconded by Miniah. Thie variance ie �ranted because the co.ntour of the lot is of auch to allow for a walkout baseme.nt therefore, a detached ga,ra.ge could not be built without caueiz�g a hardahip to the homeowner, also the fact that no one was present to oppoae thie variance request. N.E. FRIDLEY. MINIVESOTg. REQIIEST BY J�CEN ST. N.E 1 Mr. and Mrs. Jacen Sykes were present to present their request. MOTION by Mittelstadt to close the public hearing. Seconded by Minish. IIpon a voice vote, there bei.ng no na,ys, the motion carried unanimously. M�I'ION by Miniah to grant thia variance as there is a hardship in the request. On most corner lots the side street side yard ie 17 feet 6 inches, whereas in this case the house is reatricted to 35 feet to line up with the other houses. Also, other home ownera in the area have been granted similar vaxiancea to build detached ga,rages. Because of the building of Interstate #694 there is very little uniformity of structures and it's to late now to try and make it uniform. To allow this variance would not hinder visability or be a hazaxd in anyway. Also this requeat was accompanied by a petition signed by 21 area homeowners. Seconded by Mittleatadt. WASH", LOT 1 � AVE. N.E.. E STREET N.E Mr. Parizek etated that since the change in the service road, he was forced to remove his pylon type sig.n and would like to keep it in line with the old poaition which was on the right of way. At this time Mr. Paxizek was iziformed that a sidewalk was proposed thru tha,t area where he had intended to set the aign and if he moved the sign back to allow for the sidewalk and planting strip he would be back the necessary 10 feet as required by the Code.
