SUBJECT: Fence Behind 6655 Fridley Street, N.E.
Based upon your memorandum of July 11, 1991, subject as above, you
indicate that the fence is not on City property and therefore, is
not a City responsibility.
In regards to easements and right-of-ways in which the City has
certain rights such as alleys or streets that we have not improved,
we have allowed the residents to utilize this area for their own
uses with the understanding that should the City initiate an
improvement project, we would not be responsible for the removal
and replacement of anything that is in the dedicated area. In this
particular case, it would appear that one of the residents in the
past have installed a fence and, therefore, the property owners by
purchase have assumed responsibility for that fence.
The sketch you provided indicates that approximately 1/2 of the
fence is on each of the abutting properties. Therefore, it would
be appropriate for each of the property owners to be responsible
for the actions for their 1/2 of the fence length.
I would assume that if the City receives a petition from the
property owners to remove the fence and to assess them for the
costs associated with it, we would be able to provide to Council
and then take action that you have proposed. Until such is
received, I do not suppose that your request can be acted upon.

Recently, I received a complaint regarding a fence in disrepair at
the above-referenced location: Upon further investigation, I
learned that this homeowner and the adjacent property owner (6640
McKinley Street) were both confident that the fence in question was
not on their respective properties. Apparently, the City owns a
12 foot strip of property between Fridley and McKinley Streets
north of 66th Avenue which has not been vacated, although there is
not even an unimproved alley at this location.
I asked Ray Statler to check this site, and he informed me that the
fence does not appear to be on City property. I have attached
copies of additional information, including a drawing that Ray made
recording his findings.
Please authorize the removal of this fence as soon as possible.
Feel free to see me if you have questions or wish to discuss this
matter further. Thanks for your assistance!

Please revie�a the attarhed information relating to the fence located betwe.�n your
property and 6640 McKinley Street N.E. Included in these materials is a memo to the
City Att�rney concerning this issue arid his written response to my questions.
It appears fro�n the City Attorney's reply that the City does not h,ave any
responsibility regarding this fence, since the City has not opened or authorized a
public alley at this location. The City merely maintains the ric�t to establish an
alley at scnne future date.
�us, there are two pos.sible alternatives that y�z could pursue, should yau wish to
take further action in this matter:
1. Vacation - You could request that the City formally vacate this alley. This
would result in an additional six feet each being deeded to you and your
neighbor to the east. Should you wish to pursue this option,you will need to
sul�nit a�leted vacation request form with a non-refundable fee of $100.
(I am aware frcan a previous canversation that you do not believe that you
should have to pay this fee. We must rec��ire the fee to process the
application, but you may request that the City Council waive the fee and
refund your money when they are consider�ng the application.)
2. Repair/remove/replace Fence - You and/or your neighbor could take action to
correct this problem. If you choose to construct a new fence, please refer
to the City Attorney's answer to question #3 from my memo.
