NOTICE IS HEREBY GIVEN that the Appeals�Commission of the City
of Fridley will meet in the Couneil Chamber of the City Hall at
6431 University Avenue Northeast on Tuesday, April 26, 1977 at 7:30
P.M. to consider the following matter:
A request for variances of: Section 205.053,
1B, Fridley City Code, to reduce the minimum
lot area on a lot recorded before December 29,
1955, from 750Q square fe�t to 5220 sqt�are
feet, and Section 205.053, 4C, to reduce the rear
yard setback from 33.75 feet to 25 feet (1/4 lot
depth), and, Section 205.053, 2B, to reduce the
n"rinimun lot width from 50 feet to 40 feet, and
Section 205.053, 4b, 5a, to reduce the street
side of a corner lot from 17.5 feet to 4 feet
on the north side of the lot, all to allow the
construction of a dwelling to be located on Lot
1, Block 2, Oak Grove Addition to Fridley Park,
the same being 6694 Fridley Street N.E., Fridley,

Please be advised that the County of Anoka Park Department
has no opposition to the above application and that it in
no way conflicts with any plans for development of Rice
Creek. It is requested however, that an easement over the
Northeasterly portion of this lot be negotiated to allow
convenient access to the top of the embankment for pedes-
trian traffic and maintenance purposes. The attached map
shows a suggested easement area in green.

Mr. Sobiech, Public Works Director, stated this is a request for four variances on
property located at 6694 Fridley Street. The variances requested are as
follows: (1) To reduce the minimum lot area from 7,500 square feet to 5,220
• square feet; (2) To reduce the rear yard setback from 33.75 feet to ?5 feet;
(3) To reduce the minimum lot width from 50 io 40 feet; and (4) To reduce the
street side of a corner lot from 17.5 feet to 4 feet.
Mr. Sobiech stated numerous discussions were held at the Appeals Comnission
Meeting and their vote was to deny this request.
In response to a question by Councilman Fitzpatrick regarding 67th Avenue, Mr.
Sobiech indicated it is not vacated.
Mr. Willey appeared before the Council arid stated, basically, this is a repetition
of a request made in 1973 when he tried to find sane means of making this iot
buildable for a single family residence. He explained the difference in this
I request from the one made in 1973 is that he would meet the standard setback
requirement on the south side.

Mr. WilTey indicated he would like to make this lot buildable which he felt would
be benefical to both the City and himself.
Mr. Dennis Drevniak, 6684 Fridley Street N.E., indicated he was opposed to this
variance. He stated a petition was presented to the Cormnission and most of the
neighbors in the area are opposed to the variance. He indicated they would not
be in favor of a 40 foot lot.
Councilman Schneider felt the Council has taken a strong position on 40 foot
lots to not encourage development and, therefore, he would n�t be in favor of this
variance.
MOTION by Councilman Schneider to concur with the recommendation of the Appeals
Comnission and deny the following four variances: (1) Reduction of lot size
from 7,500 square feet to 5,220 square feet denied, because of overcrowding of
the lot in a residential neighborhood; (2) Reduction of rear yard setback

3Q2.02 as ollows:
"It shall b unlawful for any person, or for the parents or guardians of an person '
under 18 yea of age, who owns, harbors, or keeps a dog, to allow such do ,
regardless of ge of dog, to run at lar�e in,the City of Fridley."

Mr. Brunseil, City Clerk, stated thi ordi nce would change the dog license fees
and entertairment license fees.
MOTION by Councilwoman Kukowski to wai the reading and approve the ordinance upon
its first reading. Seconded by Counc' m n Schneider.
Mr. Qureshi, City Manager, stated t new icense fees will not cover the administrative
costs involved.
Councilwoman Kukowski felt, how er, if the li enses were not issued for the entire
year, residents would not obta' the necessary icense.
UPON A VOICE VOTE TAKEN ON E MOTION, all voting aye, Mayor Nee declared the motion
carried unanimously.

APPROVING SALE OF TAX FORFEIT PROPERTY:
Mr. Qureshi, City Manager, reviewed a list of tax rfeit properties and requested
approval from Council, if they wished the C nty to ell the property in June.
Mr. Herrick, City Attorney, stated it wou d seem, when he City permits someone to
buy property at public auction, you are in essence, tel ing them there is some use
for that property. He felt perhaps s notice should be iven at the time of the
auction that lots not meeting minimum equirements of the c e are not buildable.
Mr. Qureshi suggested eliminating e lots that are 40 feet o less from the auction
sale.
MOTION by Councilwoman Kukowsk' to approve the list of properties or the tax forfeit
land sale, but removing all 1 s�chich are 40 feet or less. Secon d by Councilman
