28th day of June, 2000, on a petition for a variance pursuant to the City of Fridley's Zoning Ordinance, for the
following described property:

To reduce the rear yard setback from 25 feet to 19 feet;

MOTION by Mr. Tynjala, seconded by Mr. Jones, to open the public hearing and waive
the reading. Seconded by Mr. Jones.

Mr. Bolin stated that the lot is odd shaped. It was built in this location to keep the home
lined up facing the same direction as the other streets in the neighborhood. Technically,
it is only 30 feet from the front yard setback rather than the code-required 35 feet so a
variance for that nonconformity needs to be obtained before the expansion can happen.
The petitioner is hoping to expand on the north side of the existing home requiring a

reduction in the rear yard setback from 25 feet to 19 feet. A side yard setback reduction
is requested from 17%2 feet to 15 feet. The petitione�s reason for this request ties into
the comprehensive plan with the plan books to identify different ways for Fridley
residents to add onto their existing homes. Many homes were built in the 1950s and
1960s, and a lot of them do not really meet the needs of today's families. This is one
way to keep families in Fridley.
Mr. Bolin stated that the home is located at 5991 Gardena Lane on the comer of the cul�
de-sac. The home is zoned R-1, as are all the surrounding properties. The petitioner's
hardship summary states: "Our entire property is uniquely shaped, as such, our options
for expansion are quite limited. In fact, we have examined our entire property and the
only area for addition would be the entire north edge of our existing home.°
Mr. Bolin stated it is relatively level on the north side of the home where the petitioner
has proposed the expansion. Staff has no recommendation as similar variances have
been granted in the past. A front yard variance on Arthur Street was reduced to 20 feet.
A rear yard setback on Rice Creek Terrace was reduced to 19 feet. A side yard setback
on a corner lot on Sylvan Lane was reduced to 10 feet.
Mr. Bolin stated that Staff recommends that the following stipulation be attached if the
variances are granted:
1. The property owner shall obtain building permits prior to construction of the new
addition.
Mr. Tynjala asked if there were any situations where the rear yard setback and side
yard setback were reduced.
Mr. Bolin stated there have not been any cases in the last three years where each was
granted at the same time; however, more complicated variances have been granted.
The-petitioner, Martin Schutz, stated this house was built many years ago and does not
lend itself to a growing family. They bought the house from his parents who had bought
the house for somewhat of a retirement home. It has very small bedrooms and one
bedroom is a loft room with the whole loft side exposed to the living room area. There is
not much privacy and they would like a more private bedroom. The addition would
consist of bedroom space and bathrooms. They would like to have more children and in
order to stay in the neighborhood in that house, they would have to add on or move.
The addition would jet out from the north end of the house, and rooflines would stay the
same, as would the width dimensions. They might change the first floor window
location.
Ms. Jackson asked if there were windows on the north side of the house.
Mr. Schutz stated there is a window and a main level window on the second floor levela

Ms. Jackson asked if there would be a window on the addition.
Mr. Schutz stated that the same window upstairs wouid be brought out roughly 14'/Z
feet. Rather than place the downstairs window; they may shift it over more tovvards the
center of the home to bring more light into the bedroom. �
Mr. Kuechle stated he would like to add the stipulation that construction be
architecturally compatible with the existing home with rooflines and siding material.
Mr. Schutz stated that there is really no other way to do it with the four bids he has. The
house is so uniquely shaped.
Mr. Jones asked if he had heard any comments from the neighbors.
Mr. Schutz stated that all the neighbors have had positive comments. They want kids in
the neighborhood, and it will not block anybody's view of the cul-de-sac.
MOTION by Ms. Jackson, seconded by Mr. Jones, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:51 P.M.
Mr. Tynjala stated he is a little hesitant, because it is fwo variances at one time,
however, he agreed with staff that it is an important goal of the City to encourage
neighborhood stability. This �s a decent proposal to achieve that.
Mr. Jones agreed.
Mr. Kuechle stated that the property is uniquely shaped and the house is relatively small
for what most home needs are today.
Ms. Jackson stated this seems reasonable to her to make the home more attractive and
functional.
MOTION by Mr. Tynjala, seconded by Ms. Jackson, to approve Variance Request, VAR
#00-13, with the following stipulations:
1. The property owner shall obtain building permits prior to the construction of the new
addition.
2. The construction shall be architecturally compatible with the existing home with
rooflines and siding material.

Tnis letter is submitted in connection with our Variance
Application dated May 9, 2000 wherein we seek approximately 3
variances from the City's zoning requirements in order to enable
us to construct an addition to our existing residence.
Specifically, this letter serves to show that strict enforcement
of the existing zoning codes would cause undue hardship on our
family because of conditions unique to our property. Also, this
letter serves to highlight our strong contention that the
granting of the variances sought would be.consistent with the
in'tent of the City' s zoning ordinances and the ;.City' s
romprehensive Plan which states in its vision statement that
°`Fridley will be widely recognized for its....sensible land use
planning that creates a distinctive image while accommodating
residential needs."
In particular, my wife and I purchased our home from my parents
in 1995. The home has been in my family for three generations.
bVe already have two young children and would like to have more
children, but the house is too small to accommodate a larger
faraiiy ancl to meet our famiiy' s needs . As such, we either need
to add on to our house or move out of the area. Our hope is that
we can add on since we really enjoy our fine neighborhood, area
schools and parks and the Fridley community.
Specifically, we would like to utilize the large area of land
directly north of our existing home to construct a 16' x 26'
�ddition. The addition would be comprised of a basement, first
floc,r. and second floor which would accommodate four additional
;�ecir�oms, one and cne-half additional bathrooms and a large
family reom.
Un.fortunately, however, we have been informed by the City that we

will be issued. They are as follows: First, we need to obtain a
°`front yard" variance since the southwest corner of our existing
home encroaches by approximately 3 feet. This condition was
created when the home was built in 1967, approximately 28 years
before we purchased the home. Second, we may need a"side yard"
variance of approximately 2 feet since our property may be
considered a corner lot. If not, our proposed addition will not
encroach on the ten (10) foot side yard setback. Finally, we
need a"rear yard" variance since our back yard is so uniquely
shaped. Specifically, our rear yard property line runs at such
an angle that it would be approximately 19 feet from the corner
�f our proposed addition whereas it is approximately 45 feet from
the southeast corner of our existing home.
As the att�ched surcey clearly sho�as, our_ entire pr�pe.�ty is
uniquely shaped, As such., our options for expansion are quite
limited. In fact, we hav� examined our entire property and the
only reasonable area for an addition would be to the entire north
�na of ou� existing horne. To be clear, there are no possible
alter�ia�tives. Unfortunately, however, we could not even put this
arA� to reasanabie and sensible use if the City fails to grant
our variance requests.
Finally, the variances, if granted, will not alter the character
o� our neighborhood. Specifically, we have one of the smallest
��crnes ir. �ur neiqhborhaod and one of the most unique yards that I
ha �e aver see?Z. rdat only wauld an addition add to our home in
i�erm� of living area for aur growing family, but it will also
acL�::��Luate �h.e uniqueness of our yard and add to the esthetic
value of �ur neighborhood. Currently, the land to the north of
our home lays idle. We would like to put this land to reasonable
�.nc� sensi�le use by constructing a modest and beautiful addition
