REASON FOR VAIANCE:
We are asking for a 28' rear yard variance to add a bathroom and laundry room on the main
level. Both Mr. & Mrs. Monlinari are in bad health and need both bathroom & laundry room
on main floor or they will be forced to sell their home and find somewhere else to live to meet
their needs.
After looking at the survey I don't understand how the City ever issued a Building permit for
this home the way the house sits on the lot. The whole house should have been moved closer
to Rainer Pass. The hardship in this case is the home is already Non-Conforming use. The
back yard of this home is very secluded and I don't think there would be any neighbors
opposed to fhis variance. By adding this addition, tlle Non-Confor2ning use really isn't any
more than it is at it's present state.

My wife and I have lived in Fridley since 1970. At this time we are both disabled. My
wife, Renata Molinari, has had both knees replaced and suffers with Degenerative Disc
Disease. I have Degenerative Disc Disease of a(1 &ve lower lumbaz vertebrae. On
9/13/2000 I was operated on for a niptured disc at L-2 az�d bulging disc at L-3. In
additioq a decompression, bone spur removal, and lesion barn was performed on
L-2,3,and4.
Our problem is we have no bathroom on the main floor and also the laundry room is 2
flights of stairs down in the lower azea of ow home. It is very difficuk under these
circumstance. The proposed addition will replace a utility deck and provide us with a
bathtoom and laundry azea on the main floor.
� have enctosed various documents as proof of disability, pictures of the current area to be
remodeled, letters of consent from my neighbors stating this proposed variance represents
no problem to them and a plot map showing the location of the proposed addition.
My wife and I respectfully ask for your approval for the requested variance so that we will

ANALYSIS
The property is located on the comer of Glacier Lane and Ranier Pass. The lot is rectangularly
shaped, with the home being "squazed up" to and fronting on Glacier Lane, with the attached
gazage located only 11' from the code defined reaz yard line. The code defined front yazd of the
home is along Ranier Pass. The existing home and gazage were built in 1960. Petitioner is
seeking variance to recognize this non-confornuty. City staff has received only coxnments of
support from neighboring property owners.
RECOMMENDATIONS
Ciry Staff has no recommendation, as similar variances have been granted in the past.

Mr. Bolin stated that the property owner, Don Molinari, is at the meeting. Mr. Molinari
would like to reduce the required rear yard setback from 39 feet to 11 feet to recognize
an existing nonconformity. The corner of the existing attached garage is only 11 feet
from what the zoning code defines as the rear yard. Zoning code requires a rear yard
setback of 25% of lot depth which is 39 feet. The narrowest portion of the lot with street
frontage is along Rainier Pass. There is about 122 feet of street frontage along Rainier

Pass. There is 160 square feet along Glacier Lane. The property is zoned R-1, single
family, as are all the homes surrounding the property. The lot was platted in 1959 and
the home was built in 1960.
Mr. Bolin stated that the builder constructed the home facing Glacier Lane and in line
with the other two homes along Glacier Lane. The petitioner's hardship states: "My
wife and I have lived in Fridley since 1970. At this time, we are both disabled. Our
problem is that we have no bathroom on the main floor and also the laundry room is two
flights of stairs down in the lower area of our home. It is very difficult under these
circumstances to propose additional replacement utility deck and provide us with a
bathroom and laundry room on the main floor."
Mr. Bolin stated the petitioner desires to put a small addition on behind the corner of the
garage that wouid not encroach any further than the garage already does. Staff has no
recommendation as similar variances have been granted in the past. Variance #99-20
at 1561 Rice Creek Road had the rear yard setback reduced to 10.5 feet. Many
neighbors are in support of this expansion.
Ms. Jackson asked if the closest neighbor to the west sent a letter in support.
Mr. Bolin stated that he believes that neighbor had.
Mr. Molinari, 1420 Giacier Lane, stated that the two neighbors directly involved to the
west and south both submitted letters in support. He stated It was interesting to find out
that they are living in the back yard of their property.
MOTION by Ms. Jackson, seconded by Mr. Jones, to close the public hearing.

Ms. Jackson stated that since they are not changing the footprint of the building and the
neighbors to the west do not object, she sees no reason not to approve it. --
Mr. Kuechle stated that this is one of those unique situations where the code has to
legally define what is front and back yard. In this case, anyone would say it is the side
yard, but legally it is not. He would recommend approval.
Mr. Jones concurred.

#00-28 with two stipulations:

MOTION by Ms. Jackson, seconded by Mr. Jones, to approve the September 27, 2000
Appeals Commission meeting minutes as presented.

Mr. Kuechle stated that the hearings would be reversed in order.
PUBLIC HEARING: VARIANCE REQUEST. VAR #00-28. BY NEDEGAARD
CUSTOM HOMES:
Per Section 205.07.04.D.(3) of the Fridley Zoning code, to reduce the rear yard
setback from 39 feet to 11 feet to allow the construction of an addition on Lot 3,
Block 4, Innsbruck 151 Addition, generally located at 1420 Glacier Lane.
MOTION by Ms. Jackson, seconded by Mr. Jones, to waive the reading and open the
public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:32 P.M.
Mr. Bolin stated that the property owner, Don Molinari, is at the meeting. Mr. Molinari
would like to reduce the required rear yard setback from 39 feet to 11 feet to recognize
an existing nonconformity. The corner of the existing attached garage is only 11 feet
from what the zoning code defines as the rear yard. Zoning code requires a rear yard
setback of 25°/a of lot depth which is 39 feet. The narrowest portion of the lot with street
frontage is along Rainier Pass. There is about 122 feet of street frontage along Rainier

Pass. There is 160 square feet along Glacier Lane. The property is zoned R-1, single
family, as are all the homes surrounding the property. The lot was platted in 1959 and
the home was built in 1960.
Mr. Bolin stated that the builder constructed the home facing Glacier Lane and in line
with the other two homes along Glacier Lane. The petitioner's hardship states: "My
wife and I have lived in Fridley since 1970. At this time, we are both disabled. Our
problem is that we have no bathroom on the main floor and also the laundry room is two
flights of stairs down in the lower area of our home. It is very difficult under these
circumstances to propose additional replacement utility deck and provide us with a
bathroom and laundry room on the main floor."
Mr. Bolin stated the petitioner desires to put a small addition on behind the comer of the
garage that would not encroach any further than the garage already does. Staff has no
recommendation as similar variances have been granted in the past. Variance #99-20
at 1561 Rice Creek Road had the rear yard setback reduced to 10.5 feet. Many
neighbors are in support of this expansion.
Ms. Jackson asked if the closest neighbor to the west sent a letter in support.
Mr. Bolin stated that he believes that neighbor had.
Mr, Molinari, 1420 Glacier Lane, stated that the two neighbors directly involved to the
west and south both submitted letters in support. He stated It was interesting to find out
that they are living in the back yard of their property.
MOTION by Ms. Jackson, seconded by Mr. Jones, to close the public hearing.

Ms. Jackson stated that since they are not changing the footprint of the building and the
neighbors to the west do not object, she sees no reason not to approve it.
Mr. Kuechle stated that this is one of those unique situations where the code has to
legally define what is front and back yard. In this case, anyone would say it is the side
yard, but legally it is not. He would recommend approval.
Mr. Jones concurred.
MOTION by Mr. Jones, seconded by Mr. Jackson, to approve Variance Request, VAR
#00-28 with two stipulations:
The petitioner shall obtain all necessary building permits prior to the
construction of any additions.
Any additions shall be architecturally compatible with the existing home.

home were built in 1968. The property is zo ed R-1, single family, as are all the
surrounding properties. The petitioner's har hip states: "1508 Windemere Drive was
built in 1968 and the garage was placed 1.3 f et too close to the street."
Mr. Bolin stated that it is hard to tell that the ga ge is nonconforming. Staff has no
recommendation as similar variances have bee granted in the past. The front yard
was reduced to 31 feet at 369 Hugo Street (VA #00-23), and to 32 feet at 191
Hartman Circle (VAR #Oo-18).
