The fence appears to be flush with the front/north side of your hane, running east to meet East River Road. There are no pezmits reguired for the construction of a residPntial fence and the City of Fridley has no objections to the materials used to oonstruct the fence. R9�e City Code does, however, impose sane restrictions and limitations on the height of a fence within a certain distance from a public rightrof-way. 7his is of �rticular c�ncern on corner lots such as youzs. The Code states that ro fence shall be c�structed � wrner lots such that it shall impede vehicular vision or cause a hazardous condition to exist. It appears that if your fence is wnstructed to wheze the most easterly post is now set, it will obstruct the public right-of-way, impede the vehicular vision, create a hazardous wndition, and, therefore, not comply with the Fridley City Code. The City is requesting that you complete the fence to the second most easterly post, or the second westerly post from Fast River Road. Compliance with this request will result in the completion of a safe and legal fence. A reinspection will be conducted on or about May 26, 1988. The purpose of this letter is to confirm the information discussed at that meeting. The following areas of concern were identified and discussed during the meeting: 1. �ompletion of Acauisition - Mr. O'Srien indicated that he was unaware that his offer had been officially accepted, and that the County should not conduct any work on this site until the acquisition is final. You stated that the offer was officially accepted on December 2, 1991, and that the County was in the process of clearing the sale with the mortgage holder. Although such action requires additional time, it allows the County to issue a check directly to Mr. O'Brien, rather than requiring the mortgage holder's signature. (In the latter case, the money is often applied directly to the principal, whether or not this is desired.j F'ence Relocation - The relocation of the fence could create a vision safety problem at the intersection of East River Road and Chesney Way. i stated that, at the time the roadway is expanded, no fencing can exceed 30 inches above the curb line in the vision safety zone. (See enclosed definition of vision safety zone for further clarification of this area.) I under- stand that the intended plan is to relocate the fence at six feet in height just inside the new right-of-way line and connect it with the existing fence along Chesney Way. Mike Kelly January 7, 1992 Page 2 Although this is acceptable at the present time, it will create a vision safety problem when the expansion project has been completed. Therefore, I agreed that the fence could be relocated as planned, provided that Mr. O'Brien agrees to reduce all fences in the vision safety zone to no more than 30 inches in heiqht (East River Road and Chesney Way sides) upon widening of the roadway. 3. Gradina - Mr. O'Brien indicated that this project will create a drainage problem on his property and, in addition, the planned fence relocation will put the fence at a very low point, reducing its effectiveness as a sight and noise barrier. Therefore, Mr. O�Brien contended that the area near the planned fence relocation should be graded. You replied that a drainage problem already exists on this property and that the County is not responsible for correcting pre-existing drainage problems. However, you added that the County would be taking a further look at this site and, depending upon their findings, it may be necessary to provide grading and relocate the fence a second time, it was agreed that this issue would be put "on hold" until the County studies the site further. As a representative of the City of Fridley, my purpose in co- ordinating this meeting was primarily to facilitate a process to resolve these issues. However, with respect to achieving adequate vision safety at the "new intersection" of East River Road and Chesney Way, I must remind you that it is imperative to the City that you understand that relocation of the fence at the planned height must be temporary'. Mr. O'Brien is responsible for reducing all fencing in the vision safety zone to 30 inches or less when the roadway is expanded.
