Notice is hereby given that the Appeals Commission of the City of
Fridley will conduct a Public Hearing at the Community Education
Center at 6085 Seventh Street N.E. on Tuesday, May 23, 1989, at
7:30 p.m. for the purpose of:
Consideration of a variance request, VAR #89-
O8, by Norman and Mary Herzog, pursuant to
Section 205.07.03.D(3)(a) of the Fridley City
Code to reduce the rear yard setback from 33
feet to 0 feet to allow the construction of a
porch addition on Lot 38, Revised Auditor's
Subdivision No. 77, the same being 115 Glen
Creek Road, Fridley, Minnesota, 55432.

Public purpose served by this requirement is to provide rear
yard space to be used for green areas which enhance the
neighborhood and provide adequate separation between
buildings.
STATED HARDSHIP:
"The arranqement of the house allows the north side to be the
only possible location for the proposed porch addition to
enjoy the outdoor environment. The garage is on the west,
bedrooms are on the east, and the south does not lend itself
to any construction. The house was built in 1956 when current
setbacks were not in existence. The porch addition would not
detract from the appearance. The area of setback affected
borders on an undeveloped creek bank. This bank is not in
the flood plain."
ADMZNISTRATIVE STAFF REVIEW:
Request
The petitioner, Norman Herzog, is proposing to construct an
enclosed porch with a deck onto his house located on a portion
of Lot 38 of Auditor's Subdivision No. 77, the same being 115
Glen Creek Road. The proposed 16 ft. x 13.6 ft. addition
would encroach into the rear yard setback, reducing it from
33 feet to 17 feet.
Site
The parcel is located on Glen Creek and is in an R-1 Single
Family Dwelling District. The parcel does not abut any street
right-of-ways, and the petitioner has an easement for access
to Glen Creek Road. The parcel is heavily vegetated with
deciduous and evergreen plant materials.
Analysis
The required rear yard setback as stated in the Code is 25%
of the lot depth with not less than 25 feet or more than 40
feet permitted (Section 205.07.03.D.(3)(a)). This setback has
been required since the adoption of the Code in 1955.

An analysis of the lot survey reveals that the house has been
placed 28 feet from the rear lot line, leading staff to
believe that in 1956 the minimum 25 feet was used as the
required rear yard setbacks. Staff calculated the rear yard
setback by adding the two sides, dividing by two, and takinq
25� of that, equalling 33 feet.
To make the above determination, staff looked at the placement
of the house and the access to Glen Creek. Since the access
and the house face the south, staff determined that the rear
yard was to the north.
The petitioner also has an easement for access to East River
Road to the east. If this easement had been used, the
proposed porch addition would have been in the side yard,
negating the need for a variance.
Structures to the rear are located across Glen Creek on lots
that are 300 feet deep. Because of this, the concern for
separation of buildings becomes moot. Adequate vegetation
also screens this rear yard.
Engineering has expressed a concern about erosion of the creek
bank during construction of the addition. The addition will
be constructed on piers on frost footings. Since a full
basement will not be used, disturbance of the topography
should be minimal. The petitioner should install silt fence
around the construction area to prevent erosion.
Recommendation
The location of the lot is unique in comparison to other
properties in the area. Because there is more than one
interpretation of the Code that applies to the lot, and
because there will be minimal impact onto adjacent properties,
staff recommends that the Appeals Commission approve VAR #$9-
08 to reduce the required rear yard setback from 33 feet to
17 feet.

Ms. McPherson stated the petitioner is proposing to construct a 16
ft. x 13.6 ft. enclosed porch with a deck onto his house. The
property is zoned R-1, Single Family Dwelling District and Glen
Creek passes to the north of the property. The property is
virtually landlocked. The petitioner has an easement for access
to Glen Creek Road.
Ms. McPherson stated staff is recommending the Appeals Commission
approve the variance due to several features:
1. As previously mentioned, the property does not abut any street
riqht-of-ways which makes the property essentially landlocked
except for an easement to the south between two lots to Glen
Creek Road.
In the "Stated Hardship", the petitioner stated that "the
house was built in 1956 when current setbacks were not in
existence." In reality, the Zoning Code was in existence in
1955. But, in looking at the placement of the house on the
original survey, it appears the house was placed 28 feet from
the rear lot line, leading staff to believe that in 1956 the
minimum 25 feet was used as the required rear yard setback.
Staff calculated the rear yard setback by adding the two
sides, dividing by two, and taking 25� of that, making the
rear yard setback actually 33 feet. Because the house and
the access face the south, staff determined that the rear yard
is to the north.
3. The parcel abuts Glen Creek. There is adequate separation
between the proposed addition and any buildings across the
Creek. There are a lot of evergreens and deciduous vegetation
on the property, so staff feels there is adequate separation
of the visual or physical intrusion onto adjacent properties.
Ms. McPherson stated the Enqineering Department has raised the
concern of the potential for erosion, and staff has suggested that
the petitioner use some silt fence to help prevent any erosion.
Ms. McPherson stated the petitioner will not be putting a full
basement under the porch. He will just be using frost footings so
the amount of soil to be disturbed would be as large an area as

needed to accommodate the diameter of the required footing. She
ctated that erosion vas a concern, Dut she did not feel it was a
larqe concern because there is no full basement, and they will not
be moving a lot of dirt. The Appeals Commission could add this as
a etipulation if they felt it was a concern.
Mr. Norman Herzog etated they desire to have a three season porch
so that they can enjoy the natural area and the Creek. The
propoaed location of the addition is the only spot on the house
vhere they can build a porch. To the west is the garage; the
bedrooms are on the east, and the front of the house (south) does
not lend itself to an addition.
Mr. Herzog 6tated that at this time of year, the houses across the
Creek can hardly be seen because of the veqetation. He stated the
unusual thinq about their lot is they do not own the property from
the bank down to the Creek. In a normal situation, they should own
the property down to the Creek. The owners of the properties two
Iots over do own the land down to the Creek.
Dr. Vos stated that in other words if the Herzoq's owned what they
should have, they would not need this variance.
Mr. Herzog stated Glen Creek is an undeveloped creek like Rice
Creek. He stated the land is completely flat where they intend to
build the porch, and he did not envision any kind of erosion
problem.

this is a unique piece of property. There is nothing behind the
Herzoq's except the Creek, and there is a deep embanl�ent going
down to the Creek with a lot of veqetation. She stated the houses
across the Creek cannot even be aeen at this time of year. There
was certainly lots of qreen Bpace, and she felt the granting of
this variance was certainly in keepinq with the spirit of the Code.
She would be in favor of approving the variance.
