DESCRIPTION OF REQUEST:
Anthony Mangan III, has requested a variance to change his garage door location from the
east face of his garage to the south face of his garage. A 5.5' variance will be required to
allow the driveway to access Glencoe Street.
STATED HARDSHIP:
Anoka County will be sxpandi�g East RixerRo�d adjacent to this site. The expansion will
eliminate this properties driveway access closer to EastRiver Road.
SUMMARY OF ISSUES:
Section 205.07.03.D.2(C).3, requires that any attached or unattached accessory building
which opens onto the side street shall be at least iwenty-five (25) feet from the property line of
a side street.
Public purpose served by this requirement is to assure visibility at street intersections by
allowing adequate sefback of structures. This Code Secfion also assures fhaf the site lines
and aesthetic environment of a neighborhood are not hampered by an accessory structure
that has been placed too close fo the street.
The Mangan residence and garage currently exist at this address. There will not be an
expansion of the garage in conjunction with this modification. However, the location of the
overhead door will change.
A residential comer lot typically is required to have a 35' front yard setback and a 17.5' side
yard setback on the street side. As constructed, the Mangan home has a 39' front yard
setback from the East River Road right-of-way line and a 17.5' setback from the Glencoe
Street right-of-way.
Recent approvais of similar requests include an approval of a variance to 19' for an accessory
structure at 8041 Riverview Terrace NE (1994), a variance to allow a reduction in the side yard
from 25' to 6° adjacent to an unimproved right-of-way, and a variance to allow an accessory
building to be constructed 10' from the right-of-way at 5980 5th Street (1996).

Anoka County Highway Engineers have prepared preliminary
Roadway improvement drawings for East River Road. Once
improved, the County seeks limited interruption of the
roadway beyond the expected interruptions at cross-streets.
Whenever possible, private drives will be rerouted. The
petitioners driveway is an example of this. Though the

The building permit for the house and garage on site was issued on June 1, 1976.
In November, 1997, Mr. Mangan requested a buiiding permit to reside his home. At
that time, the plan to move the garage door was discussed and the Building Secretary
alerted Mr. Mangan of the setback implications. Mr. Mangan then applied for the
variance necessary to relocate the garage door.

Per Section 205.07.03.D.(1) of the Fridley Zoning Code, to reduce the front yard
setback from 35 feet to 24 feet,
Per Section 205.07.03.D.2. (C).(3) of the Fridley Zoning Code, to reduce the side
yard setback on a comer lot from 25 feet to 19.5 feet;
To allow the existing garage to remain on Lots 6-9, B{ock H, Riverview Heights
Addition, the same being 499 Glencoe Street.
MOTION by Mr. Jones, seconded by Mr. Vos to waive the reading of the public hearing
notice and to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPENED A7 7:33P.M.
Mr. Hickok, Planning Coordinator, stated that Anthony Mangan has requested a 5.5'
variance to allow him to change his garage orientation by removing the existing east-
facing overhead door and to replace that door with a south-facing door. Hickok stated the
garage is 19.5' from the Glencoe right-of-way.
Mr. Hickak stated that Code Section 205.07.03.D.2( C).3 requires that an attached or
unattached accessory building, which opens onto the side street, shall be at least 25'
from the right-of-way line of a side street.
Mr. Hickok stated that the public purpose of this section of the Code is to allow adequate
setback of structures and to assure that the site iines and aesthetic environment of the
neighborhood are not hampered by a building that is too close to the street.
Mr. Hickok stated that the petitione�'s hardship was stated as: "Anoka Counry will be
expanding East River Road adjacent to our property's driveway access, near East River
Road."
Mr. Hickok stated that the public hearing notice and agenda identified an additional
variance consideration due to the reduced setback resulting ftom the County
Improvement.
Mr. Hickok stated a residential lot typicaliy is required to have a 35' front yard setback and
a 17.5' side yard setback (on the street side). As constructed, the Mangan Home has a
39' front yard setback from East River Road and a 17.5' setback from Glencoe Street.
Mr. Hickok stated, the garage on this home is set back an addftional 2' from the house,
making its deficiency 5.5', from the Code required 25'.
Mr. Hickok stated that recent approvals of similar requests include: a 6' variance at 8041
Riverview Terrace, a 15' variance at 5980 5"' Street, and a 24'-6" variance at 6601 Lucia
Lane.
Mr. Hickok stated that this request is within previously granted variances, therefore, staff
has no recommendation for the Commission.
Mr. Kuechle asked if the variance from 35' to 24' for the front yard was just eliminated
from discussion for now, or whether the request was being withdrawn.
Mr. Hickok responded that the request was withdrawn because at this point staff and the
homeowners are not sure what the final acquisition amount will be. Therefore, it is too
early to try to deal with that setback issue. Hickok continued by stating that there may be
a number of properties along East River Road in a similar situation. This Commission
may see a number of properties with substandard front yard setbacks, caused by the
roadway improvements, in the future. The Commission will need to deal with those
properties and issues when all the facts are known.
Anthony Mangan, 499 Glencoe Street NE, introduced himself to the Commission and
indicated that staff did a good job of pointing out the issues. He stated that although he
did not have anything to add, he would be glad to answer any questions that the
Commission may have.
Dr. Vos asked if Mr. Mangan understood what staff was saying about front yard and side
yard on this property.
Mr. Mangan stated that this is the first he realized that his front door is technically in his
side yard.
Ms. Beau{ieu stated that she did not have an issue with the request. She stated that this
is truly not as much a homeowner-initiated request as a County matter.
Commissioners Kuechie, Vos, and Jones concurred.
MOTION by Ms. Beaulieu, seconded by Mr. Jones, to recommend approvai of variance
request, VAR #98-Oi, to reduce the side yard setback on a comer lot from 25 to 19.5 feet
to allow the existing garage to remain on Lots 6-9, Block H, Riverview Heights Addition,
also known as 499 Glencoe Street NE.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED UNANIMOUSLY.
Mr. Hickok ted the Commission on a number of projects underway in the City of
Fridley.
