On July 2, 1991, Bob Clauson, Clyde Wiley, and I met Donna Matson
at 501 Glencoe Street to inapect the condition of tho hause for the
purpose of determining whather ft could be rehabefl for resale
purposes. Donna Btated t�at they pianned to spend $30,00o to
upgrade the atructure for re�ale.
our asse�sed value on the structure is currentiy $27,800 and
therefore the structure� if repaired, would have to conform to
today's building and zoning co8es.
To cox�piy, the converted qarage would have to be made into a garage
again and the size would have to be increa�ed to accomimodate two
cars (ceilinq ileiqht is less than the r�quired 7'6" for livinq
space). The house would have to be increased to a minimum of 1020
square feet. The slectrical, plwqbing, and heating systems would
have to be completely replaced. Tha structural framing of the roof
Would have to be removed and replace8: !Se floor joist framing
waz�id heve to be repaired; all the windows and exterior doors would
have to be replaced, and the interior finish completely redone.
Zn xy opinion it would he better to demolish the structure, remove
the debris, and either rebuild a nev home on the lot or move the
structure from the flood plain at 7899 Broad Avenue onto this lot.

It is hernby daclared to be the intention of the City that the
provisions of this Chspter ue reverable in accordance vith the
folloviag:

A. If any court of competent jurisdiction :hall adjudge any
provision of t his Chapter to be imralid, such �udpent shall not
affect any other provisions of this Chapter not specifically
included in said judgnent.
B. If any court of cospetent jurisdiction shall adjudge imalid
the application of any p=ovision of this Chapter to � partioular
property, building or othez structure, such �udgment ehall aot
affect the application of said proarision to any other property,
building or structure not cpecifically included in said judgnent.
DSES AND STRIICTORES
A. Any structure or use lawfully existing upoa the effective date
of this Chnpter say be coatinued after such date exeept as
hereinafter specified or as alloved under special diatrict
raquirements.
E. Nothing in this Chapter shall prevent the upgrading of a
nonconformfng structure to a safe condition vhen said atructure
is declared unsafe by the City, provided the necessary repairs
shall not constitute more thaa fifty parcent (SOi) of the fair
oarket value of such ctzucture.
C. iR►enever the nonconforming use of a structure is changed to
a use permitted in a uore reatricted district, such use ahall not
thereafter be changed to a use peraitted in a less restricted
district.
D. Whenevet a lawful aonconforming structure is danaged by fize,
flood, explosion, earthquake, tornado, riot, or act of God, it aay
be reaonstructed and used as befo=e if it ie seconstructed within

provisions of this Chapter.
E. Hhenever a lavful nonconfoming use of a structuze or lsnd is
abandoned for a period of twelve (12) oonths, any future use of
said strueture or land shall be in confoxnity vith the provisions
of this Chapter.
F. Atry nonconforaing use ahall not be �oved to another part of
the parcel of lsnd upon vhich the same vss eo�ucted at the time
of the adoption of this Chapter.
� G. Any stzucture vhich rill under this Chapter become
nonconfotning but fo= vhioh a building per�it has been lav£ully
granted prior to the effective date of thls Chapter or of
asenduents thereto, �ay be conpleted in accordance vith the
approved plans: pzovided coastruction is staxted rithin six (6)

months of the effective date of this Chapter or amendmants thereof
and continuea to completion within two (2) years. Such structure
shall thereafter be a lagal nonconforming structure.
H. Normal oaintenance of a building or other structure containing
or related to a lawful noneonforming use is permitted, including
nacessary aonstructural repairs and incidental alterations which
do not extend or intensify the noaconforuing use.
I. Alterations nay be ■ade to a building containing lawful
nonconforming residential units ivhen they will improve the
livability thereof, provided they vill not tncrease the number of
dwelling units or aize of the building.
J. The provisions herein for the continuance of nonconforming uses
shall not prevent or intnrfere vith action that may be taken to
abate any nuisance in any manner provided by law.
K. Any structure or any portion of a structure which is situated
unlawfully within a public street or alley or other public way or
thoroughfare, is hereby declared to be a nonconforming use,
vhether oz not its use is othexvise in conformity with the
regulations of the district in vhich said structure is located.
Any such structure shall be subject to any and all applicable
regulations herein for nonconforaing uses except in the event the
City Council shall requite removal of the structure o= portion
thereof for a public purpose in which case auch requirement shall
prevaiL
L. The provicions of this Chapter shall pertain to all lawful
nonconforning uses or structures as applicable and specifically
to the performance standards outlined in the established
districts.
4. BIIILDINC SITE
A. No lot ehall be so reduced or diminished, nor ehall any
structure be so enlarged or moved, as to reduce or diminish the
yards, lot area or open space required in the district in which
it 1s located. No yard or other open space required for any
building shall be considered as providing a yard or open space for
any other building, and no yard or open epace on an adjoining lot
or parcel of property shall be considered as providing a yard or
open space on a lot where a building is to be erected.
B. Only one (1) principal building shall be located on a
buildable R-1 lot.
C. L�rery lot, in order to be built on, shall have at least one
(1) lot line which abuts for not less than twenty-five (25) feet
along a street or along a permanent, unobstructed easement of
access to the lot from a public street as approved by the City.
D. Where no curb elevation has been established, the City shall
furnish such elevations. If curb elevations are not available,
the City shall approve the elevation of the building and the
drsinage plan before a building pezmit is issued.

This letter is to notify you of a water well in your district that should
be sealed according to the Water Well Construction Code MCAR 44725.2500-29D0.
E.H. RfNNER 8 SONS, INC has been notified by the owner of this property or
an interested party and have subsequently submitted to them an estimate for
the sealing of tfiis well under our LICENSE �71015. We have also included
a copy of the current code with our estimate.
In submitting our estimate, the owner may also receive additional estimates
and hire any number of Minnesota licensed water well contractors in the area
to sea] this well. However, there is a possibility that this well may not
be properly sealed and thus jeopardize the ground water and Public Health.
