NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City ot Fridley
wi11 meet in the Council Chember of the City Hall at 7:30 P,M. on 1�esday,
Jaxruary 30, 1973 to conaider the following matter:
A request for a variance of Section 45.053, 1B,
to reduce the minimum required lot area for a
lot in a plat recorded before December 29, 1955
from 7500 square feet to 5500 square feet to
a11ow the construction of a dwelling on Lots57 '
and 5g Block I, Riverview Heights Addition, the
same heing 520 Glencos Street N.E., Fridley,

Mr. Gordon Drake was present to present his requests. Mr. Drake explained the sizes
of each prospective 1ot; those north of Glencoe were to be 62� feet each and those
south of Glencoe were 50 foot lots. Mr. Drake further explained that the homes were
ramblers laid lengthwise on the loC and that each house placement would meeY all
zoning requirements.
Mrs. Wahl6erg asked where a garage would be located. Mr, Drake indicated a driveway
along the side of the house with a garage in the rear yard, to be built later if the
owner desired.
Mr. Crowder asked if Mr. Drake felt the cost would be prohibitive to purchase
additional lots abutting the present 1ots. Mr. Drake replied that the 50 foot lots
abutting the Qroperty were being sold at the cosC of an independent building site
and consequently would put the homes out of range of other homes in the area. These
homes were to be at the top of the price range in this area, $24,000 -$25,OOD.
Mr. Crowder moved to close the public hearing. Seconded by Mrs. Wahlberg, upon a
voice vote, there being no nays, the motion carried.
I�TION by Crowder to recommend to Council approval of a11 four requests by Mr. Drake,
for variances of the square footage requirements on Lots 15 and 16, B1ock H, Riverview
Heights Addition, Lots 14, 13, and the West 2 of 12, B1ock H, Riverview Heights
Addition, Lots 57.and 58, Block I, Riverview Heights Addition, and Lots 55 and Su,
Block I, Riverview Heights Addition.

Seconded by Wahlberg. Upon a voice vote, there being no nays, the motion carried.
Chairman Minish referred back to item �1 as Mr. DeGardner had arrived.
Mr. DeGardner explained that a building was presently on the site, and this
building would be razed and a home built in its place.
A discussion followed in regard to the likel�hood of future floods in this axea.
Chairman Minish reminded Mr, DeGardner that this area was part of that being
considered for flood plain zoning.
Mr. DeGardner replied that he realized this, but he lives in the area and cannot
see where there would be a problem since the road was raised.
MY. Cxowder asked if he would consider waiting until the flood plain question is
settled.
Mr. DeGardner indicated a desire to begin i�nediately and would like action this
evening.
Mr. Minish was concexned about the welfare of the prospective owner in that he
be informed of the location of the house in relation to Yhe 1965 flood and the
flood plain.

Mayor Liebi asked what price range this home would be. Mr. DeGardner said
it would be approximately $28,000.
Mayor Lieb} asked Councilman Nee if he had any comments as this was within

proposal to be accompanied by a site ptan and waiver. He said he believed
it very unfortunate that the house on the south side of this has an im-
proper profile. _. _ .
MOTION by Councilman Nee to approve the variance with all future proposals
submitted to the'Council for approval accompanied by a site plan of the
structure.
The �ity Engineer said this information is always present if the Council-
men wish to see it. Councilman Nee said the building mentioned takes up
80% of the iot. The C�ty Engineer said as these are all smatl lots in
this area, they will all look a litt}e crowded:
-SEGONDED by Councilmah Utter. Upon a voice vote, all voting aye, Mayor
Liebl declared the motion carried unanimously. -
Mayor Liebl asked the City Attorney if it had 6eert the practice oF the City
to obtain a letter waiving the City's responsibility as it pertains to
floodin9? The City Attorney said he did not recall such a practice. The
City Attorney said a better protection would be to not allow an individual
to build at too low an elevation. The City Attorney asked the City Engineer
if there were any stipulations to this effect in the zoning Ordinance. He
said they did at one time request such a letter when a permit to build a
garage was issued, but he added, all buildings in the area should be built
in accordance �iith the flood plain zoning regulations.
MOTION by Councilman Nee to restrict buiidin9 in proposed flood plain
areas to those conditions set by the new standards, Seconded by Councilman
Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the
motion carried unanimously.
MOTION by Councilman Nee to approve the variance. Seconded by Councilman
Utter. Upon a voice vote, all voting aye, Mayor Liebl declared the motion
carried unanimousiy.
