Garage now located at 3534 Maxshall, Minneapolis, proposed to be
moved to 685 Giencoe Street, Fridley. The framework is all 16" O.C.
and in excellant condition. The fireplace will not be moved. There
is a centex partition dividing the building into the garage and workshop.

MOTION by To to approve the minutes of the May 21, 1970 meeting as written.
Secon by White. Upon a voice vote, all voting aye, the motion carried
una mously.
Mrs. Schack was present to presenY the request.
It was stated that the building was in excellent condition and that all
previous appeals for variances had been granted. A frost footing will be
put in because the garage will be treated as an attached garage. It was
also brought out that the Board would not want to see the garage sit too
long without any siding. Mrs. Schack was informed that the structure had
to be brought up to meet all City codes and she agreed that this would be
done.
MOTION by Tonco to recommend approval of the moving permit to move the
garage into Fridley subjecE to the following stipulatioas:
1. Ninety days from the time the permit is issued they must side the garage
with the similar siding that they will have on their new home.
2. A frost footing under the garage will be necessary because the Boaid
feels that the garage will eventually be attached to the home.
3. All electrical and mechanical aspects af this structure must be brought
up to meet City codes.
Secoaded by White. Upon a voice vote, all voting aye, the motion carried
unanimously.

REGULAR COUNCIL MEETING OF JUNE 15, 1970

MOTION by Councilman Liebl, in an attempt to meet the applicant half ay, to
bring this back at the next regular Council Meeting of July 6, 197 . Applicant
to present a plan which incorporates the original plan and his p n to try to
reach a compromise satisfactory to both the applicant and the uncil.
Mr. Bmthen asked if there was anyone he could work with to guide him in what the
Council would find acceptable. Councilman Liebl suggeste that he could meet
with the City Engineer. Mayor Kirkham commented that h did not feel that the
City Engineer should be put in the position of a cons tant. Mr. Srothen said
that he need not be a consultant, but rather just po' t out any suggestions that
would meet with the Council approval.
COUNCIIkIAI� HARRIS ARRIVED AT 8:35 P.M.
Mayor Kirkham explained the motion before t table and Mr. Brothen outlined the
reasons that prompted his actions to Counc' man Harris.
Councilman Harris said that he had look at his neighbors property and they seem
to be doing a reasonably good job. H said that he was up in that area and was
appalled at what Mr. Brothen is sugg ting. He felt that crushed rock is suitable
for driveways, but not for an enti front yard. xe said that his business takes
him to other business enterprises and he has yet to see an all crushed zock front
yard. He said that it appeared at Mr. Brothen did as he pleased.
THE MOTZON was seconded by Co cilman Breider. Upon a voice vote, Liebl and
Breider voting aye, Harris, heridan and Kirkham voting nay, Mayor Kirkham declared
'the motion FAILED.
Mr.. Brothen asked if th e was any further appeal. The acting City Attorney
(Mr. Wyman Smith in th absence of Leonard Juster) said that the Council has
jurisdiction over bu' ding permits, and it would be a legislative matter to
determine if the Co cil had acted arbitrarily or capxiciously. In this
instance, they are only insisting on what was agreed upon by both parties_

MOTION by C uncilman Harris to adopt Ordinance #459 on second reading, waive the
reading order publication. Seconded by Councilman Sheridan. Upon a roll
call vot , Breider, Sheridan, Kirkham, Liebl, and Harris voting aye, Mayor
Kir declared the motion carried unanimously.

The City Engineer said that �is request is for moving a garage onto their
property and the Building Board recommended approval with some stipulations.
Nlr�. Schack said that her husband will be buildinq their house and the plans have
already been approved. She said that the reason the garage has no siding now
was that they wanted to wait until thoY c4�ld eide it witY� thg Same siding as tkl�

house. The City Engineer asked if the house would be done this year. Mrs.
Schack said that she was not sure. The Building Board said that they would
give her 90 days to side the garage. Councilman Sheridan asked if the garage
would be used in any way as living quarters and Mrs. Schack replied no.
Councilman Liebl asked if she was agreeable. to the stipulations and she replied
that she was. Councilman Liebl asked if there were any objections and she said
no, there were not. Councilman Breider asked if the Building Board had seen
the plans for the house and Mrs. Schack said that they had.
MOTION by Councilman Sreider to concur with the Building Standards - Design
Control Subcommittee and grant the request for Mrs. Schack to move a garage,
subject to their stipulations. Seconded by Councilman Liebl. Upon a voice
vote, all votinq aye, Mayor Kirkham declared the motion carried unanimously.

City Engineer handed the Council a list of the work canpleted to date and a
�of Estimate #10.
MOTION b Councilman Liebl to authorize payment of Estimate #10 in the amount
of $6,044. , payable to D.M. Noyes Construction Company and their bonding company.
Seconded by uncilman Breider. Upon a voice vote, all voting aye, Mayor
Kirkham declar the motion carried unanimously.

Councilman Breider said hat it seemed that at the hearing, the majority of the
people did not favor the ditional storm sewer system being installed. He
felt that as has been done i the past, the prevailing petition should guide the
Council's decision. He pointe out that the City Engineer has stated that the
drainage as originally engineere would drain the water, and the low spot would
be taken care of.
The City Engineer said that they would e receiving a minimal slope to the street
and the water would eventually drain int the southeast corner.
Councilman Liebl pointed out that first there as a petition far an additional
storm sewer system as some of the people felt t the additional cost would be
money well spent. Then the Council received a pe 'tion against any additional
storm sewer drainage system because these people fe that the plan as presented
by the Engineering Department would take care of the w er. He said that the vote �
showed that 13 people favored no additional system and 8 vored the increased
system. He thought that about 40i of the people were prese from the area.
xe recalled that there was a 78 difference in cost, and the c t without the �
increase would be about $12.50 per foot. �
Councilman Breider said that to his way of thinking, graded properly e problem
would be taken care of. Councilman Liebl said that it was a problem of ether
the people would be assessed $12.50 per foot of $13.50 per foot. He point out
that for Horizon Drive the City Engineer advised that there should be sane
additional storm sewer work and he was very glad that it was done.
MOTION by Councilman Sreider to reaffirm the Council position on the improvement
of Hartrnan Circle and put in the street as originally engineered. Seconded by
Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried unanimously.

BUILDING PERMIT FEE SCHEDULE
SECTION 2. The Inspector of Buildings sha11, before issuing permits for the
erection of any building or structure, or for any addition to any eacisting
building or structure, or for any alteration or repairs to any existing
building or structure, upon application theretore, require the payment by the
applicant for such permit of fees to the amount herein below set forth and in
the manner herein pravided to-wit:
UPiIFORM BUILDING CODE: Type 1, 2& 4-$2.15 for each one thousand cubic
feet, or fraction thereof, in such cubical contents. Type 3& 5-$1.85 for
each one thousand cubic feet.
ADDITIONAL INFORMATION
For the purpose of computing fees for building permits, the cubical contents
of any building or addition, is determined by multiplying the ground area
covered fxom a point six (6) inches below the floor line of the basement
or the cellar to the average heights of the upper surface or to the average�
height of the roof surface of the main gable of a pitched roof.
For repairs or alterations to an existing stzucture, the fee shali be at the
rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in
the cost of all proposed work.
In no case shall the fee charged for any permit as set forth in Section 2 be
less than $5.00.
VERIFICATION OF FOUNDATION
NOTE: Pexmits for construction wi11 be issued a miniffiun of 24 houra from the
time of application, to allaw for proper review of the proposed stxucture and
of the construction site.
A Certitied Survey of the lot, showing the location of the foundation, once it
has been constructed, will be required before roceedin with the framing.
CHRTIFICATE OF OCCUPANCY
Application for a Certificate of Occupancy shall be mad� ten (10) days prior
to the use or occupancy of any structure for which a building pexmit has been
issued; and said etructure shall not be used or occupied until a Certificate
of Occupancy has been issued. -

Dear Ms. Schack:
In 1997, the Ciry Council adopted an ordinance declaring gravel driveways a public nuisance.
They were declared a public nuisance for a number of reasons, such as: they can cause
erosion, contaminate soil with oil and other vehicles fluids, and deposit soil and gravel in the
City's storm sewers and detention ponds. When gravel driveways were declared a public
nuisance, the City Council gave property owners five years to have their gravel driveways
paved. The five-year deadline is quickly approaching, which means all gravel driveways within
the City of Fridley must be paved with approved concrete or asphalt by December 31, 2002.
If on December 31, 2002, your driveway hasn't been paved a citation will be issued and filed at
the Anoka County Courthouse. A misdemeanor citation is a criminal offense and is punishable
by up to 90 days in jail and/or a$700 fine.
If you've already paved your driveways, Thank you! Please call me at 763-572-3595, so I can
update our files.
For your convenience, a brochure on the City's foan program has been enclosed. You can use
this loan program to acquire financing for your driveway improvement project. Please call Jim
Hesnik at 612-335-2651, ff you have any questions regarding this program.
