We met with Mr. Duare Fleten on Friday, 1►'grch 20, 1987 at 10
a.m. to diswss the malification of his existing garage, the
renaval o� his e�d.sting driveway and v�nstruction of a new
driveway and aaoess to 8athaway Lane.
Based upon Mr. Fleten's request and tbe driveway
o�nstruction, we agreed to remave an existing Oak tree to
the rear of his c$rage and install a cnncrete sidewal k f ram
his hame to the garage when the driveway is renoved. We
also cliscussed the ite�ns that he will negotiate with a
private contractor to accompl ieh the garage door
modif ication.
Sane eeparate it�ems that evolved clealt with (1) relocating
the e�dsting NSP servioe pole at the rear of ttie property=
(2) aonsicleration for vaaating the e�ocess right-of-way and
combaining Mr. Fleten's property= and (3) placing the NSP
distribution li�e tnc]ergrotnd along Old Central.
�e City staff will 000rc]inate with NSP to relocate the
servive pole and attempt to schedule the installation of
uzc3ergrotmd distribution in mrrj tnction with the impcavenent
project. We als� advised 1�lr. Fleten to initiate a request
for the e�ocess property vacation, if he s� desires.
Based upon this meeting, Daqe Pillatzke,

agree on what is to be acoompl ished and a tentative time

SUBJECT: 5755 Central Avenue N.E.
An inspection was made on the detached 20' x 22' garage at 5755
Central Avenue N.E. The garage is about 30 years old. It is not
dangerous but is in need of some maintenance.
,1. The roof shingles are old and need to be replaced.
,�2. The facia and soffit should be replaced.
3. The visible rafter tails are rotting.
4. The 2" x 4" rafters are overspanned.
5. The bottom plates are starting to rot.
6. The slab has one major crack.
7. The entire structure needs paint.
The back of the garage has 3 courses of block, therefore to
relocate the overhead door from the front to the back would mean
the whole wall would have to be replaced.

This is to update you on the status of the project to change the
location of your driveway entrance.
The HRA has approved payment to you in the amount of $2,475.00 for
the reconstruction of your garage. Additionally, they have
authorized granting you the excess property to the south, after the
new intersection is completed, in exchange for your agreement to
maintain the property. If you are going to build a new garage and
extend it to the south, it appears that the HRA will immediately

Attached is a Warranty Deed transferring a portion of the property
obtained for the reconfiguration of the intersection of the Old
Central/Hathaway intersection. Conveyance of the indicated excess
property at this time will allow Mr. Flaten to rebuild his garage
without obtaining a variance, will negate the need to grant an
easement for the new driveway and relieve the HRA of the obligation
to maintain this portion of the property.
Recommend that the HRA convey the indicated property to Mr. Flaten
at this time.

Reconstruction of Driveway at
5755 Central Avenue
To update you on the progress of the Flaten Project, I will provide
the following:
Mr. Flaten has received a building permit for the changes to his
garage and is approximately 75 percent completed with the changes.
Concrete work (install new curbcut on Hackmann Avenue, remove and
replace existing curbcut, new sidewalk) are being completed under
the 1989 Miscellaneous Cancrete Curb, Gutter and Sidewalk Project.
The new curbcut is already in place. The placement of the existing
curbcut will probably take place next spring. Our estimate for the
cost of the concrete work is $560.00.
We have solicited bids for the construction of the new driveway
(including tree removal), removal of the existing driveways and
sodding the disturbed areas. The low bid is $2,450.00. This work,
with the possible exception of the sodding, will be completed
within the next week.

Reconstruction of Driveway at 5755 Central Avenue
The property owner at 5755 Central Avenue, Mr. Duane Flaten, has
essentially completed the retro-fit of his garage and should have
final building inspection this week.
Work had begun on the construction of the new driveway that will
access Hackmann Avenue, but was not completed due to weather. The
new curb cut, and gravel base for the driveway were installed and
are being used by Mr. Flaten. The asphalt paving of the new
driveway, removal of the old driveway and sodding will be completed
next spring. Mr. Flaten has indicated that this schedule is
acceptable.
Recommend the HRA issue payment to Mr. Flaten in the amount of
$2,475.00 for the reconstruction of his garage and that a partial
payment of $800.00 be made to W.B. Miller, Inc., for the completed
portion of the driveway reconstruction.

Dear Mr. Flaten:
The City of Fridley has established a City Code for the purpose of
promoting a pleasant and attractive suburban environment. A recent
inspection of the property at 5755 Central Avenue N.E. revealed
that not all Code requirements are presently being met. Listed
below is an item which does not comply with the City Code:
1. Discontinue outside storage of brush on south side of
property.
2. Recent3y, I received inforanation suggesting that vehicles are
sometimes parked on the grass on the south side of the
property. Please be advised that the Fridley City Code
requires that all vehicles kept outside must be on a hard
surface parking area.
Your prompt attention in correcting this situation would greatly
assist us in helping �ake Fridley a better place to live. An
inspection will be conducted on or about June 17, 1991, to
determine compliance.

At the Council meeting of Rp�il 19, 1993, Councilman Schneider raised an issue regarding
complaint from Duane R. Flaten, 5750 Hackrr�ann Avenue, who was involved in HRA's acquisition
of the property on the comer of Old Central and Hathaway Lane for future roadway
improvements.
Mr. Flaten received a cash payment of $2,475 plus a new driveway, sidewalk and additional
property with the understanding that he wouid maintain the boulevard between the property lines
and the curb of the existing adjoining streets. This was executed through an agreement dated
October 18, 1989.
