A pcoperty aaner maY appeal the strict application of the
provisions of this Chapter where thete are pLactical

application of the regulations of this Chapter. An
application for a variance shall be filed with the City and
shall state the exceptional oonditians and the Peculiar and
practical difficulties claimed as a basis for a vatiance.

within thirty (30) days after filing an appeal ftom an

fran City Code provisions the Appeals Commission shall hold a
Fublic hearing thereon and shall hear such persons as want to be
heard. Notice of such hearin9 shall be mailed not less than ten
(10) days before the d3te of hearing to the person or persons
M•ho file the appeals, and to all adjaoent property owners within
a 200 foot distance of the requested vaciance location. Within
a reasonable time, after the hearing, the Appeals Commission
shall make its recommendntions or aFprovals subject to
conditions of the Fridley City Code and forward a copy of such
zecorrar,endation or approval to the City Council through the
Planning Cor.¢cdssion.
D. Varianoes In R-1 2oning.
(1) In areas zoned R-1 (One Fasr,ily Dwelling District), the
Appeals Ca�eiission has the authority to gcant final apprwal
of variances when all of the follaring ooaditions aze met:
(a) There is unanimous agreement of the Appeals
Conmission.
(b) The staff concurs with the reoonanenaations of the
Appeals Commission.
(c) The genezal public attending the meeting or
responding to the notice of public hearing have no
objection.
(d) The petitioner is in agreement with the
rf ndation.

(2) h'hen the above conditions are not met, the variance
request must be reviewed by the Planning Commission with
final a�.proval by the City Cowcil.
E. Reoord Of Action Taken.
4he Appeals Crnmission shall prwide for a wtitten record of its
proceedings which shall include the mSnut�s of its meeting, its
finoings an6 the reoommendation or apprwal of each matter heard
b� it. The finding of fact shall contain the fallowing:
(1) The public polii,y which is served b� tequirenent.
(2y The practical difficulties or unique circumstance of
the property that canse undue hardship in the strict
application of the requirenent.
(3) In reoaimnending or apprwing a variance. the Camnission
ano%r Coimcil may impose o�nditions to ensure compliance
and to protect adjacent properties.
F. Action By Zt,e City Co�cil.
�he Co�mcil shall at its next regular meeting, after re^_eiving
the reoomnendation of the Appeals Commission, with a policy
revi� by the Planning Ccr,imission, decide on the action to be
taken.
G, Lapse Of Variance By Ncvt-ase•
If work as permitted by a'variance is not commenced within one
yeat and cos�plete3 within two years after granting of a
variance, then the variance shall beoane null and void unless a
Fetition for extensian of tirtie in which to ownplete the work has
been gzanted by the City Council. Such extension shall be
reo,uested in writing and filed with the City at least twenty
(20) days before the e�iration of the original variance. The
rca,uest for extension shall state facts showing a good faith
attempt to complete the work permitted in the variance. Such
petition shall be presented to the appropriate body for review
and/or decision.

The patitic�er pxesently has a two-car garage of tandan design; therefore,
staff interpreted that the newly appmved nrr�i nanpe amendment allvaing
single car garage expansi� into two car sidrb�side doum to 3 feet wuld
not be achninistered.
If the Board approves the request doan to 3 feet, the staff reca�mends
that the garage wall adjaoent to the side lot line be a one-hour fire-
resistant wall with m unprotected �nin9s•
Mr. Clark stated there was a similar situation almost across the street fran the
petitios�er's house where a single car garage {not a t.andem gaxage) was allaaed to
be expanded to a cbuble car garage without a variance under the critesia of the
new o�linance passed last year. The reason Sta£f felt they oould not handle this
request under the new ordinance was beaause it was really a two-ca�' garage, but with
a single width.

Mr. Clark stated the petitioner wanted to widen the garage to the south and west
up to 3 ft. fran the property line to make an 18'� ft. wide garage.
Mr. Clark stated that, as stated in the staff report, if the request was granted,
they should stipulate that the wall next to the lot li.ne be a fire-rated wall and
that there be m openings in that wall unless they were fire rated also.
Mr. Zverson, contractor for Mr. Skallet, stated the plan was to expand the whole
length of the tandem garage to 18'� ft. This was being done as �ch far aesthetics
as it was for space. He stated they will npt build in ariy way that would be offen-
sive. They will contirnie the sight lines and do it in accorda�e with all the
codes. The gazage with the e.�ansion would be a little over B00 sq. ft. He stated
they have no problem with the fire-rated wall.
Mr. Iverson stated Mr. Skallet has other things he wovld like to do with the house
with the space in the back in the future; however, thase plans were conti.ngent upon
whether or not he can expand to a two car side-by-side garage as opposed to the
tand�n he has nva. Vdien Mr. Skallet purchased the praperty about five years ago,
it was a tandem gaz'age at that time. The tandan 9arage was alric,�t far a family
with only one person working, but both Mr. S1ca11et and his wife work with vaxying
��s, so the single car width was a real hardship for than.
Mr. Harna asked abaut the possibility of a windaa in the back of the garage on
the southwest corner not adjacent to the ha�se a� the adjoining property because
that azea of the garage oould be pretty dark.
Mr, Barna stated if they want a windaa, theY oan Put in wir�glass. Iie stated if
windaa was put in the back of the garage that was nat firrrated, there was always
the possibility that the house next door might be exp�azided at some future time.
It was haxci to go back and chanqe tl�ings tl�n. It was better and cheaper to put
the fire-rated windaa in naa.
Mr. Clark stated that, again, he wanted to say that evexything about this request
met the criteria of the new ordinance, except that the garage was two-car deep.

ordinance, but in this situati�, tie wwld be fairly canfortable with omni.ng within
3 feet of the lot line.
Mr. Sherek stated that as far as the new x�equlranents of the new ozdinance for
expanding a single car garage to a doub7-e cas' 9as'age up to 3 ft. fran the proQerty
line, he felt this request was certainlY meeting the intent of that ordinance.
It was not quite a double qarage, but a tand�n garage certainly provided sufficient
haYdship that he thought the same rutes should apply.
Mr. Kuechle stated he agreed with Dr. Vos and Mr. Sherek.
