Dr. Vos stated the City Council w�l have to make that decision.
Mr. Pelstring stated he thought th Commission could now appreciate what they have
been through. They have had a n mber of conversations and appreciated the comments
in terms of recognition of the hards ip situation. He would be more than happy to sit
down with City staff and the City Co ncil to find out what options would work best for the
City and for them. They see a situa n where they cannof work with the existing
ordinance. He did not think a rooftop sign was adequate. He was not sure how that
helps the commission's discussion. ey will try to cooperate. They have laid out the
issues and the problems, and want to esolve it. They are concemed about negotiating
publicly and/or coming back with a se nd request.

Mr. Bolin stated the petitioner is requesting a variance to increase the allowable
encroachment into the rear yard setback from 10 feet to 14 feet 71/2 inches to allow the
continuance of an existing deck at 3869 Hackmann Avenue.
Mr. Bolin stated the code allows an encroachment of 10 feet into the rear yard setback f�P
the construction of an open deck. The property is located on a comer lot at the
intersection of Hackmann Avenue and Hackmann Circle. The property is zoned R-1,
Single Family. The properties to the.north are zoned R-1. To the east is a playground
zoned P, Public Facilities. To the south and vvest is also R-1, Single Family, zoning.
Mr. Bolin stated the home was built in 1958. There was an addition to the home built in
1966. That is all that is on file for zoning and land use actions.
Mr. Bolin stated the petitioner has indicated on the hardship statement that the deck was
professionally built and has been in place for flve years. Removing the deck would create
a financial hardship as well as decrease the aesthetics of the home.
Mr. Bolin stated the deck was built without a permit. The building inspector looked at the
deck in November. He stated the deck looke� as though it was well constructed;
however, he was not able to view the footings at that time.
Mr. Bolin stated similar requests have been granted in the past. Because the request is
within previously granted variances, staff has no recommendation.
Mr. Kuechle stated he was curious as to what triggered this request or to know why it is
here now.
Mr. Hickok stated the Ciiy recently undertook a project to survey all of the parks. As a
result of that, they have found some interesting things. In one case, they found a sa4ella��
dish installed off of the private property and in the park. In this particular case, it was a
chain link fence that had been installed into the park approximately 17 feet. In making �
determination as to how to solve that issue, st�ff recognized that the fence was not th�
only issue. There was a deck built without a permit that encroached into the setback.
Also in 1966, the addition to the house was constructed without a variance although $��

rear yard setback is deficient. That building addition did have a building permit however.
The deck is the issue which they are asking to rectify. The fence has been removed.
Dr. Vos stated that in looking at the site, the lot depth appears to be 100 feet. It must be
a square lot about 100 feet by 100 feet. The house is set back about 37 feet so they are
already iwo feet back. Then with the house, they could not put anything in the back yard.
They would have a 5-foot deck without encroaching.
Mr. Wolf stated he is probably responsible for the problem they are having at this time.
Dr. Vos identfied the problem that there are not many spots to build a deck and have a
deck you would like to spend some time on. He designed the deck. He is a mechanical
engineer and built the deck. He did not realize this needed to have a permit. There is a
unique history in that this lot had a row of trees back where the fence line is set 17 feet
into the park. Before they built the deck, there were many trees there. They had grown
up wild in the back. When they contacted the City at that time about getting some of
those trees removed, the City response was that those were the owners trees and they
could do with them what they wanted. The neighbors' fences were also set back. He did
not do a survey when he did the deck. It appeared that, if those were their trees, it was a
ways from the back of the lot. If you Iook at the site, there really was no other site to build
a deck that one could use.
Mr. Wolf stated the deck is well constructed. It is treated 2 x 10's on 16-inch centers with
9 footings on the deck. They are set down to frost level. The deck is constructed such
that to reduce it would make it unusable and would destroy it. Even though economics
are not considered a reason for a hardship, it would be a hardship for his daughter to
destroy that deck. It has been there for five years. The structure speaks for itself. It has
not settled or heaved in that time.
Mra Kuechle asked the petitioner how long they have owned the house.
Mr. Wolf stated the house was originally owned by his wife's sister who died �#0 10 yea�s
ago. They then purchased the house for their.daughter, Kelly. It has been in the family
for about 25 years.
Mr. Kuechle stated he is curious about how that fence got to be where it was.
Mr. Wolf stated that as an offshoot of that tree scenario, his daughter wanted to put up a
4-foot fence to keep the kids off the street.
Ms. Wolf stated she called the City when that was done and was told to follow the existing
posts. The City installed the fence on the park property and that has also been moved.
Mr. Wolf stated on the diagram is the diagonal fence which goes from Ms. Wolfs proper�
to the neighbors property and onto the park property to the fence fhat was put in by the
City. They put in their fence from th�t comer out to the street and dvhi�h encompassed

the trees which they thought were a part of the property. The fence has been taken
down. The ordinance was developed to protect the neighboring properties. The
neighboring property here is the park.
Ms. Ruwart stated she is a neighbor who came in to support the request. The deck is
very nice. The lot is very small. She thought it would be nice if the variance is approvedo

Ms. Mau stated she understood the hardship. There is not much the petitioner can do
�now that the deck is there. It would be a hardship to tear it down. It seems there was a
misunderstanding as to where the property line was. She can see how it could happen.
She would recommend approval.
Mr. Kuechle concurred. He thought building without a permit is inexcusable. Even if they
had applied for the permit, the deck probably would have ended up there anyway
because it would not have been considered an encroachment on the backyard setback.
Because the fence indicated that is where they thought the lot line was, they would have
been issued a permit until the Cit�r started looking at the parks and the boundaries. There
is no indication that the petitioner deliberately changed that. He would recommend
approval.
Dr. Vos stated he understands the petitioner's problem. He lives next to a park and he
does not know where the lot line is. He can understand how this could happen. He
visited the site and could not determine the location of the lot line. He would concur v�ith
the variance request.
Mr. Jones stated he drove by the s�te. His first reactio� was that he cou�ld not see a
problem. If this had come up for a permit, they likely would have looked at the fenc� line
and the lot line. If we had known where the lot line was, would we have given them a
variance? He would have voted to approve it. A 5-foot deck is not adequate. From th�$
standpoint, he agrees there should have been a building permit. He would vote in favor
of the request and would not make them take it down.

HARDSHIP STATEMENT
"An employee from the City of Fridley was out to my house and showed me where to
run my fence and gave me permission fo remove trees along that line because they
were `my' trees. Therefore the assumption was made that was the lot line.
Based upon that information we built the deck, knowing it was well within any possible
setback and we built it at the most logical location on the lot. The deck was built by
ourse/ves and didn't realize a permit was necessary if a builder was not involved.
1 have applied for a permit and would request your help in resolving this issue.
The deck is professionally built and has been in place for 5 years. It would create a
financia/ hardship as well as decrease the esthefics of the home.
The deck is on mu/tip/e concrete footings that are below the frost line, 48" deep and are
flared at the bottom. Because of the design, the deck could not be reduced in size
without destroying the entire deck The construction is primarily of cedar and
represents a substanfial investment that 1 cou/d not afford to /ose. � Kelly Wolf
ANALYSIS
Section 205.04.06.A.(3) allows a 10' encroachment into the rear yard setback for the
construction of open decks. The petitioner is requesting a variance to increase the
allowable encroachment into the rear yard setback from 10' to 14' 7'/2 ", thus
decreasing the rear yard open space 15' to 10' 4'/2" to allow the continuance of an
existing deck. .
Building Inspection staff inspected the deck on November 17, 1998 and noted that the
deck appeared to be well constructed. An "after the fact" building permit was issued for
the deck on November 13,1998.
RECOMMENDATIONS
City Staff has no recommendation due to the fact that this request is within a previously
granted dimension. Approved variances similar to this request include:
