Enclosed is your DNR permit 4�87-6302 which authorizes you to place
natural rock riprap as shore protection along the Mississippi River at
your property. Your original application for a permit was to
construct a retaining wall; however, consistent with your June 22,
1987 telephone conversation with John Stine of this office, we have
authorized the placement of riprap.
In order to ensure that the work is stable and well designed, the
permit contains several provisions regarding finished slope thickness
of rock, etc. If you have any questions, feel free to contact John
Stine of my staff. _

GENERAL PROVISIONS -
1. ihis permit is permissive only and shall not release the.permittee from any liability or obligation imposed
by Minnesota Statutes, Federal Lau or local ordinances relating thereto and shall remain in force subject to
al: conditions and limitations nou or hereafter imposed by law.
2. Th�.s permit is not assignable except with the written consent of the Commissioner of Natural Resources. �
3. Tha Regional Hydrolagist shall be notified at least five days in advance of the commencement of the aork authorized
he�eunder and shall be notified of its completion within five days thereafter. The notice of permit iss�ee
by the Commissioner shall be kept securely posted in a conspicuous place at the siEe of operations. -
4. No change shall be made, uithout written pera�ission previously obtained from the Commissioner of Natural Resources,
in the dimensions, capacity or location of any items of uork authorized hereunder.
5. The permittee shall grant access to the site at all reasonable times during and after construction to authorized
representatives of the Commissioner of Natural Resources for inspection of the work authorized hereunder. -
6. This Permit may be terminated by the Commissioner of Natural Resources at any time he dee�s it necessary for
the conservation of uater resources of the state, or in the interest of public health and welfare, or for violation
of any of the provisions of this permit, unless otheruise provided in the Special Provisions.
7. Construction uork authorized under this permit shall be completed on or before date specified above. Upon written
request to the Commissioner by the Permittee, stating the reason therefore, an extension of time may be obtair.ed.

The excavation of soiI authorized herein shall not be construed to include the removal of organic matter (as
indicated above) unless the_area from which such organic matter is removed, :s impervious, or :s sealed by
the application of bentonite after excavation.
In all cases where the doing by the permittee of anything authorized by this pErmit shall invoive the taking,
using, or damaging of any property rights or interests of any other person or persons, or of any publicly ouned
lands or improvements thereon or interests therein, the permittee, before proceeding therewith, shall obtain
tFe written consent of all persons, agencies, or authorities concerned, and shall acquire all property, rights
and interests necessary therefore.

A stop work order for construction of an accessory building was
issued on Friday, May 20, 1994 at approximately 22:45 p.m. The
location of the structure is immediately adjacent to the
Mississippi River bluffline. Section 205.25.S.C.(1) requires
that new structures and uses be placed not less than 40 feet from
the top of the bluffline overlooking the Mississippi River. You
have three options to correct this violation:
1. Move the structure to a location on the property in
conformance with the bluffline setback and other zoning code
requirements, and obtain a building permit if the foundation
exceeds 100 square feet of area.
2. Reactivate variance request, VAR #89-18. Enclosed is an
application. Complete and sign the application, attach
three full size copies and one copy of an 8 1/2" x 11" site
plan showing the location of the structure on the lot, and
an elevation plan depicting the exterior of the building and
its materials. An application fee of $60.00 is also
required. In order to be considered by the Appeals
Commission on June 7, 1994 and the City Council on July 11,
1994, you must submit these materials no later than 5:00
p.m. on Tuesday, May 24, 1994.
If you do not apply for the variance, the structure must be
removed from its current location by June 1, 1994 and conform to
option #1 or #2.
3. Remove the structure in its entirety from the property.
Upon placing the stop work order on the structure, it was
observed that the floor of the structure had been constructed.
