Notice is hereby given that the Appeals Commission of the City of
Fridley will conduct a Public Hearing at the Fridley Municipal
Center at 6431 University Avenue N.E. on Tuesday, September 5,
1989, at 7:30 p.m. for the purpose of:
C�nsideration of a variance request, VAR #89-
18, by Wayne Dahl:
1. Pursuant to Section 205.04.05.8.(2) of
the Fridley City Code to reduce the side
yard setback between an accessory
building and a side property line from 5
feet to 1 foot;
2. Pursuant to Section 205.07.02.B.(1) of
the Fridley City Code to increase the
allowable total floor area of an
accessory building from 1,400 sq. ft. to
1,670 sq. ft.;
3. �Pursuant to Section 205.04.05.B of the
Fridley City Code to allow the
construction of an accessory building in

A. PUBLIC PURPOSES SERVED BY REQUIREMENT:
•
'Section 205.04.05.B.(2) requires that accessory buildings and
structures in the side yards shall not be any closer than 5
feet to any lot line.
Public purpose served by this requirement is to provide space
between individual structures to reduce the possibilitji of
fire, to provide access to the rear yard for emergencies, and
to limit the condition of crowdinq in the residential
neighborhood.
Section 205.07.02.B.(1) requires a maximum allowable floor
area for an accessory building of 1,400 square feet.
Public purpose served by this requirement is to maintain the
residential quality of a neighborhood by limiting the size of
accessory structures.
Section 205.04.05.B requires that all accessory buildings
shall be constructed in the rear yard.
Public purpose served by this requirement is to preserve the
open space and maintain the 35 foot setback requirement which
preserves sight lines.
Section 205.04.06.A.(1) requires that fences or hedges be
maintained at a height of four feet in the front yard.
Public purpose served by this requirement is to preserve open
space and sight lines.
Section 205.25.08.C.(1) requires that all structures be
constructed 40 feet from the Mississippi River bluff line.
Public purpose served by this requirement is to protect the
natural feature of the bluff line and to reduce monetary loss
if the bluff line should fail and the structure is lost.
B. STATED HARDSHIP:
"Need additional storage since attached garaqe is
insufficient. Need reduction of setback to be able to build
sufficient size accessory building."

Dr. Wayne Dahl is proposing to build a 1,100 square foot accessory
building on his 1ot; Lot 20, Block 1, Sandhurst Addition, the same
being 177 Hartman Circle N.E. The proposed garage requires several
variances. In addition, the petitioner has applied for a vacation
of a drainage and utility easement along the lot line and a special
use permit for a second accessory building.
Site
The petitioner's lot is located on the Mississippi River and the
lot has rolling topography. It is heavily vegetated with large
mature Maple, Cedar, Arborvitae, and Pine trees on the site. The
Mississippi River bluff line is also heavily vegetated with a
variety of trees and shrubs. The placement of the accessory
building would require the removal of four, six inch diameter Pine
trees.
Analysis
As this request requires several variances, staff will present an
analysis of each variance request and a recommendation for each.
1. To reduce the side yard setback between an accessory building
and a side property line from 5 feet to 1 foot.
This request would cause an overcrowded condition due to the
close proximity of the neighbor�s garage to the north. There
would remain approximately 13 feet between the proposed
accessory use and the neighbor's garage. The placement of the
accessory building would also require the removal of four
White Pines which currently help to screen and provide
separation between Dr. Dahl�s lot and his neighbor. In
addition, construction of the accessory use would also impact
a mature Silver Maple that is currently on the neighbor's lot.
The petitioner has a second alternative to construct his
proposed accessory use. The petitioner could construct the
accessory building adjacent to the existing two car garage
with a 90 degree turn which would allow the use to be
constructed parallel to the west line of the driveway (see
proposed site plan). This would allow the petitioner to
preserve many of the screening trees that occur along the
northern property line and would allow for adequate separation
between structures.
Staff recommends denial of this request.

2. To increase the allawable total floor area of accessory
buildings from 1,400 square feet to approximately 1,670 square
feet.
A smaller structure can be constructed to meet Code. Personal
storage needs should not be accepted as a hardship.
Staff recommends denial of this variance request.
3. To allow the construction of an accessory building in the
front yard.
Due to the placement of the house on the lot, the front line
of the house, as defined by Code, occurs approximately midway
through the lot. In its proposed position, the accessory use
is in the front yard. However, if the petitioner were to
construct the accessory use in the alternate location
suggested earlier, it would be more consistent with the
current front line of the house, even though it may extend
forward of that particular line.
Staff recommends approval of this variance request based on the
alternative location proposed by staff.
�. To increase the allowable height of a fence in the front yard
from four feet to seven feet.
This request is a fall-back position for the petitioner in
the event that the variance to the side property line is not
granted. The petitioner is proposing to shorten the width of
the building in order to meet the 5 foot setback requirement
and then construct a 7 foot tall fence. The petitioner is
proposing to store materials between the fence and the
building.
The 7 foot fence would begin at a point even with the front
of the neighbors' house. Because the lot line where the fence
is to be located is within the front yard, the ordinance
requires it to be a maximum of four feet. However, the
location of the fence is consistent with the intent of the
ordinance by locating the 7 foot section behind the front line
of the house.
If the alternative location for the addition is proposed, it
is unclear whether the petitioner would continue to seek this
variance request. However, if the original request is
pursued, staff recommends approval of the fence variance since
the location of the 7 foot portion is consistent with the
intent of the ordinance. Note that this recommendation is

based solely on the fence request only, and not on the basis
of it being used in conjunction with the accessory building
immediately adjacent to it.
5. To reduce the required setback from a bluff line overlooking
the Mississippi River from 40 feet to 22 feet.
Currently, the existing house encroaches into the 40 foot
setback by approximately 6 feet. This is due to the fact that
the O-2 District regulations were adopted after the house had
been constructed. Staff recommends that the Appeals
Commission approve this variance because of strict enforcement
of the 40 foot setback would force the accessory structure
into the front yard. The addition to the garage can be
constructed to minimize impacts to the bluff line. If the
petitioner does relocate the proposed accessory use to the
placement that staff is recommending, the petitioner will
require a variance to the bluff line.
Recommendation
Staff recommends that the Appeals Commission deny variance requests
#1 and #2. These requests concern the side yard setback and the
total floor area. Staff recommends that the Appeals Commission
approve variance requests #3, #4 and #5, which would allow the
construction of an accessory building in the front yard, allow
construction of the 7 foot fence behind the front building line of
the neighbors' house, and an encroachment into the 40 foot setback
from the bluff line. Approval of these variances would be
stipulated on the alternative location of the accessory use as
proposed by st�ff. Further stipulations should include:
1. The structure shall be architecturally compatible with the
existing house.
2. A qrading and drainage plan shall be submitted for approval
by City staff.

We, the residen�t of Hartman Circle, have reviewed the
request made by Wayne Dahl for the right to erect a large
accessory building near the northerly line of lot 20, blxk
2, Sandhurst Addition.
As residen�i of this neighborhood, we do not want an
accessory building of any size or type in a front yard. Nor
do we want an accessory buildinq of this Bize even on a side
yard or back yard. The Hartman neighborhood originally was
developed in accordance with uniform standards of building
required by the subdivisions restrictive covenants, We, as
residen�i, do not want to deviate from that uniformity now by
alZowing a non-conforming accessory building that would
devalue our properties and encourage commercial use of a
zesidential property.

The Commissioners looked at the aeria� map showinq the setbacks and
boulevard of adjacent properties.
Mr. Kuechle stated he is in favor of this variance since the 10
foot setback is existing for other bu inesses alonq this block.
He stated this is the. first time someo e has come in to ask for
more parking than the Code requires. If there was not enough
parking, he would not want to see peopl parking on the Service
Road.
Ms. Savage agreed with Mr. Kuechle. She sta ed the 10 foot setback
would conform with the other businesses in the area. She would
like staff to make sure there is a good lan cape plan.

Council approval of variance request, VAR #89- 0, by Fridley Alano
Society, pursuant to Section 205.14.05.D.(5). a) of the Fridley
City Code to reduce the setback for all parkin and hard surface
areas from 20 feet from any street right-of-way o 9 feet, on Lots
18 through 24, Block 13, Bennett Palmer Addition, enerally located
directly north of the former Zantigo Restau ant, with the
stipulation that a landscape plan with screening r the rear lot
lines by submitted for approval by staff. At mini um, a six foot

Mr. Barna stated this public hearing is opened for the purpose of
getting testimony from neighbors who have requested that
opportunity. After testimony is received, this item should be
tabled indefinitely as requested by the petitioner, Wayne Dahl, in
a letter dated September 1, 1989. Mr. Dahl is not present at this
meeting.
Mr. Neal Hayford, 173 Hartman Circle, stated he has lived in this
neighborhood for three years. He loves the neighborhood. It is
a close, friendly neighborhood; and it has always been his dream
to live on a river.
Mr. Hayford stated the neighborhood was built to a standard in the
1950's and 1960's. Since that time, the owners have cared for
and updated their properties. Every home on Hartman Circle really
looks qood from the street. By submitting the petition, the
neiqhborhood is asking the City to uphold this neighborhood by
enforcing the City Code as it is written. And, they want to
support the City in its endeavors to do that. The codes are
written for a reason, and they agree with these codes. They do not
want the area redeveloped in a commercial standard which would be
much different than it is right now.

Mr. Barna asked if there were any restrictive covenants on the
properties' titles.
Mr. Hayford stated there was at one time, but he believed those
covenants expired in 1965-66. The covenants specifically address
accessory buildings. He stated he had brought a copy of his
covenant for the Commission's and staff's information.
Mr. Hayford stated it is the neighbors' opinion that this second
accessory building does not fit their residential neighborhood.
He did not know of any residential neighborhood that needs a 9-
stall garage or that large a square footage.
Mr. Hayford stated this accessory buildinq would be built right on
the riverbank. The Mississippi River is a resource, and there is
not that much riverbank. Building a garage on a riverbank seems
an odd use of precious riverbank property. If this qarage is
built, he believed it would become an eyesore in the future. There
are trees there now, but trees come and qo, and this could also
cause an erosion factor.

of a restrictive covenant for the iiartman Circle neighborhood.

Ms. Darlynn Ronn, 169 Hartman Circle, stated she lives right next
to Mr. Hayford. She stated Mr. Hayford has expressed the feelings
of the neighborhood very well. She stated they did have an
appraiser come out and look at both plans that would have been
submitted by Mr. Dahl, and they asked him for an evaluation of what
the impact would be on the neighborhood with this 65 ft. accessory
building. The appraiser strongly felt that it would devalue the
property values for the City. He will be writing a report on the
impact, value-wise, of this proposal.
Mr. Barna recommended the City Attorney look at the restrictive
covenant, the expiration of the covenant, and if it holds any
restrictions over and above the City codes.

This letter is in response to your Memorandum to me dated
September 6, 1989 regarding the above subject. Attached to your
Memorandum are excerpts of an abstract regarding Sandhurst Addition.
You asked me whether the restrictive covenants are still in effect.
In examining entry #167 of the abstract I note restrictive covenants
regarding Blocks 1 and 2 of Sandhurst Addition. They are dated
November 30, 1955. The covenants state �hat they are to be in effect
until January 1, 1966. Unless they have been renewed, and I have no
evidence of that, the covenants are no lon er in effect.

Enclosed are the proposed site plans for Dr. Wayne Dahl, 177
Hartman Circle N.E., Fridley. Dr. Dahl is proposing to construct
a 1,000 square foot accessory use on his lot which is adjacent to
the Mississippi River. In order to construct his accessory use,
Mr. Dahl will need several variances; one which deals with the
Mississippi River bluffline (see enclosed ordinance section). The
O-2, Critical Area District, requires a 40 foot setback between the
Mississippi River bluffline and any structure. Plan A is the
structure proposed by Dr. Dahl, which would require a variance from
40 feet to 22 feet, and Plan B is the addition proposed by staff,
which would require a variance from 40 feet to 16 feet.

Dear Ms. McPherson:
This letter is in response to your inquiry into our position on the
proposed variance from the 40-foot bluffline setback at the Dahl
residence at 177 Hartman Circle NE in Fridley. It's in the best
interest of the river resource that no further encroachment take
place toward the bluffline; therefore, we would recommend against
granting such a variance unless some kind of hardship can be proven.
This appears to be a case of the activity not specifically suited to
the property. Perhaps there is some other location that can .suit
the needs of Mr. Dahl.
It would also be in the best interest of the river resource if Mr.
Dahl were to discontinue dumping his yard clippings over the
�� riverbank. These yard clipping present a detrimental nutrient
source and contribute to algal production in the river.
