The Appeals Commission is given the power to review vcncicmce requests. The Laws of Minnesota .
have given the Appeals Commission the following responsibilities:
1. To heca cmd decide appea�ls where it is cicrimed that there is a mistccke in cmy order,
requirement, decision, or determination made by a City OHicial in enforcing the zoning
ordincmce.
2. To heaa� vca�icmce requests where strict enforcement of the code would cause undue
ha�rdship because of conditions unique to the property, cmd to grmlt these requests when it
is shown that the grcmting of the vari�ce will be in keeping with the intent of the ordincmce.
What is undue hcadship?
Undue hcadship is defined by the law ars:
1. The property ccmnot be put to recisoncxble use if used under the requirements of the code.
2. The need for the va�icmce is due to the conditions unique to the property cmd not created
by actions of the lcmdowner.
3. The vaoricmce, if grcmted, will not crlter the chc�acter of the neighborhood.
Money alone shall not constitute a hcQdship if rearsonarble use of the property exits under the
re�quirements of the code. The appliccmt should review all possible alternatives which would meet
the code requirements prior to applying for a vcuicmce. Wi� c� sufficient hcudship statement from

REQUEST
Petitioner is seeking to reduce the required front yard setback from 35' to 32' in order to
construct an attached garage at 191 Hartman Circle. This home was constructed without a
garage and is limited in where a newly constructed garage could be placed due to the lot
topography and unique architectural style of the home.
SITE DESCRIPTION/HISTORY
The subject parcel is located on Harman Circle north of Rice Creek and Mahnomen County Park.
Located on the property is a single family dwelling which was constructed in 1966. The
dwelling on the subject parcel is architecturally unique when compazed to adjacent dwellings in
the neighborhood. No garage was constructed with the original dwelling, and the owners have
used a bituminous parking area since 1966 for the pazking of vehicles.
In 1997, a realtor obtained a variance (VAR 97-02) to allow construction of a detached garage in
the front yard and to reduce the front yard setback to 32'. This variance expired in 1998, as
construction never began on this project. The current owner has found a way to azchitecturally
integrate an attached garage.

property is surrounded by R-1 single family homes to the north and to the west. To the
south is Rice Creek, part of Banfill Park. The lot was platted in 1955, and this unique
home was built in 1966. In 1969, a small addition was constructed onto the home �� t��
portion where the garage will be added. In 1997, the property obta�ned a variance to
reduce the front yard setback to 32 feet on the front of the home for the construction of
a garage. The variance expired in 1998 because the garage was not constructeda ����:f�

nicely with the unique structure. �

Mr. Bolin stated that the petitioner is requesting to reduce the required front yard
setback from 35 feet to 32 fest to allow the construction of an attached garage. The
property is surrounded by R-1 single family homes to the north and to the west. To the
south is Rice Creek, part of Banfill Park. The lot was platted in 1955, and this �anique
home was built in 1966. In 1969, a small addition was constructed onto the ho��e at tP��
portion where the garage will be added. In 1997, the property obtained a variance 40
reduce the front yard setback to 32 feet on the front of the home for the construction of
a garage. The variance expired in 1998 because the garage was not constructed. �taf�

Ms. Jackson stated that it is a beautiful plan.
Mr. Jones stated that this is within the parameters of the other variances granted so he
would vote in favor of this.
Mr. Tynjala concurred. It is an improvement over the last variance granted and fits in
nicely with the unique structure.

#00-18 by John Payne,191 Hartman Circle, with the following stipulations:
1. The petitioner shall obtain all necessary permits prior to construction.
2. The garage addition shall be architecturally compatible with the existing home.
