ADMZNISTRATIVE STAFF REPORT

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4B, requires a minimum side yard setback of IO feet for
living area.
Section 205.154, 6, requi�es a chimney to extend not more than 2 feet
into a required yard.
Public purpose served by these requirements is to maintain a minimum of
20 feet between living areas in adjacent structures and 15 feet between
garages and living areas in adjacent structures to reduce expo�ure to
conflagration of fire. It is also to allow for aesthetically pleasing
open areas around residential structures.
B. STATED HARDSHIP:
"Need above grade family room and energy fireplace. Not sufficient
eating area in the present kitch�n arrangement and the kitchen is to
dark at present. This addition will provide needed area instead of
moving.".
C. ADMINISTRATIVE STAFF REVIEW:
The existing gaxage is 7 or more feet away from the west lot line, the
petitioner would like to con5truct living area above the existing garage.
They also want to build a 1 foot chimney up the outside of the new con-
struction which will be 6' from the w�st lot line. Therefore, the variance
approval necessary to complete the aans�ruc�ion is to reduce the side yard
for living area from 10 feet to 7 feet and the side yard for a chimney
from 8 feet to 6 feet. If the Board approves this request the staff has
no suggested stipulations.

Mr. Kin� asked if he could rent the basement apartment as just a room?
Mr. Clark said that Mr�. King could rerit aroom out to college students. He said
that under Section 205.051 (assessory uses) of the Fridley City Code, he could not_ ____.__.
rent his�basement apartment out to more than 2 uersons. �
Ms. Schnabel said that this section of the Code applied to R-1 zoning and Mr. .
' Kings house was in R-3 zoning. She again suggested that Mr. King tal�k to Mr.
Boa�cdman of the City:�-Planning Department,'as he may be able to come up with another
idea on the request. .
Mr. Clark said the request would go to Council•on the f irst Monday in July.

vacant lot to the east, that lies only 4.5 feet.away. Therefore, it
is staff recommendation that the request be denied, or if approve3, no.
windo�as be allowed along the eust side to maintain some deg��� of
rear y�rd privacy for the lot to the east, also that the south setback
should be approved. , . _
IYjr. C].ark said that he had talked to Karla Blomberg, who is the developer of the
property on the South side of this house, and she said she had no objection to the
variance being granted.
Mrs. Gunnick said that the present 12' by 24' living area was not large enough for
tier wheel cl�air to move around in, and if there were other people in the room, iC
became too congested. �
Mrs. Kurtznolan, owner o£ the property �o �.he east side of the house, said that she
did not ab�ect to the addition to this house. Her house sits north of this house,
and he� 1ot is over 300 feet long. �ven if Mrs. Rurznolan were to split off the
south half of her property, the lot was over 100 feet wide and it was felt rchat
any new house could be placed�so as not to be bothered by this addition. (The new
1ot would be approximately 150' x 100'}. .
