1248 Hathaway Lane N. E., Fridley, Minnesota'S5421. The aforementioned
complaint is forwarded to the City Attorney as enclosure No. 1.
The Building Inspection Department submits the information
attached as enclosure No. 2.
Action is being taken concerning the cleanup. Please advise of
whether action can be taken on the complaint by the City; or whether
such action is a private suit matter. If City action is indicated
please advise steps to be taken.

City Attorney concerning the embankment problems of
Mr. James 0. Luff, 1248 Hathawy Lane N. E.
Please set up enclosure 2 as indicated in my memo
to City Attorney. As a minimum I would suggest a
statement as,to what has been d�ne by Building Inspection
Department, a copy of building permit with allied papers
and any stipulations that might have been made at time

problem r�e have had since the early au�ner of 1969. The construction began on a
house to the East of our home in early June of 1969, the builder, did not have the
lot surveyed, but proceeded to �ark off the lot �aith a tape measure from a supposed
• lot line East of the construction site. In layin� the footin�s fbr the house, we �
noticed the house would be about 4 or 5 feet in front of our home, we callad the
Building Insp�ction �ept, and they �earae out and had the builder nove the footings ;
back in line with our ho�eo
We he.d our lot surveyed by my Brother-in-law vJho does surveying for A�iinn.
HiGhway T�pt. �ilen we had our hone built, the su�:uner of 1968. Our address is 12�F8
Hath�V�ay Lane and the house under cons�ruction and in question is 1232 Hathawaye
�7hen they e:ccavated for 1232 our stakes vrere removed and a considerable amouni
of our land was cut ataay. We called the Building Inspector because our land was
start?ng to erodea By August and S�-pt. o� 1969 vre had contacted the Mayor and Building
Inspector hoping something'could be dane to have a retaining caall built so as to
contain the drashing away oi our dirt and sod. :de a�ain had our lot Surveyed by my !
Brother-in-law, because our staltes had been talten out. ii�thhen the builder oi 1232 saw
ne� stakes he pulled them out and threrr the� on o.ur front yard, zrhen r�Je �ouldpound them in
he proceeded to pull them out a couple more tines and throw then up on our yard.
The Buildin; Inspector told the builder he had to cons�ruct a ce�.�ent trall,
� we have not heard what answer �das given .Erom builder if any. The Buildin� Inspector
e�lso told us that one of ias would have to furnish a certified survey before they could
push the issue, beeause ray Brother-in-law t�as not a certified surveyor.
This spring of 197d, �e hired Comstock 8a Davis Surveyors to survey our lot
and fouad the house is only 6 Feet-l0 Inc'�es iroa our lot line at one point, and the
builder of 1232 has dug �2 Feet of our ground and sod ��raye Ever;� rain cre have large
pieces of dirt and sod are falling and aven hitting the 1232 address. I went and sat�
the City iianager on June 4, 1970 and he suggested I vrrite our complaint out and expl�in
our situ�tion. The �uil�.inc Inspection Dept. eannot seer� to deal with this builder,
the firs� time we inquired about the footin�s and the Inspecto^s ca�e to look at the
footin�s the builders vrifle v��s their� that afterizoon the builder called the Chief
Building Inspector and told hi� ofi' ior using abusive language on his tai�e and the _
Inspector told us he �vas very belligerent, �,re could not see any point in discussing
the situation with the attitude he had.
This house o=" 12j2 has had a pile of debris since last year, ��hic:� has been
bloVaing aroung, we ealled to connlain in A�ril of 1970, because vre had just raked and carec
for our lawn and yard and pieces of plasiie, insulation and pieces of cardboard Vrere
bloVring down the street and into our ye�rd� the pile oP clebris is s�ill there. :�le cannot
believe this is raally happeiling, and nottling is bein� done, jtthy ian't somet:�ing being
, done. There should be a penalty �rhen a house is not positioned were the builder says hets
going to put it.
jt looks as if we will have to go to court;to �et our land back and to get

It has recently come to our attention that you are operating a catering
service.
The Anoka County Food and Beverage Ordinance requires that a license be
obtained for the operation of a catering service. Enclosed is a partially
completed application for a license to operate a catering service in Anoka
County. Please complete both sides, and return it to us, together with the
appropriate fees ($80.00 license fee and $80.00 plan review fee) and plans
(description) of the catering service. These plans and description must
identify the methods of and facilities for, storage, preparation, transporta-
tion, display, service, utensil cleansing and all facilities used in con-
nection with the service.
If the establishment is a sole proprietorship or partnership, the applica-
tion must bc signed by the owner(s). If the establishment is a corporation
the application mu�t be signed by an officer of the corporation or evidence
provided that the person signing the application is authorized to act on
behalf of the corporation for this purpose.
