BUILDING PERMIT FBE SCHLDULE
Section,2. The Inspector of Buildin�s shall, before issuing any permit for
the erect3on of any building or structure,_ or for an� addiltioa to any exist-
ing bu$ldiag or structure, or for �ny alterations or repaira to any exiat�ing
building;or seructure, uport application therefor, require the paymen� by �he
applican� for such p.�rmit of fees to the amount h�rein below set forth and
in the masnnsr hereia provided tai-wi�;
2.1. For any such permit for �he erection of any fire-proof building, other
than a garage+ warehouse, factory og grain elevator, or for the erection of
any fire-proof addition, for similar occupaacy, to any existing buildibg
shall be et the rate of $Z.40 for each oae thousand cubic ieetb or fraction
thereof, in such cubical coptents.
2.2. For any.such permit for the eraction of any fire-proof garage, wasehouse,
factory or grain elenator, or for the erection of any� fire-proof addition,
for similar occupancy, to any exiating buildiag shall be at the rate o� $1.25
for each one thousand cubic feet, classified as 01fireproof" by Section 502 of
the.Minaeapolis Building Code.

2.3. For any such permit for Che erection of any non-fireproof building other
than a garage, wareliouse, f�ctory or grain elevator, or any non-fireproof
addition, for similar occupency, to aay existing buildiag - permit $1.00 for
each one thousand,cub�c feet.
GARAGES
2.4. For any such permit for the erectioa of aay noa-fireproof garage,
�� warehouse, factory or grain elevator, or for the erecttion of any non-firepgoof
addiCion, for similar occupancy, to any existiag buildiug or for each such
building or addition - niae�y cents ($0.90) for each one thousand cubic feet
or fraction thereof, in the cubical Goatents thereof ti,�ith a minimuan of $4.OU.
Far the purpose of computing fees £or building permits, the cubical con�tents
of any building or additioa to a uniform height throughout by mul�iplying the
ground area covered fram a point six (6) inches below the floar line of �he
basement or cellar to the aver�ge heigh� of the upper aurface or to the
average h�ight of the roof surface of the mein gable of a p3tched rooi.
2.5. For repairs or alterations to an existing structure, the fee siiall be
at the rate of $3.00 per each Fiv� Hundred Dollars ($SOO.QO) or fraction
tlaereof ia the cost o� a}.1 progoaed work.
2.6. In no case shail the fee charged for aay permit as set forth in
Section 2 be lesa th�n $4.00.

Letter Responding to Questions Posed by Mr. and
Mrs. Sachs
Attached is a draft letter answering the questions that Mr. and
Mrs. Sachs submitted to my office on March 15, 1990. Because of
the apparent controversy involved with the sale of a portion of
Outlot C, we have structured the letter to indicate that the City
would advertise for a process of sealed bids and award the property
to the highest bidder. Typically, this is done for tax forfeit
property; however, for excess property, sometimes the City Council
has made a decision just to transfer the sale of property to the
property owners and not necessarily do a bid process.
Our concern with the bid process is that because of neighborhood
rivalries, the Sachs' may be outbid, and the solution to their
garage expansion as proposed by the City may not occur.
Without a bid process, the only other method is for the City
Council to conduct the public hearing, announce that the City
Council is interested in selling property, declare it excess, and
make a decision on its own to convey the property without the rules
and structure of the bid process.
If the Sachs� were to add on to the existing garage, as little as
10 to 20 feet could be conveyed to them, or if they propose to have
a three car garage, as much as 40 feet would be necessary.
I realize that the City Council has a number of items to address
in the next week; however, maybe Councilman Schneider could be
contacted regarding the letter prior to mailing it to the Sachs'.
Please provide further direction.

This letter is in response to the four questions you submitted to
us on March 15, 1990:
Question i: How wou18 the sale cf outlot C be conducted?
Prior to the sale of Outlot C, the Council must declare the
property excess, either a part or in its entirety. This is
done through a 4/5 vote of the Council and the passage of an
ordinance. The Council typically holds a public hearing prior
to deciding whether or not the property is to be declared
excess property. The City would then advertise for sealed
bids and award the property to the highest bidder.
Question 2: Ahat will be the cost of the land?
The costs for the land will vary depending on whether the
Council would choose to sell the entire Outlot C or only a
portion of it. If the Council were to sell the entire parcel,
the costs would include:
1. Price of the land by the highest bidder
2. Assessments for sewer and water laterals
3. Sewer and water services
4. Lawyer's fee to review the abstract update provided

As outlot C is currently zoned R-1, Single Family Residential,
the uses allowed would be restricted to those outlined in that
section of the zoning code (Section 205.07.01). The City may
choose to stipulate that there would be no access onto
Matterhorn. This would only apply if the entire lot was sold.
Question 4: If the lot is split, what will be done with the
remaininq land on outlot C?
If split, the remaining land on Outlot C would continue to
remain owned by the City and would remain vacant.

Orville Sachs would like the City Council to sell a portion
of Outlot C at the end of Hathaway Lane . He would like to add an
additional 10 feet onto the existing 12 foot garage. In order to
expand the garage to the east, he would need to purchase a portion
of City-owned Outlot C. '
Staff has determined that Mr. Sachs would need to purchase 10 feet
of Outlot C in order to construct the addition. This includes the
proposed addition and the required setback.
In order to sell the 10 feet to Mr. Sachs, the City would need to
subdivide Outlot C. This can be done via a simple lot split; a
plat would not be required (please see attached site plans). A
vacation would also be required, as a six foot drainage and utility
easement is located adjacent to the east lot line.
Please inquire if the Council would encourage the above requests
from Mr. Sachs. Al1 e�cpenses associated with the requests should
be Mr. Sachs' responsibility.

Dear Mr. Bergman:
I met with Mrs. Bergman regarding your concern about the danger of someone falling from the
top of the retaining wall at the end of Hathaway Lane. We feel that the best way to address the
problem would be for us to install a fence behind the retaining wall at the City's expense and allow
you to attach a fence to the City's fence at your expense.
The City has received a quotation (enclosed) from Town and Country Fence for the proposed
work. The City will install the fence behind the retaining wall as soon as weather conditions
permit this spring. We need to know if you would like to have a fence installed between the City
fence and your property as part of this installation.
The City would prefer that the contractor bill you directly for your portion of the installation
($175). Please advise me as soon as possible regarding your portion of the installation as the City
must notify the contractor within the next 30 days. If you have any questions, please contact me

Dear Mr. Burns:
My name is �ric Bergman. i1iIy wife, Christine, and I live at 1281 Hathaway Lane T�TE
in Fridley. We live in the last house on the north side of Hathaway Lane, which is a dead end
street. We have lived here for two and a half years. Our property is adjacent to city property.
The city property starts approximately seven feet from our garage and runs east down to
Matterhorn Drive. Contained within the city property is a.retaining wall which is

approlcimately seven feet high. The city property has a grass lawn that flows into our property
so that it appears as one yard.
During the entire time we have lived here we have cazed for the city property (mowing,
raking) as if it were our own. We have never been contacted by the city regard°uig maintaining
the property, or compensation for that maintenance. We have been happy to assume that
responsibility, as we have enjoyed its use.
What we would like to do is erect a fence (4 to 5 feet high) mm�ing across the high part
of the retaining wa11 and sloping down towazds the garage. The fence would be approximately
fifty feet long. We would like to do this for a number of reasons. First, we have a son who
is a year and half old. In the spring he will be playing outside and we feel that this high wa11
presents a significant danger to him. Secondly, my wife recently starting doing daycaze in our
home. Even though the outdoor activities aze largely focused in the backyazd, it is likely that
a young child, unavvare of the danger, will suffer a serious injury if he or she strays too close
to the wall and fa11s. Thirdly, we have often noticed kids passing through the city property.
If any of these kids were unfamiliar with the azea an accident could result. Unfortunately, if
an injury were to occur, the issue could become one of liability, for my wife and me, as well
as the city. Lastly, the lack of a protective fence may discourage parents who would otherwise
choose to place their children in my wife's daycaze, but simply feel the risk is too great We
believe that a fence is an inexpensive way to protect a child, as well as ourselves and the city,
from harm.
We would be happy to assume the responsibility of building the fence. However,
because the fence would largely rest on city property, we feel that the cost of materials should
not be our financial burden alone. I have gone to Home Depot and done two cost estimates
` of the project, one based on installing a chain-link fence, the other wood. The materials for
a chain-link fence will cost approximately $200.00. The materials for a wood fence will cost

approximately $400.00. We would prefer a wood fence. Therefore, I propose that the city put
up $200.00 for the cost of the fence and we will make up the difference.
My understanding from a conversation with John Flora is that this proposal will be
brought before the city council, who will then make their decision. My wife and I would be
happy to appear before the council to answer any questions it may have. Nonetheless, we
would like to be advised when this will be on the council's agenda.
