Notice is hereby given that the Appeals Corrnnission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, January 14 , i986 in regard to the
following matter:
Consideration of a variance request pursuaat
to Chapter 205 of the Fridley City Code, to
reduce the side yard setback from 5 feet to
4.8' to allow existing garage to remain on
Lot 10, Block 1, Heather Hills West, the
same being 6185 Heather Place N.E.
(Mistake made by the surveyor on the verifi-
cation survey.)
Notice is hereby given that all persons having an interest therein wi11 be
given the opportunity to be heard at the above time and place.

Section 205.07.3D.2b, requires a side yard of five (5) feet betW een an
attached accessory building or use and side property lines.
Publie Purpose served by this requirement is to provide space betWeen
individual structures to reduce conflagration of fire, to provide
aceess to the rear yard Por emergeneies and to limit the eondition of
erowding in the residential neighborhood.

"Possible resale problem of house with building not at proper side line
setback."
C. ADI�IINIS?BATIVB STAFF aBVIBiT:
This variance request was caused by an error made by the surveyor. The
first As-Built survey dated 10-24-83 indicated a 5.3 foot side yard.
In November of 1985 while the surveyor was conductirig a survey for the
new house to the north (6199 Heather Place N.E.) a one foot error Was
discovered in the location of the front lot iron thus changing the
sideyard setback from 5.3 feet to 4.8 feet for the garage.
The neW house to the north (6199 Heather Place N.E.) is located more
than 11 feet from the common lot line therefore there is more than the
required 15 feet between living area and garage area.
If the Board approves this request the staff has no stipul ations to
suggest.
