Benedict wrote a letter to the District concern9ng the subject detention pond which was located on the lot h� purchased from Thomas Brlckner, namely, Lot 7, Block 1, Creekridge. Attached to Mr. Benedict's letter was a sk�tch of the proposed deten�ion pond that had b�en submitted to us on October 23, 1984. The revised pond sketch which we have attached as Exhibit "B" was submitted to us on April 3, 1985 and subsequently approved �s the �evised Grading �lan for the po�dfng area on June 3, 1985. Whoev�r had prov�ded Mr. Benedict with a drawing of the ponding area did not provide �im with the drawing that was current at the t�me he purchased his lat from Mr. Brickner on June 6, 1985. The purpose of the pond is to provide retention and treatment for storwater runoff for 2 acres of land adjacent to 55th Avenue N.E. and a��aller parce1 of land adjacent to Arthur Street N.E. You have recently completed grading the pond and this work looks very good. However, there are still two items which need to be completed before this detention pond can function as it was designed to. The two items are completion of the weir and sodding of the ponding area. The skimming weir should be constructed according to the plans submitted to and approved by the Rice Creek Watershed District. I am attaching a copy of this weir design for your information. I believe that this weir was constructed some time ago but has apparently been destroyed during the regrading of the ponding area. The second item which we have discussed several times regards the sodding of the ponding area. The ponding area was to have been sodded by Brickner Builders when the pond was first installed at the start of the development. You have provided me with a copy of the specification form for the house at 1499 66th Avenue which states that the final grading and sodding is to be accomplished by the buyer. The buyer, Mr. John Benedict, has stated that it was only his responsibility to grade and sod the portion of his yard not included in this pond and that you had a verbal agreement with him that Brickner Builders would sod the pond. We would like to hav�e the weir and sodding completed this fall so that this ponding area is not a problem again next year. Several representatives from the Rice Creek Watershed District and the City of Fridley, as well as yourself, and the property owners have spent too much time the past two years discussing this detention pond and it is now time for the pond to be completed. � Mr. Tom Brickner Brickner Builders, Inc. Our snowplows have ane-way plows on them which means they can only plow the snow to the right side. These plows are attached to the larger trucks which carry sand for ballast and are very difficult to maneuver in narrow and small spaces. Your suggestion would require the driver to drive on the wrong side of the road to cast the windrow to the right, and would require him to back up down the cul-de-sac all the way to Central Avenue in order to make another pass up that segment of the street, since the typical plow only deals with about eight foot of width and the street is 30 feet wide. While I appreciate your concern regarding the amount of snow that is left in the driveways and builds up in the cul-de-sac, it is not possible to honor your request and still provide a safe and efficient removal of snow from the roadway surface. Thank you for your interest. If there was a way this could be accomplished, be assured we certainly would have attempted it, but we cannot put our drivers and equipment in a position where they could suffer injury or cause injury to others. (refer to the enclosed diagram - the arrows are intended to show the direction in which the snow would be plowed) In doing so, you would remove the snow in front of our driveways on that side. This would appear that the only extra effort on the part of the city would be to back the truck up twice for the short distance from the circle to the corner. In turn, this would relieve five homeowners from having to remove the excess from their driveways.
