Mr. Hickok explained that Mr. and Mrs. Nchols requested a variance to allow them to park their
travel trailer on their blacktop driveway rather than in the side or rear yard as required by code.
He provided photographs of the property, noting that it was located on the north edge of Locke
Lake. Several photographs were presented showing the location of the trailer from various
directions.
Mr. and Mrs. Nchols' hazdship was that their loi does not allow them to utilize either the side
yard or the back yard. Both of their side yards slope sharply, and one side has stairs and large
flower boxes. Mr. I3'ickok noted that on a field visit, there was not access to the side or rear yazd.

Mr. I-i'ickok noted that no similar requests ha�e been granted. Council did consider one such
variance request at a January meeting but denied the request. Staff did not have any
recommendation on this request. He noted that if Council grants this variance, the following
stipulations would be recommended: 1) The petitioner shall continue pazking the travel trailer on
the paved surface; 2) The petitioner shall continue parking towing vehicle in the garage when not
in use; and 3) The variance shall become null and void once Mr. and Mrs. Abraham Nchols sell
the property or move from the home.
Mayor Jorgenson asked if Mr. and Mrs. Nchols were issued a citation. Mr. H'ickok responded
that this violation was discovered as part of the systematic code enforcement process. No
complaints have been received; however, several letters of support have been sent to the City
from neighbors. The ordinance, however has been in effect since the late 1960s.
Councilmember Bolkcom stated that she did not feel the Appeals Commission's direction was
clear. Mr. H'ickok stated that the Appeals Commission would like to see this portion of the code
revisited so that it would be cleazly evident th�t in no case a.re travel trailers to be parked in the
front yard. �
There was some discussion with regard to motor homes being parked in driveways. Mr. Hickok
noted that these types of units fall within the statutory definition of vehicles; and, therefore, are
allowed on driveways. This is often difficult for residents to comprehend.
Councilmember Wolfe noted that to most residents who live on the la.ke, the lakeside property is
considered to be the front yard. Parking trailers there would have a more visual impact than
parking them on the front driveways.
Mayor Jorgenson stated tha.t she felt the ordinance must be applied to all properties within the
City, not just certain properties.
Councilmember Bolkcom felt that the entire ordinance needed to be reviewed aga.in.
Mr. Knaak, City Attomey, stated that he felt Council must be careful in granting variances such as
this. There are likely other properties with similaz situations, which would come forwaxd with
variance requests as well. If Council chose to approve the variance, the various set of unique
circumstances which apply to this property would need to be explicitly outlined.
MOTION by Councilmember Bolkcom to approve Variance #99-01, due to the unique
characteristics of the property. Seconded by Councilmember Wolfe.
MOTION by Councilmember Bolkcom to amend the motion of approval, noting that it was a
unique property with the lake in the rear yard, and it was to include the following stipulations: 1)
the petitioner shall continue parking the travel trailer on the paved surface; 2) the petitioner shall
continue parking towing vehicles in gazage when not in use; and 3) the variance shall become null
and void once Mr. and Mrs. Abraham Nchols sell the property or move from the home.
Seconded by Councilmember Wolfe.
Mr. Mazk Nchols, stated that his parents, Mr. and Mrs. Nchols, have been residents of Fridley
since 1965. The trailer has been parked in that location for over thirty years. During the summer
months, the trailer is moved to a seasonal site on Big Lake. The neighbors have all indicated their

approval of the parking situation. He stated that his parents are retired with a fixed income and
that storing the trailer off site would be �pensive.
Mayor Jorgenson stated that she was empathetic that Council must maintain consistency. This
situation would really be no different than those properties on Matterhorn Drive. .
Councilmember Barnette stated that he could support the variance request provided it would
become null and void if the Nchols should ever move or sell the properry.
Councilmember Billings stated that a stipulation such as this would indicaxe that the variance was
not being granted for the particular property, but rather for the property owner and would
establish a precedent for storage of other trailers in front yards. He felt that many of the big
motor homes do create a bigger visual impact than trailers such as that owned by Mr. and Mrs.
Nchols. However, at this time, he could not support this variance.
Councilmember Barnette asked where some of the other trailer owners at the Big Lake resort
store their trailers during off-season. Mrs. Nichols stated that many of them are parked off-site.
She checked into the cost of doing so, and found that it would cost approximately $48.00 per
month to store the trailer on a 12 foot by 24 foot stall (outdoors).
Mr. Knaak, City Attorney, noted that should Council choose to approve the variance request, he
would recommend that the approval be based on the steep slopes and large evergreens on the
property and the fact that there is no possible way to put the travel trailer in the side yard. There
was no alley behind the home to access the rear yard. Additionally, due to the large trees on the
lot, the travel trailer is fairly well screened from all neighbors except those directly across the
street.

Mr. Hickok noted that Mr. and Mrs. Nichols have 45 days to remove the trailer from their
property. Councilmember Bolkcom felt that portion of the City Code should be revisited.

Councilmember Bolkcom stated that sh requested that this item be removed from the consent
agenda for clarification as to which street would be sealcoated. Mr. Flora provided a diagram
showing which streets would be complete . Originally, staff felt that the area, which was not
completed under the Riverview Heights p ject, could be completed as a part of this project.
However, when bids came in, it was evident at the costs would faz exceed the amount budgeted
in 1999 for this project. Therefore, sta�s t recommendation was that those areas be deleted
which would bring the project cost down from 210,327.74 to $163,131.28.
Since that time, staff received the bids for the verview Heights street improvement project,
which were essentially $200,000, less than what as originally anticipated. As a result, staff felt

that a portion of the funds budgete for the Riverview Heights project could be used to finance
the sealcoating project, thereby allo ' g all of the work (Areas 1& 2) originally proposed to be
completed on schedule under the City s street maintenance program.
A discussion followed with regazd to possibility of cost overruns and change orders that could
occur when the Riverview Heights pro� ct is completed. This would, in turn, increase the costs
for that project. Mr. Flora noted that on change order was alrea.dy anticipated for the Riverview
Heights project; however, he remained c nfident that there would be ample funds in the project
budget to complete the project satisfacto ' y.
Councilmember Bolkcom asked how muc excess funds anticipated would remain available for
other change orders which could result. Mr. Flora noted that the anticipated cost of the
Riverview Heights project was between $2. million and $2.6 million. The bid came in at just
under $2 million. Even with the appro�cim te $140,000 in change orders (including the seal
coating project and the raising of the water lin , it appears that there would still be ample funds.
Councilmember Billings noted that at some po' the areas designated for sealcoating would need
to be doubled up in order to a11ow the project t remain on schedule. With costs continuing to
increase, he felt Council should consider looking at completing the sealcoating in Area 1 at this
time. .

Mr. Flora noted that the bids for this project were opened on arch 19, 1999. The low bid was
received from Park Construction in the amount of $1,969,63 .75. He noted that the City has
worked with Park Construction in the past and has not had any roblems.

Mr. Bolin stated the petitioners are requesting a variance to park a travel trailer on a
blacktop driveway rather than in the side or rear yard at 6949 Hickory Drive. The code
requires that travel trailers be stored in the side or rear yarde The prQperty is located
north of Locke Lake and east of East River Ftoad. The property is zoned R-1,

Family, as are the surrounding properties. Four neighbors have sent letters to the City
in support of the variance request.
Mr. Bolin stated that Ostman 3rd Addition was platted in February 1957. The home
was built a few months later. There are no past zoning or land use requests on this
property. He showed a photo of the travel trailer as it is parked in the driveway. Large
trees help to somewhat shield the trailer from view. The property drops off sharply on
the east side of the home.
Mr. Bolin stated the petitioners' hardship statement indicates: "In reply to your letter of
February 18, 1999, with reference to our Application for Variance, we wish to state that
our Airstream travel trailer is a bit of a gypsy but does need a home too, beside our
driveway. We have been citizens of Fridley for 34 years this coming April and came
with a trailer at that time too. So, you can see that we belong together. The slab that
we had made to accommodate our trailer nex� to the house and driveway makes it
convenient to load and unload at various times when we go to club rallies or trips with
friends and children. With reference to the location of said trailer, our lot does not allow
us to utilize either side yard or the back yard —we might end up in Locke Lake. Both of
our side yards do slope sharply and one side does have stairs and deep flower boxes
with tulips in the spring. With this plea, I hope you and the other commissioners will
allow us the privilege of keeping our trailer in its present location alongside of our
driveway."
Mr. Bolin stated during the field visit, staff found the property drops off sharply. One
side has steps and flower boxes. Due to the sharp slopes� large trees, and the lack of
an alleyway, the petitioner has no access to the side or rear yard on this property. No
similar requests have been granted in the past. Four letters of support were received
from the neighbors. One neighbor pointed out that people who live around Locke Lake
consider the lakeside as their front yards.
Mr. Bolin stated staff has no recommendation on this variance request. It is similar to
variance request, VAR #98-41 that was discussed approximately two months ago.
Staff would like to point out that the topography does prevent access to the side or reaP
yard. As with variance request, VAR #98-41, the City Council has indicated that off site
storage is an option that would negate any hardship caused by topography. If the
Commission chooses to recommend approval of the request, staff recommends the
following stipulations:
1. Petitioner shall continue parking travel trailer on paved surFace.
2. Petitioner shall continue parking towing vehicle in garage when not in use.

Ms. Beaulieu asked what brought this to the aitention of the City.
Mr. Bolin stated he was not sure if this was noticed by the Code Enforcement Officer,
Ms. Daniels, or if it was called in as a complaint.
Ms. Beaulieu stated staff had reported that no similar requests have been granted.
Have their been similar requests that have been denied?
Mr. Bolin stated yes. VAR #98-41, discussed at the January meeting, was a similar
situation, but it was a situation where the house had a tuck-under garage and steep
slopes in the front yard that prevented the trailer from fitting into the side or rear yard.
This request was denied by the Appeals Commission and also by the City Council.
Mr. Kuechle asked how many situations like this are out there.
Mr. Bolin stated there are quite a few. He has personally seen approximately 15 travel
trailers parked in the front or side yards. He did not have an exact count from Ms.
Daniels. As she sees these violations, she sends out compliance notices. As people
call in, she will go out and look at the situation as well.
Mr. Kuechle stated he was not at the City Council meeting where they considered VAR
#98-41. Did the City Council give an indication of where they expect to go with this
issue? He would suspect this will be coming up time and time again. It would seem to
him that a high hill, drop-offs, narrow side yards, etc., would prevent 90% of the trailers
to be stored in the side or rear yard.
Mr. Bolin stated the Council did indicate that they would like to make a zoning text
change to address some of these problems. They have given staff the directive to
study what other communities are doing and to get back to them. No definite time line
was given. With summer fast approaching, there will be more and more campers.
Therefore, staff is anxious to address this issue.
Dr. Vos stated that right now a boat or a camper can be parked temporally in the front
yard in the summer, but now they are talking about the storage year around.
Mr. Kuechle asked what the code says precisely for a time.
Mr. Bolin stated the code does not give a specific time. It has been the policy to
seasonally allow storage for a few days or a week at a time for boats, campers,
snowmobile trailers, etc. In these cases, these are stored in the driveway but are used
every few days or every weekend. According to the current code, even that should not
be allowed.
Ms. Mau stated she assumed that all this started because there have been a lot of
complaints about this storage being done in the driveways.

Mr. Bolin stated, yes. There were complaints, and the code has to be uniformly
enforced across the City.
Ms. Beaulieu stated she could see that anyone living on a lake would not want the
storage on the lake side either. If there was a way to get there, she can see where
people think of that as their front yard. It seerms like this should say either the side yard
or nowhere.
Mr. Kuechle stated he thought much of this is coming out because of the systematic
code enforcement. Has there been any thought by City staff toward a moratorium on
enforcement of travel trailers until this is figured out?
Mr. Bolin stated that until staffs get that direction from City Council, the code has to be
enforced. The City Council has not changed the directive to the Code Enforcement
Officer.
Dr. Vos stated the City Council denied the pr�vious request because off-site storage
was possibfe. It appears the City Council did not solve the problem but rather denied
the request.
Mr. Bolin stated the City Council indicated that as long as there is off-site storage in
Fridley or the surrounding community, that negates any hardship caused by
topography, etc.
Mr. Nichols stated they have been at 6949 Hickory since 1972. They like their house,
the lake, and their trailer. They park their trailer there sometimes in Fridley and
sometimes at another lake near St. Cloud, so they are not situated in only one spot.
They also travel to various places across the country and Canada.
Dr. Vos asked the petitioner if they had considered the option of off-site storage whe�
the trailer is not being used for travel. The City Council gave that directive to the
petitioner that came ea�ier.
Ms. Nichols stated they do not take the trailer out in the winter because they have had
the experience of a sudden snowstorm and, when going around the cloverleaf, the
trailer started to jackknife. So they decided tFsat it was best to travel with the travel
trailer when the weather is better.
Dr. Vos stated there is then a period of time that the travel trailer is parked in the
driveway perhaps November to April.
Ms. Nichols stated this is correct.
Mr. Nichols stated there is actually a cement slab that they had poured �e�t �� ���
driveway.

Ms. Beaulieu asked if the petitioner could leave the trailer at their other lake place.
Ms. Nichols stated they require all trailers to be off by October 1.
Ms. Mau stated it is then possible that the petitioner could store the trailer off-site from
October to April.
Mr. Nichols stated he did not know. He may want to use it at any time. They want the
freedom to use it, to leave, or to stay. They have three sons in the neighborhood and
they don't want to isolate themselves from them.
Ms. Nichols stated they looked for five years for a house before they bought their house
in Fridley. It met all their criteria. The house was nice, the yard was nice, it had a safe
place for their children to slide, it had mature trees, and it was on a lake. It has all of
that. They have been happy there. They have raised three children there. This is their
pick, and she would hope that they could have a variance for it.

Dr. Vos stated he has lived in Fridley since 1974. He was the one that brought up the
fact that there is no hardship because there is off-site storage. He stores a boat and a
van off site at the facility off East River Road. He will vote no because he wants the
City Council to hear every request. If the City is going to do code enforcement, then
either the code has something wrong or the City needs to do something with the code.
He would vote against the request.
Ms. Mau agreed. As much as she is sympathetic to fhe plight that the petitioners would
like to have their travel trailer at their home all the time, she stated last time that there
would be a massive influx of people requesting a variance. She agreed that the City
Council has to address this. If the City is going to have a code. the City either needs to
enforce it or change the code so that it is more user friendly.
Ms. Beaulieu agreed. She also has a boat and a camper that are stored elsewhere.
They live in a state that has one extra vehicle per household. If the City is
systematically trying to remove these from the front of houses, she thought that was a
good idea. Let the City Council hear the request.
Mr. Jones stated he is particular�y sympathetic because he lives on a lake and just
down the street from the petitioner. He kind of agrees with the comment that the
backyard is really the front yard when you live on a lake. Putting things toward the back
of the buildings makes it seem really more towards the front. However� he is reluctantly
going to vote against the variance, not because he is not sympathetic �o the request.

He also has a camper and a boat that are stored off-site. This is a code issue and
either they stick with the code or change the code. That is something that the City
Council needs to address.
Ms. Nichols asked if the Commission is going to recommend that everyone who ha� a
trailer or a boat be cited according to code.
Mr. Jones stated it is his understanding that Ms. Daniels' job is to look for code
violations and to cite them. He agrees that th�re are others and he wonders what is
going to happen here.
Mr. Bolin explained the systematic code enforcement process. Last year,
approximately 60% of the City was completed. This coming spring and summer they
will finish the remaining areas of the City going into each neighborhood at least one
time looking for code violations. While Ms. Daniels goes around, she tries to be pro-
active rather than re-active. If she gets a call about a code violation and is driving to
that site, anything she notices along the way is also noted and followed up. The City ��
Fridley is rather large. It may be possible that there are campers out there thafi staif
has not yet seen. For the most part, staff has a pretty good handle on what is out there
and they are being dealt with. If there are some particular properties that anyone is
concemed about, he/she should feel free to call Mr. Bolin or Ms. Daniels directly. They
can check to see if the property has received a notice, etc.
Dr. Vos stated he has also become aware that there is a distinction in the code
between a travel trailer which is pulled behind a vehicle versus a motor home or a pick�
up camper. If you have a camper on the back of a pick-up, you can park it on that pad.
The same is true of a motor home. Since a travel trailer has a hitch on the front, then it
must be in the side or rear yard. The code is inconsistent about that.
Mr. Jones stated that if you look at the code from April through October, is that
considered temporary for boats and trailers?
Dr. Vos stated technically the code does not say.
Ms. Beaulieu stated the Code is saying they cannot be there but it is not strictl�
enforced.
Mr. Kuechle stated the idea is that they cannot be there.
Mr. Jones asked when this portion of the code went into effect.
Mr. Bolin stated this section was approved in 1978. In the last year, this has ����
heavily enforced.

Commission.

1999 at 7:30 p.m. in regards to the above case number but will "agree" to the variance
under the following 2 conditions. If either condition is not met, then consider my vote
"No" on the variance.
Condition 1 The variance will terminate with the sale or transfer of the land to
another party. This is to say that the variance is for the current
