MII'�ERS PRESENT: Ylinen, Mittelstadt, Minish N���S ABSIIVT: 0' Bannon, Ahonen OTF�tS PRESE�NT: Breher-Building Official MOTION by Minish to accept the amended minutes of the August 7, 1968 Board of 9ppeals Meeting. Seconded by Mittelstadt. Upon a voice vote, there being no naye, the motion carried unanimously. 1. A REQUEST FOR A VARIANCE OF SECTION 45.23(a) SIDE YARD SET BACK FROM 5 FEET TO 2 FEET 6 INCHES, AND SECTION 45.26 FRONT Y.ARD SET BACK FROM FEET TO 2 FEET TO PERMIT CONSTRIICTION OF A 17 FOOT 6 INCH BY 25 FOOT ATTACHID G�RAGE ON LOT Mr. Mickley was preaent to speak on his own behalf. , --,.°-�: Mr. Mickley called to the attention of the Boaxd that the contractor for exiatix� dwelling ma,de an error in 9ide yard set backs when pourin.� the footings wherein the eide yard set backs are 20 feet instead of 25 feet, and 15 feet � instead of 10 feet, neither being in violation of any Code but making it necessary for the requeat for a side yard vaxiance of Section 45•23 (a�. This was confirmed by a copy of the origin.al buildix� permit. MOTION by Mittelatadt to close the public hearing. Seconded by Miniah. IIpon a voice vote, there being no nays, the motion casried unanimously. MOTION by i�fittelatadt to grant the two variances because the owner was a victim of circumetancea ina.smuch as the house was not placed on the property ae orig�ina,lly planned, and due to the co.ntour of the lot it prohibite the construction or use of a detached garage and it does not cause a hazard by reducing the front yard aet back and alao due to the fact tha,t none of the adjoining property ownera were present to preaent an objection to the requeated vaxiance.
