2.1. For an� such permit for the erection of any firerproof building, other than
a garage, werehouse, factory or grain eleeator, or for the erect3on of anv fire-
proof addition, for aimilar occupe,nc�, to aa�y existfng build3ng shall be at the
rate of �1..1F0 for each one thousand cubic f�et, or iraction thereof, in such
cubical contents.
2.2. For any such permit for the erection of any fireproof garage, warehouse�
factory or grain elevator, or for the erection of ar�r fireproof addition, for
similar occupancy, to any existing building shall be at the rate of �1.25 for
each one thousand cub3.c feet, classified as ��fireproof'� by Section 502 of the
Mirmeapolis Build3ng Code.

This is a letter of appeal in response to your denial of our° claim of the
damage to our basement from the sewer back-up we discovered on March
lOth,1999—the day we came back home from our vacation. We didn't know
where all the water was coming from, so uve called the plumber. He came
over right nway. He discovered that it wns the sewer that was backed-up.
We immediately called the city of Fridley and they came out nnd unplugged
the sewer system. The city foreman, Mr. Brimley came to our home 2 or 3
times. He felt really bad thctt this happened to us. He really felt bad when
we told him we had to cancel the rest of our vacation to clean und salvage
what was left of our 4-room finished basement. Judging by the smell, the
sewage had been there for many days. We left 7 days prior to finding this
catastrophe and I hnd put a pile of clothes next to the wushing machine th�
day that we left. I was going to wash them when we returned. Obviously,
they were irreparably damaged.
Since my father has been in insurance for several decades, I called him right
awny. He instructed us to take photos and videotape everything. Now I am
very glad he told us this.
Mr. Brimley was very kind and compossionate. He called SERVICEMASTER
and they nrrived later that day. With their tools they discovered the exte��°
of the sewage damage. The sewage soaked into all 4 rooms and extended f�
within 5 feet of the farthest corner of the rec room. Since it wns Q finished
basement, we had a eontinuous roll of carpeting, so to get ctt the foarn
�
padding undernenth they had to CUT UP all of our carpet to get nt nll %!��
foam padding which held most of the sewage. Now we have no fonm padding
and our carpet is in shreds. Furthermore, we do not have sewnge back-up
---
coverage on our State Farm homeowner s insurance.
The next day, Mr. Brimley came back at 9 n.m. to check on us and told us
that the city's insurance company would be in contact with us. Again, he
expressed how awful he felt about what happened. His concern made us f��l
a little better; we 4ppreciated his kindness.
That Fridoy, when you nrrived I said that we were interested in just being
reimbursed for what was actually damaged, such as the carpet (since our
new carpet was in shreds from the carpet cleaners), the clothes thnt were in
front of the washer, the trim that got wet, nnd our two wooden desks.
Fortunately, the computer and printer were set up high so they weren't
damaged. Also, we had set most of our boxes in the storage closet up on
cement blocks, so they weren't dmm�ged either.
When you responded, "We don't automatically reimburse for new carpet." I
again stated thnt I was a fair person and only listed whnt was octually
damaged. You replied, "Well, but how mvch time do you actunlly spen�
down here anyway?"
Aside from being n very unprofessional question and attitude, I listed all the
activites thnt my family participates in when we are in the basement. First
of all, I use our computer room (which was completely flooded) every day to
check our e-mQil, type my notes for the college class I teach, and our two
daughters have all their computer games on that computer. Sometimes they
play their gnmes for hours at a time. Additionally, the rec room contains o�r
2"d tv, all the girl's board games, their toys, a dresser, a futon, and nl) my
Mary Kay product that I sell. Additionally, we hnve a bathroom in the
basement and, of course the furnace room with our washer and dryer. ih�
sewage got into every room extensively.
After we received your deninl letter, I called you to ask for an arbifra�i�n
and you said that was not possible, that you do not offer that. I said that �
know that legally we DO have recourse. You replied that we could, '°... ju�t
�
hire a lawyer.'° I responded that hiring n lawyer would be more expensive
thnn our entire claim. You replied, "It's your choice," and hung up.
After that, my husband took off our trim in the basement and discovered
that there was extensive black mold growing up the drywall. Since we had all
been sick we figured it might be mold growing in the basement. Sure enough,
it wus. We are all terribly allergic to mold (both my husbnnd nnd I und our
two young daughters, ages 8 and 4). With a mask, my husband removed the
trim and pninted over the mold with "Kilz" paint. The next week we were all
STILL sick, so I called n contractor and he came to look at the basement
and chisled three wide holes in our drywall nll in different rooms of our
b4sement and discovered that mold hnd grown up several inches on the
INSIDE of our drywall. Just so we can LIVE in our house (we just bought it
7 months ago) we now have to have all the drywall replaced. Additionally, he
picked up the bottom of the carpet next to the stairs and discovered thaf
too was nlso binck with mold.
We have all this on videotape. I wondered why you refused to see the
videotnpe when you were here previously, now perhaps you would be
interested in seeing it.
If the initinl claim would have just been paid, we could have just fixed
everything immediately, now we have more serious problems. Even John
Hockus, an administrator for the city of Fridley was sensitive to our plight.
Even he claimed that our initiol claim was reasonable and he couldn't figure
out why it wasn't paid.
When I told you that I couldn't even stand the smell long enough to wash our°
laundry, you thundered, "I told you to get all of your boxes and things
out in the yard nnd let them nir out!" The point is that all of our boxes
were already upstairs. We put them upstairs the dQy we found out about the
sewnge. The smell is coming from the residual smell from sewage soaked into
all of our carpet, into all 4 rooms. It's a smell that cannot come out and we
have no windows in the basement to open to even air it out. How would you
feel if this wns YOUR basement nnd YOU were being treated so awfully by
an insurance compnny after your life had been so traumatically altered and
your basement smelled so bad that you couldn't even go into it much less
work in the cornputer room or allow your kids to go down there and play �aAth

their toys and games? You can never get little pet odors completely out of
the carpet, imagine 4 rooms full of sewage...the smell won't come out.
As for appealing your denial of our claim, my sister is married to a claims
nd juster and he strongly suggested thnt since we live in a heavily wooded
area, that the city should be clenning the streets more often thnn every 2+
years. You claimed that the last time our street wns cleaned was Februnry
4th, 1997. My brother-in-law claimed that heavily wooded areas should be
cleaned every 6 months to a year.
I am enclosing an estimate from the contractor. Please add this to our initinl
claim of carpet and clothes. We need to have this matter resolved before we
all end up in the hospital. Last week I contacted the Insurance
Commissioner's office. They were very interested in receiving a copy of youw
denial letter and my nppeal letter. Vnrious other agencies will also be
contacted. I am also sending this to our mayor. I believe that she needs to
know how her tax-pnying citizens are being treated by the insurance
compnny thnt is supposed to be representing the city. I am recommending
that our city look ut a different insurance compnny to represent them—one
that acts more like the people who work for our city, Mr. Brimley and Mr.
Hockus who demonstrated concern for our situation.

As you la�ow, the League of Minnesota Cities Insurance Trust provides coverage to our trust
member, the city of Fridley. My investigation into the sewer back-up is now concluded and this
letter will provide you with a written response to your claim for damages.
There are several azeas that we look at when determining if the city was negligent in causing
your back-up. When the employees were notified of the back-up they promptly responded to the
scene and relieved the blockage. Unfortunately they were unable to determi.ne the cause. This is
not unusual as there are head waters built up and when the blockage is relieved, the debris
plugging tue main line is �arried downstrsam with the flow.
The city has a cleaning maintenance program for their sanitary sewer lines. Records will show
Hickory Drive was last jetted February 4,1997. The employees did not run into any problems
during this routine maintenance. Additionaliy, there is not any prior history of problems on this
sanitary sewer line.
A city is not-automatically liable for resulting damages whenever a sewer backs up. The city is
only liable for those damages if the back-up was caused by their negligence. The city cannot
guarantee that its sewers will never back up. A sewer system is not a closed system. Any
resident that is hooked up to the system dumps waste in it. Some things can clog the systerri
which can result in a sewer back-up.
