In regard to the construction at th� above address, my
interpretation of the cod� is as stat�d herein.

Normally, private dw�llings are exempt for the jurisdiction
of this office. I am of the opinion however, that sound
practices should be follow�d in all construction and
remodeling, wh�ther it be r�sidential or some other classification.
$ec. 104 of the U.B.C, itc�m C, states alterations of 25% or less
shall comply with all provisions of the cod�.
Table 56 of the U.B.C. relating to Separations of Mixed Occupancy
shall have a one hour fire resistive s�paration.
In vi�w of these code r�quirements, I am of the opinion that th�
ceiling and walls of the garage adjoining any living area should
be of one hour fire resistive construction including any doors
communicating from one area to the other.

WETLAND PROBLEM - 1318 HILLCRE,ST DRIVE
In the past several months, Mr. � Mrs. Arvid R. Hansen of 1318 Hillcrest
Drive, (Lot 30, Block 3, Nloore Lake Hills) have expressed their concern
over the existing marshy wetland in their rear yard area. Their initial
concern was for the direction of flow that a potential overflow would take.
After an onsite inspection, cross-sectional survey, and review of topograph-
ical ma.ps, Mr. Hansen's oUserrrations were confirmed tha.t a potential over-
flow would progress to th� west of 1318 and along the east garage foundation
of 1316 Hillcrest Drive. A copy of the cross section performed by engineering
personnel�is attachecl, along with a copy of the certifica.te of survey for 1318
Hillcrest Drive, a copy of the topographic survey �,�ith the property in question
delineated and a copy of the pertinent 1/Z section. As can be seen from these
attachments, the wetland is shown encroaching on the property from the south-
east corner.
In conversing with the property owner, the city was informed tha.t only after a
bitwninous spillway was constructed to confine the drainage from the Ga.rdena
Elementary School's open area, was the limits of this wetland progressing to-
wards the residence of 1318 Hillcrest.
The property owner�was informed to contact the school district to try and re-
solve the problem. Some suggestions were ma.de and alternatives studied to
handle the fluctuating water level. The first of these would be to dred.ge out
sufficient material in the southeast corner of 1318 Hillcrest and use this
material to either raise the rear yard elevation, or build a retaining berm
which, wauld have the effect of greatly increasing the capacity of the existing
wetland area. With the surrounding deveZopment at its near capacity, the

storage requirements are not anticipated to increase a significant amotmt
from its present condition. _
Another suggestiion was ma.de to perform some minor regrading of the rear lot
area of 1318 Hillcrest and construct a gentle swale to the west property
line of said lot and reconstruct the concrete walk along the east side of
1316 Hillcrest to confine any overflow to the cormnon property line of both
residences to the gutter line of Hillcrest Drive. Our survey indica.tes that
presently, any flow will exit to Hillcrest Drive before endangering either
ha,bitable residence. .
'17ze third alternative which appears to be the most economical and feas ible,
would entiail the placement of a control structure or simply xaising the ele-
vatio� of the existing isthmus formation behind 1324 Hillcxest Drive (noted
on attached topography map.) The upstream ponding area can much better
handle any temporary increase in water elevation without any potential damage
to landscaping or existing residences. •
The last alternative encompassed the construction of an outlet storm sewer
system from the low area to the existing system on Gardena �lvenue at Matter-
horn Drive. This would enta.il approximately 800 ± L.F. with a surface inlet
structure required because of the minimal grade differential available. In
lieu of the other alternatives available, this would be economically unfeasi.-
ble.
These alternatives and suggestions are prehminary and upon selectian of one,
, further study can be conducted if it is determined to fall within the limits
of the City's responsibility. Based on the initial complaint, it would appear
to be a problem that should be solved between the affected property owners.

Mr, Arvid Hansen presented his concerns about the wetland
problem for him and his adjoining property owners at the
regular rr�eeting of the Board of Education on March 15, 1977.
The Board has directed me to inform the City Council of their
interest in arriving at a joint and equitable solution to this
problem. When the problem is serious, water is draining
through Mr. Hans en's property from some distance, A city
culvert drains into a swamp area adjoining and east of the
swamp on school property. There is apparently an overflow
from this swamp onto District 14 property and then through
Mr. Hansen's property to Hillcrest. At least this is what past
experience and a study of the elevations would seem to indicate.

SUBJECT: Gardena School and 1318 Hillcrest Drive Drainage Basin
On May 3, 1976 a report was prepared delineating the potential drainage
problem for 1318 Hillcrest Drive and suggested solutions to eliminate
the problem. Since that date additional review has been completed, analy-
zing the City's responsibility in regard to drainage runoff contribution
to the pond in the rear yard area of 1318 Hillcrest.
As indicated by the attached topographic layout, the City has a 15"
storm sewer outfall at the west end of 60th Avenue. This is an outlet
for a drainage area of approximately 3% acres from a developed
residential neighborhood. As can be noted on this topographic map, there
is a series of low lying depressions capable of acting as a detention
system for drainage runoff. For identification, they have been identi-
fied as the initial pond (A) being the smallest and most easterly;
secondary pond (6) being the larger and adjacent to the west of the
initial pond; and the tertiary pond (C) as being the largest and most
westerly pond which encroaches into the rear yard area of 1318 Hillcrest.
A storm sewer analysis was completed analyzing the drainage runoff
volumes as compared to the storage capacities available in this series
of detention basins. The rational method (Q=CIA) of storm water run-
off was incorporated taking into consideration the runoff prior to
existing development and its subsequent runoff after hard surface
streets with storm sewer and residential development had occurred. The
results indicate that the initial pond can handle the ten (10) year
fv�quency storm. This is a normal design frequency for runoff considera-
tion in the design of storm sewers. The initial pond was determined to
have a capacity capable of handling the 12 hour, ten year storm runoff.
In considering the effects of the 25 year and 50 year frequencies, the
r.unoff would then overflow into the secondary pond. This pond has
the available capacity to handle the 2 hour, 25 year storm or the 1 hour,
50 year storm. This is a design that is considered quite adequate for
storm water detention facilities. �
What this implies is that the City's contribution to any runoff as it
affects the tertiary pond is negligible. These computations took into
consideration that normal percolation and evaporation occurs in all ponds.
During the short time period when the ground freeze has not diss�pated,
the coefficient of runoff from the surrounding areas will increase and
these pond capacities will be reduced. It should be noted that in com-
puting the runoff from the City's storm sewer contributary area, a
maximum coefficient of C=0.9 was already incorporated.

Re: Drainage; 1318 Hillcrest
One of the suggested alternatives mentioned in the May, 1976 memo was
the placement of a small berm across the isthmus connecting the secondary
and tertiary ponds. This would have the effect of handling the additional
runoffs generated during spring season without adversely affecting the
tertiary pond.
Another.of the alternatives mentioned in the previously mentioned memo
was the dredging of this tertiary pond in the r.�ar yard area of 1318
Hillcrest and using this material to construct a berm, thereby increasing
this pond's capacity and reducing the threat of potential runoff across
Mr. Hansen's rear yard area. A rough cost estimate to perform this
berm construction and appropriate restoration has been prepared by Ralph
Volkman as per the attached memo. It should be noted that the material
for this berm construction is planned to be hauled in rather than
excavated from the tertiary pond area to avoid creating a potentially
hazardous depth situation adjacent to a residential area.

Mr. Nick Garaffa, 6750 Monroe Street N.E., stated he is aware other residents of the
area wished it to be left as is. He felt, if the City would provide a few loads of
dirt for Mr. Hansen it would become the City's responsibility as well as Mr. Hansen's.
Mr. Hansen requested this item be tabled until he has an opportunity to again meet
with the School Board and the residents of his area.
MOTION by Councilman Schneider to table this item. Seconded by Councilwoman Kukowski.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously.

RECEIVIN6 THE MINUTES OF THE FRIDLEY POLICE CIVIL SERVICE COMMISSION MEETING OF APRIL 6,
1977:
MOTION by Councilman Fitzpatrick to receive the minutes of the Police Civil Service
Corrm�ission Meeting of April 6, 1977. Seconded by Councilman Hamernik. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously.
Councilwoman Kukowski requested that the movie shown at this meeting of the Fridley
Police Civil Service Commission be shown at the Council's Conference Meeting on April 25.
CONSIDERATION OF INSTALLATION OF STREET LIGHT ON MEADOWMOOR DRIVE:
Mr. Qureshi, City �4anager, stated criteria for installation of this street light has been
met in that there has been excessive vandalism in this area.
Councilman Fitzpatrick indicated he had no objection to this request, but felt on a
similar request, which was not approved, he did not feel they should be that concerned
about a precedent being set.
MOTION by Councilman Schneider to concur with the recorrmiendation of the Engineering
Department and approve the installation of a street light on Meadowmoor Drive.
Seconded by Councilwoman Kukowski. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unani�ously.
CONSIDERATION OF APPROVAL OF COMMUNICATION TO COMMISSIONER OF THE MINNESOTA DEPARTMENT OF
TRANSPORTATION IN REGARD TO MINNESOTA DEPARTMENT OF TRANSPORTATION PLAN:
MOTION by Councilwoman Kukowski to approve the letter submitted and forward it to the
Commisioner of the Department of Transportation. Seconded by Councilman Fitzpatrick.
Councilman Hamernik, referring to page 2 of the letter, paragraph 6, said he still did
not feel re-routing traffic on Highway 47 was a solution.
Councilman Fitzpatrick stated he felt Highway 47 is better designed to handle traffic,
than is East River Road, but is not sure how much traffic would shift to Highway 47.
Councilman Hamernik stated he did not oaant to imply to the Transportation Study Committee
that there is an alternate solution other than construction of the Northtown Corridor.
He felt there is already a traffic problem on Highway 47 and, by shifting traffic
from East River Road, it could become a serious problem.
MOTION by Councilman Hamernik to amend the motion by deleting the sentence underlined
in paraghaph 6, page 2 of the letter. MOTION FAILED FOR LACK OF A SECOND.

Mr. Sobiech explained reapproval of this plat is requested in order to comply with the
90 day requirement of the ordinance regarding platting. fle felt on certain parcels of
land the 90 day period may not be sufficient time to complete any work that is necessary.
It was recommended reapproval be given on this final plat, with the original stipulations
pertaining to drainage, utility and walkway easements.
MOTION by Councilman Schneider to reapprove the final plat for Subdivision P.S. �76-04,
Heather Hills 3rd Addition, as filed by Mike 0'Bannon, with the previous stipulations.
Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
CONSIDERATION OF REVOCATION OF SPECIAL USE PERMIT SP #75-29, LEROY H�LUPTZOK; 1240 73z
AVENUE N.E.:
Mr. Sobiech, Public Works Director, stated in the annual review of this special use
permit, the staff felt there was a violation of the intent of the special use permit.
He stated the staff has been in contact with the o<<mer, and the petitioner has cooperated
in bringing the property into compliance with conditions of the special use permit.
Mr. Sobiech stated, as of today, the staff felt the site is in compliance and submitted
photographs of the site itself. It was, therefore, recammended the special use permit
not be revoked as staff felt the property owner was cooperating to improve the property
and meet conditions of the special use permit.
Councilman Schneider suggested a review of the premises again in the summer.
MOTIOfd by Councilman Schneider to receive the report submitted �y staff, Seconded
by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the
motion carried unanimously.
PRESENTATIGI�S:
Mayor Nee presented�to Mr. Ned Storla the Certificate of Incorporation of "Fridley Youth
Organizat?on, Inc." issued by the State of Minnesota extended cun9ra+ula�ions from the
Council.
l�� �' CONSIDERATION OF IMPROVEMENT AT 1318 HILLCREST PERTAINING TO DRAINAGE PROBLEM:
t� Mr. Arvid Hansen, 1318 Hillcrest�Drive, appeared before the Council concerning a drainage
problem he has on his property.
Mr. Sobiech indicated the problem area on a map and stated the pond that exists encroaches
on Mr. Hansen's property and the water, at times, builds up and flows across his property
and the property owner to the west of Mr. Hansen and finally flows down Hillcrest to
the storm sewer system. He felt there vrere some solutions to the problem; however, it
was the staff's opinion the City has not created the problem.
A visitor, who lived several doors from Mr. Hansen, indicated she did not want Mr. Hansen
to have water in his basement, but did not want to change her land. She indicated there
was a water problem tvhen Mr. Hansen bought the house, which was the reason the owner
had put in drain tiles.
Mr. Herrick, City Attorney, stated situations of this nature come to the attention of
the staff several times a year. It would be his recommendation the City should not get
involved in drainage problems that esentially involve private property.
Mr. Hansen stated the swamp level is higher than it u;ed to be and is, therefore, creating
the problem of the water in his back yard.
Mr. Dave Lucas, 1320 Hillcrest Drive, indicated the map Mr. Sobiech was using was a
1959 topographic map and it shows Mr. Hansen's property as wetland. He also indicated
he did not want Mr. Hansen to have water in his basement, but would not favor any changes
being made.
Mr. Sobiech indicated that the certificate of sur��ey on file indicates wetland on
' Mr. Hansen's property.

� Councilman Schneider questioned if a berm was constructed for Mr. Hansen's property, if
it would affect other property owners. Mr. Sobiech staied it would possible create
I additional wetlands elsewhere.
