'Ihe Co�cil of the City of Fridley does ordain as follaws:
SECTION 1. Appendix D of the City Code of Fridley is amended as hereinafter
indicated.
SECTION 2. The tract or area within the County of Anoka and the City of
Fridley and described as:
Lot 1, Western Ridge Estates, lying in the South Half of Section 24, �-30,
I�24, City of Fridley, Co�►ty of Anoka.
Is hereby designated to be in the Zoned District known as R-3 (general
multiple dwellings).
Lot 2, Western Riclge Estates, lying in the South Salf of Section 24, �30,
1�24, City of Fridley, Co�ty of Anoka.
Is hereb designated to be in Zonec] District known as R-2 (two family
dwellings� .

Mr. Flora stated it would cover all z ing c]istricts, except single and
double residential.

was considered single famil esidential and therefore not included.

Mr. Flora, Public Works Director, stated this property is located north of
I-694 and east of Highway 65. He statec] Mr. Fehn submitted a plat which
involves some property that is currently zoried R-1, R-2 and 1�3.
He stated, in order to proceed with the plat and construct the buildings,
rezoning is reguested so Lot 2 is totally rezoned to R-2 and Lot 1 is
totally rezoned to 1�3. He stated this rezoning would establish zoning
lines 4ased on property lines.

Mr. Flora, Public Works Director, stated the plat associated with Mr.
Fehn's property north of I-694 involves a part of Lot l, Audito
Subdivision No. 94 which has been reconveyed to the City for no use
purposes giving the City fee ownership. He stated the property i itself
is not developable and becomes excess property and the �arter r uires all
real property be sold or disposed of by ordinance.
MOTION by Councilman Schneider to waive the reading d approve the
ordinance upon first reading. Secondec3 by Councilman F" zpatrick. Upon a
voice vote, all voting aye, Mayor Nee declared e motion carried
unanimously.

Mr. Irrman, City Clerk, stated staff has go through the liquor ordinances
and added Ghanges which are covered by tate law and at the same time,
cleared up some of the language. H stated language regarding the
liability insurance in all chapters 6 to 607, of the code were changed
and these were minor changes which rely require that the Certif icate of
Insurance be sent to the City C1er and it also spells out the period f or
which the Certif icate of Insur nce must cover. There is a change in
�apter 601, Section 601.07 reg ding the definition of inunoral character.
This item was brought up by he Human Resources Commission and after
conferring with the City Atto r�y and Legal Intern, the new language is
their recomnended change. a

Mr. Irunan,� ty Clerk, the ci�ange in this ordinance involves the public
hearings �or license renewals. He stated in researching this item, it was
found that eight out of ten cities do not hold public hearings on renewal
licenses. Ae stated staff would still review the applications and the
option would still be there if the Council wishes�to call for a public
hearing.

MOTION by Councilman Aamernik to waive the reading of the public hearing
notice and open the public hearing. Seconded by Councilman Schneider.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the public hearing opened at 7:42 p.m.
Mr. Irnnan, City Clerk, stated this is a request by Parkview Developers for
the issuance of industrial revenue bonds in the amoun� of $800,000 for the
construction of a 20,660 square feet industrial �ommercial building on
Comnerce Circle South anc] University. He stated iti is estimated, when this
facility is cx�mpleted, there woulc] be a minim�nn vf 75 new jobs. Mr . Inman
stated staff has reviewed the application and wauld reco�nenc] approval.
Mr. Irm�an stated Dave Harris was present to ans�aer any 9uestions.
No persons i.n the audience spoke regarding the issuance of these industrial
revenue bonds.

MOTION by Councilnan Schneider to grant the variance to reduce the required
rear yard setback for a driveway fram 5 feet to 1 foot, generally located
on the northeast quadrant of Interstate 694 and Highway 65 on Hillwinc7 Road
with the stipulations t1�at a guard rail be installed at any location where
the retaining wall exceeds 3 inches in height. Seconded by Councilman
Fitzpatrick. Upon a voice vote, all voting aye, Ma�or Nee declared the

MOTION by Councilman Schneider to grant the variance to recluce the required
15 foot planting strip between different zones to 1 foot, generally located
on the northeast quadrant of Interstate 694 and Highway 65 on Hillwind
Road. �is variance applies to the approximately 80 linear feet area where
the driveway c.ames within one foot of the lot line and the rest of the
property lines that separate different zonings will be planted with a
landscape plan approved by the City. Seconded by Councilman Fitzpatrick.

The zoning of the above referenced lands have been particularly difficult to
establish due to unusual circumstances. The turnback lands in question are
shown in attachments 1& 2.
The original zoning map, enacted in 1955, showed a zone division line which
extended northerly - southerly through the middle of parcel A. Attachment
3 shows the original zoning in the area. The zoning division line established
by the original zoning map has been superimposed on attachments 1& 2. This
line apparently holds true today as no record of rezoning in the area exists.
Consequently, the City can safely conclude that the present zoning of the land
is still according to the original zoning map, as shown on attachments 1& 2.
The proposed development for this land is shown in attachment 4. The developer
proposes to establish new lots as shown in attachment 5. 6efore any of this
development can occur, the following will be necessary:
1. Obtain turnback property and tax forfeit lands from City.
2. Rezaning of parts of land to the appropriate zone.
3. Platting the land to "clean" up complicated legal descriptions.
4. Obtain various setback variances.
Request the council's disposition regarding this development proposal. If
council is in favor of this, I recorrmend: they consider rezoning other parts
of lots in the area so the zoning lines and lots lines are the same.
