On August 4, 1986 , the Fridley City Council officially approved
your request for Variance requests, VAR #36-18, to reduce the front yard setback
from 35 feet to 28.5 feet; to reduce the side yard setback from 5 feet to 0
feet to allow tne construction of an attached accessory building on Lot 3,
Block 1, Lakeland Heights, the sar�e being 1333 Hillwind Road PJ.E.
with the following stipulations:
1. If the work has not commenced within one (1) year after granting this

on the inside and the furnace is in the garage. He stated the petitioner
wishes to widen the existing c�rage and move the parking area forward so
that the furnaoe oould be housed outside the garage area. He stated if the
variances are approved, it is recommended the west wall be a one-hour
fir�rated wall with rio openings and an eas�ne.nt for maintenanoe pirposes be
attair�d fran the adjaoent neic�bor.
Co�mcilman Schr�eider asked Mr. Parker if he has agreen�nt with the nei ghbor

Mr. Barna stat that basically, they were lookin at clean-up work, except
for the second si e yard variance, and they hav a letter from the adjoining
neighbor stating�no bjection. The adjoinin neighbor also had a parking lot
there, so there would e no decrease in gr en space and no change in fire
fighting ability, etc., he felt the irit of the code was being met.
Ms. Savage agreed. She felt th � iance requests seemed reasonable. She
did agree that the purpose of t ordinance was being met. Regarding the
second variance request, once e cation occurred, there would be no variance
anyway, so she had no probl with t variances as requested.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.3, D, 1 requires a front yard with a depth of not less
tfian thirty�five �35) feet.
Pub7ic purpose served by this requirement is to allow for off-street
parking without encroaching on the pub7ic right-of-way and also for
aesthetic consideration to reduce the building "line of sight" encroach-
ment into the neighbor's front yard.
Section 205.07.3, D, 2b requires a side yard of not less than five (5)
feet between an attached accessory building or use and side property
1 ines.
Pub7ic purpose served by this requirement is to provide space between
individual structures to reduce the conflagration of fire, to provide
access to the rear yard for emergencies and to limit the condition of
crowding in the residential neighborhood.
B. STATED HARDSHIP:
"My wife and 1 each need an�.automobile to get to work. In Minnesota
it's a rea] hardship having one car sit outside all the time, especially
in the winter."
C. ADP�1INISTRATIVE STAFF REVIEW:
The petitioner's present garage is about 13 r'eet wide on the inside.
The furnace is in the garage and the�petitioner hesitates to park his
car in the garage because he fears a fire may occur. The Code does not
prohibit furnaces in garages as long as there is no open flame less than
18 �r��c��s �ff the floor. He wants to widen the existing garage and move
the parking �re� for�r�d so that the furnace could be housed outside the
garage area. Tf �9�e Boa�d approue� this request, we recommend that the
west 4�a]7 be �a�e-hou�° fire-ra�te� �vi� r�o openinqs, and that an easement
for maintenance purposes be attained from the adjacent neiqhbor. Also,
a new survey should be made to monument the west property line to assure
proper placement of a structure this close. The only utility now in the
easement is a telephone cable. It may have to be relocated. This
variance must go to City Council to authorize the utility easement encroachment.

1Ns. Diane Puckett, 1343 Hillwind Rd., stating they had no objection to the
construction of additional garage space. Also in the agenda were let�ers
from the utility companies. The only utility in there right now was the
telephone company, and that might have to be relocated. The relocation
would be at the owner's expense, and Mr. Parker has agreed to that.
Mr. Clark stated the existing garage is 40 ft, back from the curb so even
witF� the addition, there would still be 282 ft, to the curb. Mr. Parker
thlnks he knows the approximate location of the west property line but is not
sure. The measurements were taken to what is assumed to be the west property
line. So, it was expressed in the staff report that before anything is built,
the west property line should be monumented to ensure proper placement of
the new structure. If construction takes place the way the petitioner is
proposing, the addition would be 22 ft. away from the neighbor's house,
which was adequate for fire protection.
Mr. Clark stated it was mentioned in the staff report that the furnace was
in the existing garage, and the petitioner hesitates to use the garage for
fear of fire.
Mr. Barna stated he wanted it noted in the minutes that the construction of
a detached garage in the rear yard would be almost impossible because of the
severe drop in elevation into the back yard and the lack of adequate space
for a driveway to the rear yard.

Mr. Barna stated the only real problem he had was going from 5 ft, to 0 ft.
He did not thi�k there were any zero lot lines on residential pronerties
at this time.
Mr. Clark stated P1r. �'arker's lot was the most westerly lot in Lakeland
Heights, and his neighbor's lot was the most easterly lot in Sheridan Acres,
s o there was the possibility there might be a gap of Z-3 ft. between the two
lots. He stated he would think that any part of the petitioner's garage and
any part of the roof would have to be on the petitioner's property and that
an easement for maintenance purposes be obtained from the adjacent owner.
Ms. Savage stated she had some concerns about the closeness to the property
line on the west wide. Of course, sf�e realized they have to consider the
fact that even tfiough the present neighbor doesn't disagree to the variance
or the maintenance easemQnt, a i�ture owner might. She was impressed with
the fact that the r�eighb�r'� �h�u�se was r��t rig�t r��t to the petitioner's
lot line so the addition would no� be encroac���sq so much or� another building.
She felt that fact made the varia��ce �equest sonewhat more reasonable. She
felt there was clearly a hardship expressed by P1r. Parker about the need for
a garage for cars, especially in Minnesota. She would be in favor of
granting the variance requests.

Mr. Sherek agreed with the fact that there was a sufficient hardship expressed
in not being able to use a garage in Minnesota. As long as consideration
was-made to tf�e new survey, the maintenance easement, and the petitioner taking

The aesthetic front lot line was not in a straight line on these streets any-
way. The house to the west was at a 55 ft, setback, and the house to the east

to the street but angled to the street. He cou7d see the hardship definitely
�lth tfie way the fiouse was designed and built with the furnace in the back of
the existing garage. The only real problem he had was with the zero lot line
at tF►e side lot line, but as pointed out by P1r. Clark, there could be a 2-3 ft.
