VARIANCE
The above entitled matter came before the Appeals Commission of the City of
Fridley and was heard on the 15th day of August � , 19 94 , on
a petition for a variance pursuant to the City of Fridley's Zoning Ordinance,
for the following described property:
To reduce the front yard setback from 35 feet to 30 feet, to reduce the setback for the
front patios from 25 feet to 18.9 feet, and to increase the width of the driveways from
32 feet to 36 feet, all to allow the construction of townhomes generally located at
971 Hillwind Road N.E. Please see attached for legal description.

Councilwoman Jorgenson was concern about�the dirt from the trucks
on the residential streets flow' g into Moore Lake. She felt that
this issue shou�d be addres .� .
Ms. Dacy stated tha his could be included in the developer's
� agreement th�t th oads are to be kept clean.
Mr. Flora s ed that this could also�be handled �aith the buildirig

TOWNHOMES,�TO REDUCE THE FRONT YARD SETBACK FRONi 35 FEET TO
30 FEET .IN ORDER TO ALLOW THE CONSTRUCTION�OF TOWNHOMES
GENERALLY LOCATED AT 971 HILLWIND ROAD N.E.:
Ms. Dacy, Comanunity Development Director, stated that this variance
pertains to the eight-unit building in N�r. Harstad's development.
She stat�d that the request is to reduce the. front yard setback
from 35 feet to 30 feet. Slie.stated because the proposed condo- �
minium design includes patios with privacy wa11s ac�jacent to the {
front entries, the setback for the patios will also be reduced, from
the required 25 feet�to 18.9 feet. She stated tha� because the
patio is not enclosed, site lines should not be affected. She
stated that the petitioner is.also proposing a 36 foot.wide drive-
way. The R-3 regulations limit the width of a driveway to 32 feet,
so a varianee is needed.
Ms. Dacg stated that the Appeals Commission recommended approval
of all three variances subject to approval of the rezoning, vaca-
tion, and plat request. She submitted photographs of the proposed
townhomes showing the front entry areas.
MOTION by Councilman Sehneider to concur with the recommendation
of the Appeals Commission and grant Variance Rec�uest, VAR #94-02,
by Forrest Harstad of Twin City Townhomes to reduce the front yard
setback from 35 feet to 30 feet; to reduce the setback for the.
front patios from 25 feet to 18.9 feet; and to increase the width
of the driveways from 32 feet to 36 feet. Seconded by Councilman
Billings. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unaMimously.
Mr. Harstad stated that he wished �o thank Council for their
approval of his development and for the excellent help he received
from the City staff who worked with him on this development. .
