Six 2$ 8's, 12' �,ong, (f].00r joists) had been broken from some heavy object
hittiag the deck. This has not damaged the flooring in any respect at this
point, and the joista can either be replaced or jacked up and a new joist
acabbed to the side of the old one.
Two joiats had been dama.ged in the bathroamn and in this area, approximately
8 sq. ft. of flooring ha.d been cracked and broken.
This ent3re dama.ge was obviously not from the tornado.

SECTIOR 2. The Inspector of Buildings ahall, befo�e isauing any permit for
the erection of any building or atructure,�or fot�ang addition to any exiating
building or s�tructure, or for any alterationa or �repairs,to any existing
building or sts�icture, upon application therefore, require the payment hy the
applicant_for_euch permit of fees'to the amount herein below �et forth and in
the macmer�herein provided to-wit; �

thereaf, in such cubical contents.

please be advised that sir�ce July 21, 1988, I have received calls fr�oan six
h�eowners who a�,m Y�xnes in the vacinity of the 5300 block of Horizon Drive,
requesting that I inspect their house foundations because of apparent
differencial settlgnents. Prior to these calls we had inspected 5 other
fourr3ations durir�g 1987 ar�d 1976 that were in this gerieral area.
There appears to be a pattern of things that probably have caused these -
settlenents to occur or are present at each location:
1. They have all occured durir� long chy spells (1976, 1987 & 1988).
2. All have had mature trees growir�g in the ger�eral vacinity of the failure.
3. Yard arrl street settlement has also occured in fzont of those l�nes tl�at had
mature trees in the fivnt yard r�ear the failure.
4. All those that have had soil tests done have had a layer of moisture
receptive or active soil at or belav the fqoting elevation.
5. All hameowners have been advised to contact a soils engineer to test arid
report their fir�clir�gs arid to suggest the n�eethod of correction.
6. All of the Yxmes were built in the mid 1950's.
The cost of repair will depend upon the extent of the failures. We estimate the
cost of such repair to range between a minimiun of $500. �0 to a maxi.mum of
$20,000.00 or possibly higher. One ho¢ne repaired in June, 1987 paid an
estimated $3,000.00 to a contractor to rePlace the Y�ack wall (32 feet) of their
basanent. That repair oonsisted of the follaaing: temporarily supporting the
structure on post ar�d timbers; ranaving the iiack foundation wall am� footing;
digging down tturou� approximately six feet of clay or silt to granular gravel
at thre� locations (each hole was about 4'x 2' ); pouring each hole full of
concrete; pourir�g a reirrForced voricrete grade beain wer the top of the new pads
to fonn a rnw footing; laying up a r�ew block wall ; arzd setting the house back
clown.

of all reported prcabl ens.

There are a nm�ber of har�es in the Carlson S�mit Marnr North Addition which
have e�cperier�ced four�dation settlenent due to the loss of grou�d water and
eonsolidation of bed material.
we have received a letter from Mr. arrl Mrs. Dzubak of 129 Horizon Circle
requesting a large e1m boulevard tree be removed. They have experienced
large cracks and settlenent . of their basenent wall ar�d f eel a portion of the
prnbl� is a rns�alt ctf the elm t,ree absorbing grour,d m�isture.
A rnanber of the hane.s in this area have also experienced the same problen.
This beirx,� an older, m�re developed portion of the city, there are large
trees in the bc�levard, fzont ar�d �ar yaxds, and sideyaxds. If the city did
deteanine to renwe a boulevard tree, th� aay be establishing a precedent
for the ratioval of aarr� bwlevard tsees in this r�ei��Uori�ood.
Whi.le trees can be a contributing factor to soil consolidation, once the
material has been aonsolidated it does not mnnally expar�d rnr can it be
further eat�ressed. Assuni� events have caused the ground in the area to
consolidate to its maximtan, reqnwing a tree will have rn effect on the
future. �erefore �onsideration s,hould be given to the past events and to
the overall ap�arar�ce o� the r�eigt�borhaod.
Request guidance f rosn the City Council on what action we should take in
regarc3ss to this request.

Today I met with the Fridley Building Inspector to
check-out cracks in the wall and floor area of our basement. These
cracks have been caused by dry weather conditions, and soil problems
in the neighborhood. They have also been enhanced by a large Elm tree
on the boulevard.
Per recommendations of the City Inspector , and to
stop any further damage, I am requesting the City of Fridley to remove
the Elm tree as soon as possib��.

SUBJECT: petition from Joe Dzubak of 129 Horizon
Circle Requesting Removal of Boulevard Tree
On November 2, 1988, we have received a letter (Petition No. 23-
1988) from Mr. Joe Dzubak, 129 Horizon Circle.
Mr. Dzubak is one of the home owners on Horizon Circle that has
experienced foundation settlement and basement wall cracking. In
his letter, he is requesting the City remove a boulevard tree in
the front of his property.
As the boulevard tree is an elm tree and is susceptible to Dutch
Elm Disease, and as the tree is a probable cause for the removal
of water from the soil causes the settlement of his basement
foundation, and as removal of this tree is consistent with the
purpose of Ordinance No. 510 (Tree Preservation), I would recommend
the City Council authorize the Public Works Department to remove
the boulevard tree in front of 129 Horizon Circle.

Mr. Flora, Public Works Director, stated Mr. Dzubak, 129 Horizon
Circle, has petitioned the City for removal of the boulevard tree

in front of his property. He stated this is the only 1•arge tree
on the property and located directly in front of the home that has
experienced foundation settlement in line with the tree. He stated
the City's soil consultant has indicated that the tree contributed
to the cause of the water loss, clay consolidation, and.footing
settlement. He 6tated the tree is an Elm susceptible to�disease
and there ar� no other trees on the property. He recommended the
City approve the request of the homeowner to remove the tree, with
the understanding that no replacement trees will be provided.
MOTION by Cou�cilman Fitzpatrick to receive Petition No. 23-1988.
Seconded by Councilwoman Jorgenson. Upon a voice vote,'all voting
aye, Mayor Nee declared the motion carried unanimously.

10. CONSIDERATION OF A MOTION TO ALLOW A PORCH TO BE BUILT OVER
A SANITARY SEWER EASEMENT LOCATED AT 5505 WEST DANUBE ROAD•
. Flora, Public Works Director, stated the property owner at 5505
We t Danube Road would like to build a deck on the northeast side
of h home that would encroach four feet into the existing utility
easeme running along the north side of the property. He stated
staff ha inspected the property and does not feel it would create
a problem i the City had to perform maintenance on the storm sewer
line. He ated it is recommended the Council approve the
encroachment i o the utility easement, with submittal of a hold
harmless agreemen that can be recorded at the County.
MOTION by Councilman chneider to approve the encroachment into
the utility easement at 505 West Danube Road with the stipulation
that the petitioner ente into a hold harmless agreement to be
recorded at the County. Se nded by Councilman Fitzpatrick. Upon
a voice vote, all voting aye, yor Nee declared the motion carried
unanimously.
